The Postal Services have their own importance and the provision of Communication facilities to the Common man in the villages is still more important. The Communication facilities in the villages are maintained and provided by the Postal employees who are known as Gramin Dak Sevaks (GDS). While the Pay and allowances and other benefits of other Central Government employees have already been revised, upwards, the same in respect of the G.D.S. employees is still to be done and there is a more to reverse the benefits already available.

We as the humble servants of the common man in the village implore your effective intervention as this connection. We enclose herewith a brief memorandum on this object for your kind action to ensure justice to the lowest rank of the Postal employees.

MEMORANDUM ON PAY & ALLOWANCES OF GRAMIN DAK SEVAKS OF THE DEPARTMENT OF POSTS IN THE LIGHT OF RECOMMENDATIONS OF 6TH CENTRAL PAY COMMISSION

The Postal services are provided by two sets of employees: (1) In urban areas by the full time Departmental Employees and (2)in rural areas by employees known as GRAMIN DAK SEVAKS (G.D.S.) who are put on duty for shorter period. Presently the duties of these GDS employees are between three hours to five hours. These Gramin Dak Sevaks were earlier called Extra Departmental Agents (EDAs). They function according to the same rules as govern the working procedure of the departmental employees and almost similar conduct and disciplines rules are also applicable. Only service conditions are different viz no pension; no constitutional gratuity; no leave similar to departmental employees and no allowances except the dearness allowance.

2. These GDS employees, over the period, have undertaken several schemes of the government like payment of NREGS wages, payment of old age pension apart from other small savings schemes and value-added services. These employees serve the "Common Man" in the village and are the commonest of the common people. The Hon'ble Supreme Court has held the EDAs as holders of Civil Post i.e Civil Servants.

3. To give a brief back ground, it is worth mentioning that when the 5th Central Pay Commission was appointed, a pay Committee for EDAs under the Chairmanship of Justice Charanjit Talwar, a retired Judge of Delhi High Court was appointed. Justice Talwar Committee broadly recommended pay-scale for the EDAs proportionate to their duty hours with the pay-scales of the departmental employees. Justice Talwar Committee also recommended payment of all allowances like house rent allowances, Children education allowances etc. Justice Talwar Committee also recommended pension and gratuity for the EDAs. It recommended pay fixation in the new scale which totally matched the pay fixation of the Departmental employees. However, the Government gave effect to the recommendations on pay and allowances only.
4. When the 6th CPC was appointed, the employees persistently requested that the issues pertaining to the GDS employees be referred to the 6th CPC or a pay committee under a retired High Court Judge be appointed, However, the department of Posts appointed a one man committee under the Chairmanship of a retired bureaucrat of the Department of Posts. The said committee in a most arbitrary way has tried to override the benefits already available to the GDS employees and has tried to over do the decision of the Hon'ble Supreme Court of India by suggesting charge is the nomenclature of the Conduct Rules from "GDS Employees (Conduct & Appointment) Rules" to " GDS employees (Conduct & Engagement) Rules
5. In view of the policy already accepted by the Government the Pay scale or pay band (including Grade pay) of the GDS employees with relation to the 6the CPC recommendations of the corresponding category of the departmental employees have Justifiable to be as follows.
(i) Pay 3-4 hrs. 4-5 hrs.

(ii) Increment: 3% percent.

(iii) Allowances:

The allowances such as HRA, Bad Climate allowance, Transport allowance, Children Education allowance etc are totally justified to be granted on principles of equal justice.
(iv) Pension & Gratuity. At par with other Departmental employees.
(v) The Committee has recommended curtailment of Postal services in rural areas to below three hours. This requires to be rejected in interest of Postal services to the rural population.
(vi) Bonus: This Committee has also given a damaging and arbitrary recommendation regarding fixing lower maximum pay limit for calculating bonus to GDS which is at present Rs. 3500/-. This is totally unjust provocative and vindictive. This requires to be scrapped and states-quo maintained.
(vii) Trade Union facilities: Proper Trade union facilities to run the affairs of the union are justified.
(viii) Fixation in new pay band: at par with departmental employees.

Respected Sir,

The Gramin Dak Sevaks (GDS) of the Department of Posts who were earlier known as Extra Departmental Agents (EDAs) have been held by the Hon'ble Supreme Court of India as Civil Servants. Over the period these GDS employees have undertaken several schemes of the Government for implementation like NREGS payments and payment of old age pensions apart from several other schemes of small savings etc.

For the last 12 years, these GDS employees have been receiving pay and allowances proportionate to those of the departmental employees. The fitment in the new scales after the report of Justice Talwar Committee have been at the same scale or even better as that of the departmental employees on implementation of the 5th CPC recommendations.

Now, the 6th CPC recommendations have been implemented in respect of the Departmental employees. There is a genuine and judicious case that the Pay and allowances of the GDS employees are refixed on the principles of the 6th CPC. Somehow or other, there is an effort to reverse the accepted principle of pay and allowances similar to, though proportionate with, the departmental employees. This, you will kindly agree, Sir, is a case of calculated discrimination and reversal of the accepted Principles to the detriment of the staff.

