Subject: - Grant of Dearness Allowance to the Gramin Dak Sevak employees of the Department of Posts.

Madam,

While the Sixth C.P.C has already submitted its report and Government orders for payment of pay and allowances at revised rates have been issued, our request for extension of similar benefits to the G.D.S employees does not appear to have borne any fruit. In the mean time as per the norms another instalment of D.A. have fallen due from 01.07.2008. In case of those employees, who are not in receipt of the Sixth C.P.C pay and allowances, the old pay and D.A. at old rates continues to paid. The G.D.S employees are such employees who still continue with the old pay and allowances.
As per confirmed statistics average twelve monthly indices of dearness (306.33 percentages over 1982 base) have crossed 104% Points – 104.40% to be precise. The last instatement of D.A. w.e.f 01.01.2008 was sanctioned on average 97 percent of D.A. indices. Hence dearness allowance at the rate of 7% have become due to be paid to the G.D.S employees

We, therefore, request you kindly to cause issue of necessary orders for payment of further dearness allowance of 7% to the G.D.S employees of the Department of Posts w.e.f 01.07.2008. In case of implementation of revised pay and allowances, at any time in future, the instalments D.A. paid between the date of effect of revised pay and allowances and actual payment including arrears are adjustable, and the instalalment of D.A. payable w.e.f 01.07.2008 will be adjustable against arrear payments.

We, sincerely, hope that you will kindly cause issue of orders for payment of D.A. at the rate of further 7% to the GDS employees.

The orders regarding payment of pension and family pension also have been issued vide Department of Pension & Pensioners' Welfare OM no. 38/37/08-P&PW(A) dated 01.09.2008.

But a section of employees of the Department of Posts who are known as Gramin Dak Sevaks (GDS) are kept bereft of the benefits. Despite our full throated demand that the issues relating to the GDS employees be referred to the Sixth C.P.C a separate Committee under the Chairmanship of Sri R.S. Nataraja Murti was constituted. The Nataraja Murti Committee has not so far submitted its report.

The G.D.S. Employees serve the rural population by providing several postal services and other services like RPLI, N.R.E.G.A etc. The full work taken together justifies the extension of all recommendations of the Sixth CPC to the Gramin Dak Sevaks employees by regularizing them we have placed the demand before the Nataraja Murti Committee with full Justification. But the said committee has opted not to submit its report this time. While other employees will be enjoying the revised pay and allowances and getting arrears to celebrate the Pooja and Diwali festivals, the Gramin Dak Sevaks feel dejected and disappointed.

We, on behalf of about three lacs of Gramin Dak Sevaks of the Department of Posts crave your indulgence to utilize your good offices to ensure that the benefits of implementation of the Sixth C.P.C. report are extended to the GDS employees also.

20.08.2008 One Day General Strike:-
My heartiest congratulations to all the comrades who have participated in the 20th August, 2008 strike and made it a grand success in postal GDS. Reports are quite encouraging that in many circles there was total dislocation of service like West Bengal, Kerala, N.E. Circle Manipur, Tripur, Assam, Jharkhand, Chattisghar, A.P. M.P., Oriss, Karnataka Circle and other Circles our comrades proved once again that they will show their oneness and unity against all anti-worker policies of the Government. Our sincere appreciation to all the Branch/Divisional Secretaries at base levels who engineered this movement and made it a grand success. Any organisnal weakness, if any, may be reviewed at base level for strong union movement. Further request to all our leaders to uphold the same spirit in the days to come, especially for realising the major demands of GDS employees.

Early submission and implementation of the GDS Committee:-
We protest delay in submission of report of GDS Committee. As you are well aware, there is no reason to delay submission of report by the Nataraja murthi committee. We have already registered strong protest in this regard and also sought for intervention of the Union Minister.The report of the 6th Central Pay Commission IS UNDER IMPLEMENTATION STAGE, cabinet has given its approval. payment of enhanced pay and allowances will begin form the month of September, 2008. The orders for such payment are expected to be issued in a day or two. You are aware that the inflation is flying sky high and the poor GDS employees are the worst hit. The GDS employees have undertaken various types of business introduced by the Department are performing such business with excellence. But the pay and allowances of the GDS employees remains by and large stagnated, but for the six monthly increases in D.A. They find themselves between rock of heavy work and hard stone of lesser payment.The enhanced payment to aII Central Government employees including the GDS employees will certainly create a sense of demoralization in the minds of GDS employees, a dissatisfied lot whose number is around 3 lac spread over every part of the country to serve the rural people certainly can not be expected to be as good an asset as a satisfied lot of employees? This reality has got to be taken note of very minutely. An atmosphere of uncertainty prevails as to the time of submission of the report of GDS Committee headed by Sri. R.S. Nataraja Murti. In such a situation when the other Central Government employees well get enhanced payment, the GDS employees will be looking on like neglected children. Their psychological frame of mind will certainly be one of despondence and hopelessness.
We requested the Govt. to ask Sri. Nataraja Murti Committee to submit an interim report on pay and allowances immediately while the other part of the report could be submitted later.