With your good self taking over of the charge of this department, a new ray of hope has gone amongst the GDS employees that Justice will be done to these employees.

We, therefore, request your kind self to examine our case sympathetically and issue necessary orders for adoption of the same principle of pay and allowances as has been in vogue for the last 12 years along with fitment in the new pay bands on the same pattern as for departmental employees.

We shall be obliged if you kindly grant us as an interview to explain the case in person, at your earliest convenience.

recognition of Associations – procedure regarding.

Ref: Directorate letter No.13/01/2008-SR Dated, 17.04.2009

Madam,

It has been intimated and very authentically declared in several of the Directorate's letters ending with letter No.13/1/2008-SR dated 23.06.2008, that the instruction contained in letters dated 27.05.2009 and 19.06.2008 apply only to regular departmental employees Associations and donot have any bearing on the Associations representing the Gramin Dak Sevaks. Similar orders have been also issued vide dte. letter No. 13/01/2008-SR dated 9.9.2008. Now it is shocking and surprising that orders for reverifications of membership in respect of G.D.S. employees Associations have been issued. In respect of the G.D.S. Associations, membership verification was held in June,2008. And membership subscription on the basis of new verification in June,2008 is being recovered from Pay of members. As a matter of fact the required statement of membership in respect of individual unions has been submitted to the Directorate by most of the Circles. Now the reverification sets the things in the reverse gear and undoes the work and Labour already invested. Therefore, it is only Judicous and proper the G.D.S. Associations are exempted from the reverification process.

Besides the following points are very pertinent and deserve immediate consideration:

(i) The programme of reverification of membership clashes with the General Election to the Lok Sabha. This process is in contradiction with the horms of democracy.
(ii) In almost all states the public transport is being utilized by the Election authorities for transportation of election official and police personnel and it is very difficult to get transport to reach upto the members.
(iii) In almost all north India states marriage season is on and this is yet another hurdle to be crossed.
(iv) Last but not the least. Earlier a period of two months was being granted for obtaining and submitting declarations while this time less than one month's time has been given. This will very badly hamper the process because the G.D.S employees are spread in innermost parts of the Country. It will be difficult to reach them within the given time. The curtailment of the period so draslically is unexplained, unexpected and devastating.

We, therefore, request you kindly to consider the entire factors objectively and exempt the G.D.S Unions from re-verification as full circle of verification in respect of G.D.S unions was completed only less than a year ago.

Subject:- Reverification of membership for recognition under the EDA(RA) Rules, 1995.



Dear Comrades,



The Department of Posts vide its letter No.13/01/2008-SR dated 17.04.2009 has issued orders that reverification of membership will be done along with the reverification of membership of unions of the departmental employees. You may recall that the Hon'ble High Court of Madras had issue stay order in respect of unions covered under CCS(RSA) Rules,1993 i.e. unions of departmental employees. The Department had issued several letters stating that the process of verification of membership carried out in June,08 as per the instructions Contained D.G.(P) letter No. 13-4/2007-SR dated 26.03.2008 would hold good. Now that the Department should issue orders for reverification of membership in respect of GDS employees unions also is surprising and shocking. We do not know whether this is being done with a view to penalise us for our struggles to protect the interests of G.D.S employees or to help those who helped, the administration at the cost of the interests of the G.D.S. employees as a whole. But this is very shocking.



We are just pointing out the facts to the Department and taking all possible steps. But at the same time we shall give a befitting reply also by ensuring that all G.D.S employees give their declarations in our favour.



So Comrades, we must utilize all resources and all Divisional/Branch level office bearers and activists should be utilized to reach up to every members and obtain their declarations in our favour. We are enclosing a copy of the from of declaration on which the declaration should be obtained. The form has been signed by Director(SR) dated 17.04.2009. The declarations are to be given on this form only.



The detailed programme of the reverification process is as follows:




(I) The declaration forms duty signed by the authorized office bears will be submitted to the DDO i.e. the concerned Postmaster/HRO on or before 15.05.2009.


(II) A list of members who have given their declarations will be prepared in triplicate. The authorised office bearer will sign the three copies of the list on each page and submit to the Divisional Superintendent of the Concerned Division on or before 20.05.2009.


(III) The Divisional Superintendent will scrutinise the declarations in presence of the authorized office bearer of the union. After serutiry the Divisional Superintendent will transfer the declaration and list of members to the DDO on or before 25.05.2009.


(IV) The DDO will return one copy of the lost to the union duly receipted and display one copy the list on notice board between 27.05.2009 to 29.05.2009.


(V) If a declaration form in a member's name has been wrongly included in the list of other union, he should represent to the Divisional superintendent by 2.06.2009.



The list of members which has been displayed on notice board must be examined carefully to ensure that the name of our members has not been included is other union's list.



We can understand the problem. The General elections to the Lok Sabha are in progress. In some states marriages are solemnoized. But at the same time we must also discharge this duty also with all our might.