All Divisional/Branch Secretaries are requested to mobilize members of this mighty Union. In order to realise our long pending demands viz.,Departmentalisation of GDS, Pension, Status and
other benefits enjoyed by Departmental employees we should galvanise the movement and go ahead of still serious form of agitations such as INDEFINITE/TILL SETTLEMENT HUNGER FAST,MASSIVE PARLIAMENT CHALO, INDEFINITE STRIKE/RASTA ROKHO etc., Following steps for extensive and intensive preparations should be taken;
(A) Extensive tour in the circle by circle union representatives and of the Division by Divisional union representatives should be undertaken and members should be educated about the issues/development. As regards the issues pertaining to the members of this union, much matter has been provided in several issues of the union journal- Rural Postal employees.
1. During third week of September, i.e., 15-09-2008 to 18.09-2008 Black Badge wearing at work places,
2. 19th September 2008 Massive Dharna before Divisional Office, Posters/handbills in local language should be brought out highlighting the demands. Press notes/press statements should be issued to highlight the issues and media kept in touch.
3. September and October 2008 State level convention mobilize more members and popuarise our demands and invite local prominent Trade Union leaders and public leaders. Also handover memorandum to the Govt. through Governors, MPs,MLAs and Chief Ministers. We should plan rallies/ meetings along with other constituents of the JCA.
4. INDEFINITE/TILL SETTLEMENT HUNGER FAST,MASSIVE PARLIAMENT CHALO,INDEFINITE STRIKE/RASTA ROKHO etc.,
The above Programme also enderrsed by Confedration, NFPE and other Unions. All Circle/Divisional/Branch Secretaries are requested to mobilise members for the grand success of struggle programme,

Attention Please/Remittance of Quota:-
The Directorate has approved the amendments made in the Constitution in the All India Connfrence held at Rewa vide its letter no. 15-02/2008-SR Dated 08-07-08 and the copy of same was already sent to branches for information and necessary action. All Circle secretaries are requested to caution all the Divisional Secretaries during this month to remit Quota to the Circle/CHQ.
All Circle/Divisional/Branch Secretaries should ensure prompt remittance of Quota to Circle/All India Union at the rate of Rs 2/- & Rs 2.50 respectively. The remittance should be made regularly and there should not any lapse in remittance which will be viewed seriously.

Comrades, we are at the extreme receiving end of all the offensives and have to wage a hard struggle. We seriously believe that our comrades will fall in the front line of the struggle.

Abolition of Group D cadre is in fact blocking the promotional avenues of the GDS is another injustice meted out to the postal GDS employees. We strongly oppose it.

CHARTER OF DEMANDS

1. Regularization and grant of pension, Gratuity, T.U. Facilities and all other facilities to Gramin Dak Sevaks in the Department of Posts.
2. Take urgent step to contain price-rise through (a) universalizing the public distribution system throughout the country to cater all essential commodities at controlled price through PDS, (b) ban on futures and forward trading in all essential commodities, (c) reduction of tax in petrol and diesel, (d) stringent action against hoarding and black marketing.
3. Strict implementation of all labour laws particularly in respect of minimum wages, working hours, social security and safety and stringent action against all cases of violations; stop contractorisation and outsourcing.
4. Scope of the Unorganised Sector Workers Social Security Bill pending in Parliament should be expanded to cover all unorganized sector workers irrespective of BPL or APL category to ensue a national minimum social security benefit for them as per unanimous recommendation of the National Commission for Enterprises in the Unorganized Sector (NCEUS) and the Parliamentary Standing Committee on Labour with Central Govt. Funding.
5. Farmers Loan Waiver Scheme to be extended to loans from private money lenders; nationalized banks to extend easy credit to peasants at lower interest rate.
6. Lift ban on recruitment in Govt. services; remove the negative and discriminatory features in the recommendation of 6th Pay Commission and finalise the same for implementation in consultation with the employees organizations:
7. Expedite wage negotiation for the employees of Central PSUs including the contract workers without any conditionalities.

Dear Comrades,

We are furnishing hereunder some recent developments concerning the postal employees in general and GDS employees in particular.

Central Working Committee Meeting
The Central working committee of our union met at Aggrawal Dhrmashala MODEL TOWN – II, Delhi – from 29-08-2008 to 31-08-2008 under the presidentship of Com. D. N. Giri Prisident CHQ. The C.W.C. was inaugurated by Com. K. Raghavendran, Secretary General NFPE, and the open session was addressed by Com.K. V. Srideran General Secretary, P-III Com. P. Suresh General Secretary R-IV, Com. B.G. Tamahnkar, Ex. President NFPE, Com. R.A.P. Singh, Ex-General Secretary, P-III, Com. D.P. Diwakar, Com. Somnth Mukrje Dy. G/S P-III, Com, Belvindhar Singh, Asst. Treasurer P-III, and others.

The C.W.C. members who attended the meeting debated and deliberated the items of aginda at length. After thorough discussion, the C.W.C. adopted valuable resolutions on the issues confronting the GDS employees.
T.U. Class
A Trade Union training session was held on 29th July, 2008. Com. D.P. Diwakar while addressing the session dwelt upon the history of NFPE in detail and important events the trade union movement. Com. B.G. Tamhankar dealt with the minute aspects of the Right to information Act 2005. Com. R.A.P. Singh in his addess to the session mainly dealt with the basies of trade union movement especially with the economic and political aspects.
Resolution on policy and programme .
This meeting of the Central working committee of All India postal Extra Departmental Employees Union in session on 29th, 30th & 31st of July 2008 at Aggarwal Dhrmashala, Model Town-II, Delhi-7, seriously considered the pros and cons of the extension sought by and granted to Sri R.S Nataraja Murthy committee on GDS issues. This CWC has come to the conclusion that all does not appear to be well in the thinking of the Nataraja murthy committee with respect to the GDS employees.

This CWC is of strong opinion that the denial of audience by the Secretary, Department of post to the representatives of this union to record protest against the extension is not only bureaucratic but displays the contemptuous attitude of the Secretary, Department of Posts towards the GDS employees. This Union has already that demanded to submit an interim report of Sri Natarajamurthy Committee, which is yet to be directed to the Committee be submitted on basic issued, but no direction has been issued to Natarajamurthi Committee nor any intimation sent to the union.

To press the demand of the GDS employees that Sri Nataraja murthy committee must submit its report on the pay and allowances of the GDS employees while the second part of the report could be submitted latter, this CWC resolves that a sustained struggle must be waged.

This metting of Central Working Committee calls upon all Circle/Divisional/Branch Secretaries of AIPEDEU to stage intensive demonstration on 18-08-2008 at all levels and to pass a suitable resolution. The Circle/Divisional/Branch Secretaries to send Telegrams / Savingrams to the Hon'ble Minister for Communications & IT, Minister of State for Communications & IT expressing their strong resentment of the issue.

This Central Working Committee further authorizes the General Secreary, AIPEDEU to finalize further program of action in consultation with sister Unions and Federation viz.,March to Parliament, indefinite strike in case the demand is not met by the given time.

Resolution II
This meeting of the Central Working Committee of All India Postal Extra Departmental Employees Union in session at Aggrawal Dharamshala Delhi form 29 to 31.07.2008 expresses its grave concern over the lethargic functioning of Sri Natarajamurthy Committee constituted to study and make recommendation of Pay and Allowances and Service conditions of the GDS employees. The extension of three months sought by and granted to the Committee betrays lack of justification, commitment and sincerity of the Committee.

This CWC very seriously feels that the Committee in order to avail the luxuries of the office on the Government cost about 2.8 lakh GDS employees for a ride and has put them to ransom. This CWC expresses its gravest disapproval of the attitude of the Committee.

This CWC records its serous disapproval of the bureaucratic attitude of the Secretary, Department of Posts, who very arrogantly denied an audience to the representatives of this Union who tried to communicate their reservation on the extension sought by Sri Nataraja Murthy Committee.

This CWC expresses its deep apprehension that this extension of the term of Sri Nataraja Murthy Committee is fraught with dangers of the serious injustice and discrimination against the GDS employees.

This CWC, therefore, keeping in view every aspect of the issues involved demands that the Sri Natarajamurthy Committee be asked and submit its report on the pay and allowances latest by the 20th August 2008 and the second part of the report in respect of other issues may be submitted later but not later thau the last date of the extended period.

In case it is not done, the members of the Union would be left with no alternative but to wage a sustained struggle to draw the public attention towards the injustice and to achieve the genuine demands.

One Day Strike On 20.08.2008:-
Notice for one day takon on 20.08.2008 has been served by the NFPE which is an affiliate of the Confederation of Central Government employees and workers. We have also served notice to go on strike on 20-08-08. As always we shall contribute our share to the strike. We support the call and our members will participate in the strike with all zeal and valour. We do support the demands including GDS issues regualisation and grant of Pension and all other benefit to Gramin Dak Sevaks.The dession of the Countrywide General Strike on 20th August 2008 was taken unanimously at a envention organised by all Central Trade Unions and employees federations.This is the first time that all Central Trade Unions issued call including the demand of regualisation of GDS employees, grant of Pension and all other social benefits.We, therefore, call upon our members to mobilize and organize the strike with all strength. A copy of the notice is enclosed herwith for information and necessary action.

Remittance of Quota:-
The Directorate has approved the amendments made in the Constitution in the All India Connfrence held at Rewa vide its letter no. 15-02/2008-SR Dated 08-07-08 and the copy of same was all redey sent to branches for information and necessary action.

All Circle secretaries are requested to coution all the Divisional Secretaries during this month to remit Quota to the Circle/CHQ.

We are furnishing hereunder some recent developments concerning the postal employees in general and GDS employees in particular.

20th August, 2008 One Day General Strike

The National Convention of Trade Unions was held at New Delhi on 13th May 2008 at the call of the Sponsoring Committee of Trade Unions comprising the major Central Trade Union in the country and the all India federations/associations of employees in telecom, railways, defence, banks, insurance, various public sector units, central and state government offices and departments etc. It expresses grave concern over the disastrous fall out of the anti-worker, anti-people neo-liberal economic policies of globalization and privatization of the government at the central leading to relentless price rise which has hit hard the common people and virtually pauperized the working class and the poor. The Govt. is not honouring the commitments made in its National Common Minimum Programme (NCMP), with the result that the agrarian crisis continues unabated. Speculative trading dominates the commodity market and public distribution system stands virtually collapsed making the situation unbearable for common people. The Govt. turned a deafear to the popular demands of the people to universalize the public distribution system, ban futures and forward trading in essential commodities, reduce the tax burden on petrol and diesel and take strong visible action on black-marketing and hoarding to protect the common people against the impact of price rise.

The working class and peasantry who create wealth for the nation are getting raw deal. The workers and employees also face severe exploitation. Growth in industrial and service sector is accompanied by mass scale outsourcing, contractorisation and casualisation at work-places throughout the country which is aimed at curtailing the wage cost through distressed wages to a large section of the workers and employees. Unemployment is also growing alarmingly. Basic labour laws in respect of minimum wages, working hours, social security benefits are being desperately violated by the employers with active indulgence and patronage of Govt. The provisions of the Unorganised Sector Workers Social Security Bill 2007 placed in the Parliament is totally inadequate to ensure a minimum social security care for the concerned workers and as such, overwhelming majority of the unorganized sector workers in manufacturing and services are virtually kept outside the coverage of that legislation.

The Convention resolves to go in for phased agitation by the working class all over the country to culminate in countrywide strike action to press for the six demands including GDS issues regualisation and grant of Pension and all other benefit to Gramin Dak Sevaks.The Convention unanimously decides the Countrywide General Strike on 20th August 2008.This is the first time that all Central Trade Unions issued call including the demand of regualisation of GDS employees grant of Pension and all other social benefits. It is our duty to make the programme a grand success.

All Circle/Divisional/Branch Secretaries are requested to give wide publicity among the members. All are further requested to mobilise members for the grand success of struggle programme, General Strike on 20th August 2008.

Arbitary Grant of Three Months More Extention Time to GDS Committee:-
We feel present time given to the GDS committee is more than sufficient to submit its report for the very reason that the committee is looking into the matter after Justice Talwar Committee which had indepth study in all the matters. So, in the over all interest of the Department and the public service we also appealed not to grant extention of time, if any, to the GDS committee which is due to submit its report by July, 2008. But the Department of Post recomneded Grant of extention three month more that will creat lot of resentment and unrest in GDS minds. We shall fight against this arbitary decision.
Sixth CPC has taken 18 months time to finalise various issues of 37 lakhs Emplyess where as the GDS Committee which was granted 12 months time is seeking further three months time. If the time is given, it will lead to postponement of the implementions of recommention till next year 2009. Therefore all Divisional/ Branch Secretaries are requsted to orgonise issues the following telegrame/ Sovigram by the members of their division immediately to the follwing address.

COMPLETE THE VERIFICATION PROCESS
There was some confusion about date of submission of Declaration forms to DDOs. It is NOT postponed for GDS Union. The Department was clarified its vide ltter No 13/1/2008 dated 23rd June, 2008 that the time
schedule is not changed even number dated 26.3.2008 stand for EDA (RS) Rule 1995- Re-verification will be made according old time table only. Therefore the DDOs shale complete the work relating to GDS verification and its compilation by 10th July 2008 and report to the Heads of Circles with details of total number of persons belonging to each Union and also to display one copy on the notice bord on 10th July 2008. All Divisional/Branch Secretaryies shall check and send reports to Circle Union. The Heads of Circle will send the consolidated statement to Directorate by 25th July 2008 All Circle Secretaries are requested to check and collect figures from each Division and Branch and send to CHQ before 30th July, 2008 including other Unions. This may be given top priority and most urgent.

Respected Sir,
As you are aware GDS officials are the most exploited employees in postal net work. We are happy that of late this source of rural power is recognised and being harnessed to strengthen the department. Constitution of rural business division and rural technology is another step forward in this regard really deserve appreciation.
Success of any concern/department lies in combined effort of workers and the management, the authority knows better. Similarly it is very much important and very much essential you know to improve service conditions of the GDS employees to raise to the occasion. So, we request respected Madam to get the report of the GDS committee at the earliest for implementation. In fact implementation of pay committee report for GDS need to be expedited as this section deserve immediate financial support and improvement for better functioning.

Constitution of Rural Business Division

The Department of Posts has constituted a Rural Business Division in Postal Directorate under DDG [Rural Business] by redeploying the post of PMG [Foreign Mails], Mumbai. It is stated that the Rural Business Division in Postal Directorate would look after the various aspects of rural postal operations, development and expansion of rural postal network, technology induction, training of GDS Staff, new business initiatives, marketing of services and monitoring quality of services of rural network. This is clear indication that there is going to be a large-scale modernization of rural ED Branch Post offices with lot of new items of work added to BOs as well as technology training to the GDS Staff to handle the work. This decision is taken in the background of the assurance of Honourable Minister of Communications & IT in the Consultative Committee for providing setting up of a separate division in the Postal Directorate with the primary objective of strengthening the rural postal network and building capacity for extending IT enabled services in the rural areas.

Constitution of Technology Planning and Technology Operations divisions:

The Department of Posts has set up two more divisions in the Postal Directorate. One is Technology Planning Division and the other is Technology Operations Division. The Order of the Department says that in the background of a major technology initiative planned in the XI Five Year Plan, there is a need for formulation of technology vision and developing a strategy to keep abreast with the developments in technology and use the innovations for giving customers better services. The plan is to computerize all departmental post offices and half of the EDBOs in rural and it is also assessed that this will require business process reengineering, administrative and operational restructuring to provide enabling requirement for technology induction. There is mention that the Human Resource issues also need to be dealt with. In addition it is envisaged to create a Data Banck.

On this workers' Day, let us rededicate ourselves for the up lift of workers/weaker section in general and Grameen Dak Sevaks in particular. We shall continue to fight for the cause of GDS employees, at any cost!

6thCPC REPORT
6th CPC, headed by Justice Srikrishna, has submitted its report to the government. Among many retrograde recommendations, ABOLITION OF GROUP 'D' CADRE and OUT SOURCING OF THE WORK OF GROUP D WORK would virtually block, rather snatch the promotional avenues of our GDS employees.

MINIMUM WAGE EVALUATED BY 6th CPC –Rs.6660 (5740)
Again, this commission too has further widened the gap between the lowest and the highest paid officials. Now it is 1:16 in ratio. A grave partiality and injustice to the lowest paid who are the salt of this soil. It will certainly have repercussions upon the other postal employees including GDS .

SERVICE ORIENTED DEPARTMENTAL SHALL HAVE PERFORMANCE RELATED INCREASE!

2.5% increment rates, 3.5% to those on performance! Performance related incentive in place of Bonus etc., are to be opposed tooth and nail and action is on at all corners in the T.U.movement among C.G.employees.

COMRADES, BE CAUTIOUS ABOUT FURTHER DISCRIMINATION, DISCRIMINATION SHALL NOT CONTINUE………………..
The recommendations of the previous committee headed by Justice Charanjit Talwar were the result of extensive study of the system and dispassionate recommendations to improve the life and service conditions of Grameen Dak Sevaks/EDAs.

Most of the recommendations of the Justice Talwar Committee were NOT implemented without any reasonable/valid reasons. In order to continue the legacy of CHEAP LABOUR SYSTEM, the justified recommendations of the Justice have been diluted. A blatant injustice was done to GDS by dilution of most of the recommendations which were in fact the result of in depth study of the justice.

You are well aware, at every step, the GDS/ED employees are denied better service conditions and benefits and thus DISCRIMINATION HAS BEEN CONTINUED OVER YEARS AFTER YEARS. We are in the 61st year of INDIA 'S INDEPENDENCE and the policy of the British regime continues! Frustration and unrest among the employees are increasing which is not the sign of fair deal to the 'equals'. The policy or treatment to this section should be changed which is the immediate necessity. DISCRIMINATION shall NOT continue in FUTURE and let us be determined to fight all injustice, inequality and step-motherly treatment.

In the present circumstances, having seen the recommendations of the 6th CPC we are of the firm opinion that weaker section would become weaker and weaker if they do not resist the present move in the country. In order to draw the attention, with a view to demand justice, we shall not compromise on following minimum demands.

WE DEMAND
Pay Scales, Pension, Promotion, Medical Facilities, leave, Gratuity (as per Gratuity Act), GPF, HRA, CCA, Transport allowance, Trade Union facilities like special leave – departmental committee etc., assuring the status of Departmental staff since GDS are part and parcel of the Postal department.

Programme of Action/awareness:
Comrades, we have added responsibilities as the ONLY RECOGNISED union. We could achieve more all these years because of our collective effort and concentration to our sectional demands/ problems. Hundreds of orders and clarifications have been issued and series of agitational programmes have been organised independently and with the coordination of NFPE and other constituents. We salute all those who have been with us in our endeavour towards emancipation.

If any member filled two union's Declaration Form must cancel one form before 20th June 2008 otherwise he will not be eligible to become member of any union for five years.

Nataraja Murti on 4.4.2008 forenoon. The evidence took more than two hours and all the issues submitted in the GDS memorandum by the NFPE and the GDS Union were highlighted before the Committee.

The Departmentalisation of GDS; the method for Departmentalisation; Ensuring two career progression in GDS Service; protection of promotion to Group D on seniority basis even if the Group D posts are upgraded to Group C as per VI CPC recommendations; the issues of Social Security including Pension, Gratuity as per Gratuity Act 1972; enhancement of Group Insurance quantum to 1,50,000/-; Introduction of a system for Medical treatment; Changing the entire GDS Conduct and Recruitment Rules to end the discrimination in conduct and disciplinary matters between the GDS and the regular employees in line with the Supreme Court Judgment as well as making these rules statutory one; Facility for transfer to a vacant post; Free Insurance covering accident, natural calamity etc; Rationalization of leave with the facility to carry forward unutilized leave; Grant of 180 Days of Maternity leave for women GDS and special disability leave; Protection of wages by application of foot beat formula; Grant of Advances like Fan, Festival, Moped, HBA etc; Facilitating formation of cooperative societies for GDS; Full implementation of orders for conversion of GDS Mailmen in RMS larger platformed railway stations as Group D; Supply of uniforms to RMS GDS and outdoor GDS; Construction of work standards for GDS in RMS or straightaway departmentalizing RMS GDS as Group D since they work for 5 hours and more; Ending the discrimination between the RMS and Postal GDS to ensure RMS GDS also can become Mailguard through seniority basis in ½ vacancies like Postal GDS becoming Postman and various other issues were highlighted by the delegation.

The Chairman and the Member Secretary and other officials of GDS Committee had an interaction on many issues with us and even the Chairman Shri Nataraja Murti expressed that his endeavour would be to do as much good to GDS when we requested him to recommend a very positive report to the Government.

Sub: Payment of Dearness Allowance to Gramin Dak Sewaks (GDS) – at revised rates from 01-01-2008 – regarding.

Madam/Sir,

Consequent upon grant of another installment of Dearness Allowance to the Central Government employees with effect from 01-01-2008 vide Govt. of India, Ministry of Finance, Department of Expenditure, New Delhi O.M. No. 1 (1)/2008-E-II (B) dated 17-03-2008, the Gramin Dak Sewaks have also become entitled to the payment of Dearness Allowance at the revised rate w.e.f. 01-01-2008. It has, therefore, been decided that Dearness Allowance payable to the GDS shall be enhanced from the existing rate of 91% to 97% (Ninety Seven per cent) of Time Related Continuity Allowance with effect from 01-01-2008.

2. The additional installment of Dearness Allowance payable under this order shall be paid in cash to the Gramin Dak Sewaks.

3. The expenditure is debitable to the Head of Account 'Salaries' under the relevant Head and should be met from the sanctioned grant.

Membership Verification

Please refer our circular dt. 27.03.08 which was forwarded by the CHQ recently. Please note the important points and act swiftly.

1. The authorisation form bearing the signature of the Director (SR) should alone be used while obtaining declaration from the members
2. There is a separate form prescribed for GDS employees in which alone the declarations shall be obtained from GDS. The form used for departmental employees should not be used for GDS comrades.
3. The last date for submitting application is 10.06.08. Need not wait till last date. Enrol more membership as early as possible.
4. The membership list should be submitted in triplicate and in each page the Divisional/Branch secretary should sign.
5. If any official has signed more than one declaration form, he can not be allowed to become member of any association till another five years. Therefore, this should be explained to all members and ensure that they have not signed in more than one application to different unions.
6. If any fake or fabricated or in genuine authorisation is proved, the concerned divisional Secretary shall not continue as office bearer in the union for another five years.
7. The D.D.O should display the list from 11.06.08 to 20.06.08. Have a close watch and see our membership intact.
8. As per the revised practice, the Circle Unions can obtain a statement from the circle office on 25.7.08 on the verification process and it is more transparent. Percentage should be arrived based on the real working strength only.
9. One senor officer will be entrusted at Circle office for attending complaints and settlement of disputes in the verification process. This may also be properly utilised in case of any problems arisen at the time of obtaining declarations from members.
10. If any irregularity is noticed on part of DDOs, disciplinary action shall be taken against him.

The 5th All India Conference of this union was successfully held at Padmadhar Park, Rewa, M.P. Circle from 24th to 26th Feb, 2008 under the presidentship of Com. D. N. Giri, All India President of the union. The Conference had lively discussions on the subjects of importance that concern the GDS employees. More then 2000 Postal employees were participated. Suitable resolutions and decisions have been adopted by the Conference unanimously.
1. The sentiments of the members were conveyed during discussions in very clear and loud terms. The message should have been well received by the powers that be. The feelings of the general members will serve as our guide in shaping and formulating our course of action.
2. The Open Session was held on 24th Feb, 2008 with Com D. N. Giri in Chair. The Open Session was inaugurated by Com. G.L. Dhar, Secretary AITUC and was addressed by Sri, Sunder Lal Tiwari Ex., M.P. Rewa, Com. K. Raghavendran, Secretary General, NFPE, Com. K.V. Sridharan, General Secretary, P-III, Com,P. Suresh, General Secretary, R-IV, Com. B.G. Tamhankar, Ex. President, A.I.P.E.U. Group ‘C’, Union, Com. Yaswant Purohit Genral Secretary COC Madhya Pradesh, Com. S.K.Nema Working President P-III CHQ, Com. N. Balusubramanian, Ex. Circle Secretary P-III, Tamilnadu, D.P.Diwakar, Senior N.F.P.E leader, Com. Sethi, Senior N.F.P.E leader and Com. S.S. Mahadevaiah, General Secretary, A.I.P.E.D.E.U. A glaxy of leaders and high dignitaries graced the conference, who were the chief guests of the open session, expressed their sentiments in very clear terms recognizing the services of the GDS in maintaining and running the communication services to the over whelming majority of the people who live in the rural areas. They assured all help and cooperation in finding a solution to the problems of the ED employees. The Open Session was conducted by Com. G.S. Asiwal, General Secretary, Reception Committee& Ex Circle Secretary P-III M.P. Circle, Shri Samarth singh, Chairman, Reception Committee Dr. Mahender Singh Chouan, President, NTTI and R.P. Yadava, addressed the delegation session on 26th Feb, 2008.
3. Hindi (Poetry) Kavi Sammelana:-After the Open Session, 24th evening, Hindi Kavi Sammelana was organized by Reception committee famous Hindi literature and Hindi poets were participated viz., Dr. Seva Ram Tripathi, Shri Shiva Shankar Tripathi,"Shivala", Com. G.S. Asiwal, Shri Ram Naresh Tiwari "Nisthur", Smt. Indu Shivastava, Smt. Vimlesh Mishra, Shri Dr. Dinesh Kushwah, Shri Raam Swaroop Dwivedi " Shantidoot" and Shri Mohd. Rafique Riwani, the Programme was more than two hours all Delegates and Visitors well enjoyed the Kavi Sammelana.
4. Rewa is a small but historical place, situated in Vindya hilly region and is a place of pilgrimage. It was a calm city and the atmosphere was congenial for GDS employees to discuss their problems. The Reception Committee had made magnificent arrangements for smooth conduct of the functions. We extend our sincere thanks to the Reception Committee. Com. G.S. Asiwal Senior N.F.P.E leader, Com. Jain Circle Secretary P-III, Com. Mahendra Pratap Singh, Circle Secretary E.D. Union, Com. Purohit, Com. Devada, Com. R.P. Garg, Com. S.K. Tiwari, Com. K.R. Sharma, and their were force to reckon with. The contributions of Com. M.P. Singh and Com. jain, Reception Committee were of high value.
5. Comrades, the dangers lurking on the ED employees do not require to be elaborated. We are facing all sorts of onslaughts from all corners. At this juncture any activity that disrupts the unity and democratic institutions of the ED employees is only unfortunate and against the collective interests of the whole lot of the most neglected and exploited class of employees known as ED or Gramin Dak Sevaks. We hope that the members of this largest and mighty organisation will receive the message of complete unity in its correct spirit.

8. Policy and programme:-The 5th All India Conference decides to populise our basic demands through organization/ Mobilisation months April/May, 2008, July/Augsth,2008 March to Parliament and Indefinite strike in consultation with NFPE and other work force in the country.
On all issues concerning service conditions and benefits the GDS are facing discrimination, humiliation and injustice which is opposed, opposed and opposed all along.
The list of anti- GDS measures, problems etc, are appended to the resolution which is illustrative.Thus in order to end the ongoing illegality, attack on the GDS employees the following programme is proposed;-Massive campaign throughout the country urging immediate submission of interim report by the GDS Committee on
1. Extension of working hours - compensation to GDS working more than five hours:There is every scope to extend the working hours of GDS from 5 hours to 7.5 hours. RPLI, PLI and many new works such as RPLI, PLI, electricity bill, phone bills, electoral work, development of extensions in urban and metros etc., are forced on the GDS but without compensation. This aspect is to be viewed objectively for extension of working hours as compensation to the toiling GDS. This way all such posts be departmentalised.
2. INTERIM RELIEF: An Interim relief of Rs.1000/- may be granted to GDS taking all aspects into consideration, viz., workload, financial distress, service conditions etc.
3. GRATUITY: As per Gratuity Act, 1972, the supreme court in a recent judgment upheld the
verdict of Hon'ble High Courts of pubjab and Haryana. Now the model employer Department of post needs to extend it to other GDS employees thereby ending discrimination.
4. PENSION: The most justified demand of the staff side is Pension to this neglected section
of employees. Having served the department and the public upto the age of 65 years in sun and rain, every day GDS are retiring with frustration. On the other hand the Government is considering pension/social security to the unorganized section! It is high time that the demand of Pension may be recommended to GDS without further loss of time.
5. 50% Merger of DA with TRCA: The present raise of 5% in the basic TRCA is totally
irrational and since it will have adverse effect in the ensuing Pay Commission, the benefit of 50% merger with pay for all purposes may be recommended. Utter discrimination meted out this section is the cause of concern and agitation in the minds of GDS.
6. Stop reduction/recovery of TRCA: There are instructions to protect TRCA of GDS and not for reduction! The instructions of the directorate, including 11.10.2004, speak about protection of TRCA but to the dismay of the union the local level officers are indulging in reduction of TRCA against the guidelines and interest of hard working GDS. The very defect in the system of review and misinterpretation of instructions are the causes for the retrograde steps.
7. Full Trade Union facilities including affiliation with federation with federation, JCM:
This is much essential to at least one major recognised union.
ii. Savingram to GDS Committee urging Interim report forthwith.iii March to Parliament from all corners of the country representing GDS from each and
every Taluka(Tasil) places in August/during session of Parliament.
iv Indefinite strike in consultation with NFPE and other work force in the country - Date
will be announced later.
CHQ request all Divisional Circle Secretaries to finalize and successfully implement following programme in impressive manner.

9. VERIFICATION MEMBERSHIP:-The Govt. has issued order No. 13/01/2008-SR Dated 28th Feb, 2008 for re-verification of membership submit their application last date 25th March, 2008 for All India Unions. For re-verification of membership fixing last date for submissions of declaration by members through the Divisional Unions before 15-05-08. In this regard Govt. further Orders will issue before 30th March, 2008 for verification Programme. All Branch/Divisional secretaries are requested to conduct more meetings, Organisational meets at work spot, organise the comrades to our fold. You may meet each and every individual and take all out efforts to enroll all as our member in your divisions/Branches. All Circle Secretaries are requested to draw a tour programme of all Circle union office bearers to visit each and every Division Braches. We should take up the challenge to ensure cent per cent membership. (Declaration Proforma will come to know on 30-03-2008)
10 Amendments to the Constitution: A. The monthly subscription of members shall be as follows Rs. 10/- for all categories of Gramin Dak Sevaks.
Para 39(i) of the constitution may be read as under:

Subject: Review of conditions imposed on filling up of GDS posts.

Establishment Division and Planning Division of the Directorate had is issues some instructions in the years 2002/2003/2004 whereby certain conditions were imposed in making recruitment in the GDS Cadre. The references of these orders which are under review are as follows:-

(a) Letters No.40-35/Xth Plan-Planning dated 14.8.2003, 23.10.2003 and 17.2.2004.

(b) Letter No.25-3/2003-PE-I dated 1.4.2003

(c) Letter No.17-115/2001-GDS dated 21.10.2002

2. The orders issued form the Planning Division were mainly intended to identify surplus staff in the GDS cadre based on income/cost calculation and thereafter redeploy them while creating new Branch Offices. Orders issued from PE-I Section was with the intention of making a consolidated review of all Branch Offices whereby on work load calculation, manpower found surplus somewhere would be redeployed to Branch Offices where work load wise more staff was required.

3. A review of these orders has revealed that implementation of these orders has resulted in inordinate delay in filling up of vacant posts in GDS category even where they are genuinely required to be filled up. In fact, due to paucity of time, it has been impossible to simultaneously review all the BOs under a Sub-Office, because the only person to do the review is the Sub-Divisional Inspector, who has other urgent work relating to business development, investigation of fraud cases, etc. to attend to, which cannot of GDS posts which have remained unfilled as a result of these orders and it has been found that as on date around 22,212 posts are lying vacant on account of these orders. The resultant impact on services in rural areas has led to strong and repeated protests from the people's representatives etc.

4. It is, therefore, decided with the approval of the competent authority to rescind these orders issued from Planning Section and PE-I Section of the Directorate as referred to in(a) & (b) of the first para. However, the order issued vide No.17-115/2001-GDS dated 21.10.2002, which discourages engagement of substitutes for a long period and stipulates managing the work of GDS vacancies by combination of posts till such time GDS recruitment is finalized will continue to be in force, because these orders are basically intended to discourage the 9parctice of managing the posts with the help of substitutes/outsiders for a long time thereby giving them scope to the Courts for regularization.

Dear Comrades,

We are furnishing hereunder some recent developments concerning the postal employees in general and GDS employees in particular.
Gratuity Act apply to GDS
The Hon'ble Supreme Court of India upheld the Judgement of the Punjab and Haryana High Court that GDS employees are entitled to payment of Gratuity under payment of Gratuity (Central) Rules 1972. The Punjab and Haryana High Court had upheld that the payment of Gratuity(Central) Rules 1972 apply to the GDS employees as it is more beneficial than the rules for payment of gratuity to GDS employees. The judgement of the Supreme Court has come in Special Leave Appeal No. 21309/2006 dated 7.12.2007. Senior Superintendent of Post Offices Hoshiarpur Vrs Sham Dulari. As per the decision of the CWC we extended all support and cooperation in fighting the case.

We have demanded that orders be issued for implementation of the judgement in respect of G.D.S. employees across the board.

Observe impressive Dharna on 12th February 2008.

There are several issues which are not being resolved, viz orders for implementation of the Supreme Court orders in respect of payment of gratuity, unjustified and arbitrary RPLI targets, combination of duties arbitrarily without any remuneration and provision of necessary forms and stationeries, it has become necessary to wage a struggle. We, therefore, call upon all Branch/Divisional and circle leadership to organize impressive Daharna at this levels to press the demand.

The Department is taking up the verification of membership during the current year at any time in January or February -08. All Branch/Divisional secretaries are requested to conduct more meetings, Organisational meets at work spot, organise the comrades to our fold. You may meet each and every individual and take all out efforts to enrol all as our member in your divisions/Branches. All Circle Secretaries are requested to draw a tour programme of all Circle union office bearer to visit each and every Division Braches. We should take up the challenge to ensure cent per cent membership.

GDS Committee
The Memorandum was placed before the CWC in June 2007 and discussions were held over it and it was finalized too. We received some suggestions from A.P. Circle Union and other members after consultation with CWC Members and others, We Submitted 131page Memorandum to GDS Committee on 11.01.2008 and also by e-mail. We have to recall our Struggles. We made series protest for since nearly two years after our Pushkar AIC. CHQ conducted many Dharnas, rallies and Campaign Programmes, National Convention on 23.05.2006, Mach to Parliament on 22nd August, 2007, Two Indefinite strikes Notices from 01.03.2006 and 24.04.2007, and also two one day Strikes on 14th December, 2006 and 30th October, 2007 against the injustice and discrimination were served. But things have not changed. Some assurances are being offered by the Government. We are aware that we have much to do and achieve, and our march ahead is consistent. We learn from every mistake. We get stronger with every struggle. We are aware of the huge task ahead of us. We are aware of the mindframe of the powers-that-be that the employees-especially the E.D. employees are facing serious onslaughts. We are aware that some forces would not like our march ahead and our independent entity for certain reasons. We march more vigorously till we achieving desired results.