The undersigned is directed to refer to the above-cited subject and to say that vide this departments
O.M.No 2/8/2001-PIC dated 16th May 2001, the Scheme of Optimization of Direct Recruitment to Civilian Posts was introduced for five years with the objective of rationalization of the manpower in various Ministries / Departments of the Government of India. As per the Optimisation Scheme, all Ministries / Departments were mandated to prepare the Annual Direct Recruitment Plan for each year in order to prioritize the fresh intake of manpower. After the expiry of the initial five years period, the Optimisation Scheme was reviewed in the year 2006 in consultation with the Department of Expenditure, Ministry of Finance and it was decided to extend the scheme for a further period of three years i.e., up to 31st March 2009 subject to a review after the receipt of the recommendations of the Sixth Central Pay Commission.

2. In this regard, the Sixth Central Pay Commission has recommended, "multiskilling of the Government employees which would increase their operational efficiency while simultaneously optimizing the staff strength. It is however, noted that while rightsizing in Government is necessary given the changes in the work process due to technology and consequent reduction of layers, a blanket ban on filling up of vacant posts across the board can impact effective functioning. More flexibility is required in this policy for effective service delivery and care has to be taken that administrative delivery structures do not become hollow or thin in critical areas ". (Para 6.3.10)

3. Keeping in view the above recommendation of the Sixth Central Pay Commission, the optimisation policy has again been reviewed in consultation with the Department of Expenditure, Ministry of Finance and it has been decided not to extend the validity of the Optimization Scheme beyond 31.3.2009.

Respected Sri,

As per pronouncements of the Government the Aam Admi is getting the sharpest attention of the Government. The Gramin Dak Sevak employees of the Department of Posts, who service the Aam Admi in the villages are the most common person amouqs the Aam Admi and disserve your persona attention and protection of the Government. Some forces are bent upon taking the Gramin Dak Sevaks down wards by cutting/withdrawing the berifts/facilities and giving the Pay and allowances a downward turn. The following basic points and principles deserve your personal attention:

1. Consequent on appointment of the 5th Central Pay commission, the Government appointed a Pay-Committee known as Justice Talwar Committee under the Chairmanship of Justice Charanjit Talwar, a retired Judge of the Delhi High Court. This committee submitted well recsoned recommendations on pay and allowances and relating the pay and allowances of the Extra Departmental employees (as the Gramin Dak Sevaks were then called) to the Pay of the corresponding category of the socalled departmental employees as then recommended by the 5th CPC i.e E.D. SPM/ED with Mail/overseer, EDDA/ED Stamp Vendor with Postmen and other ED employees with Group 'D'. The Pay scale of the Extra Departmental Agents (TRCA as it is called) so based and proportionate with corresponding categories was studied and principle confirmed by a Group of ministers. The issue was discussed several times in both houses of Parliament ending with discussions on 17-18/12/98.

2. Now attempts are afoot to reverse the Principle so adopted to fix the pay-scales (TRCA) of the Gramin Dak Sevaks with current pay bands (Pay Scale) of the corresponding category of the Departmental employees by adopting a separate and unprincipled basis. This has not gone well with the G.D.S employees.

3. Attempts are also on to degrade the other benefits like bonus etc by reversing the so-long prevailent principles which is a naked injustice.

4. As a victimization for demanding Justice for this neglected class of employees, the Department of Posts has stalled the whole functioning of the union. Since the G.D.S employees are not granted foreign service, therefore, an arrangement was made that the Chief executive and one other functionary of the Central Union woald be granted leave without pay by relaxing the ceiling on the total duration of leave. The Department of Posts has rejected further leave of Sri S.S. Mahadevaiah, General Secretary of the union who is the Chief Executive and ordered him to join his duties at Bangalore . This has stalled the entire functioning of the union.

We, therefore, request you most respectfully. Sir, to personally intervene for Justice to this category of aam servants of the aam admi by:

(i) Grant of pro-rata pay band and grade pay to the pay-band and grade pay presently granted to the corresponding category of Departmental employees;

(ii) Retaining the amount of equal ceiling on bonus as has so long been prevailing; and

(iii) Continuance of the facility to the General Secretary of the union to properly run the union affairs by grant of leave in lieu of foregn service.

The following improvements are required to be made in the above letter so that the G.D.S employees employed against short term vacancies of Postmen/Mail Guards and Group 'D' are fully compensated for the responsibilities they bear and extra expenditure they are required to incur:



i) The minimum of the pay scale of Postmen/Mail Guards as per the conversion table devised by the Department of Expenditure, Ministry of finance is Rs.6060+Rs.2000 (Grade) pay i.e Rs.8060. therefore, the remuneration of G.D.S employees employed as substitutes against short-term of vacancies of Postmen/mail Guards should be based on Rs.8060 plus other usual allowances like D.A etc.


ii) Substitutes will have to reside at the place of this duties for timely attendance and proper discharge of their duties, and will have to hire an accommodation to live, it will be only in fitness of Justice that they are paid house rent allowances and conveyance allowance as Justified on the basies of their remuneration.



More over the Hon'ble High Court of Madras while disposing of several writ petitions filed by the department has held that the HRA/CCA cannot be withheld or denied in case of G.D.S employees employed as substitutes A Copy of the said judgement is enclosed for ready reference. Taking undertaking from the substitutes will not over-rule the judgement of the Hon'ble High Court.


We, therefore, request you kindly to consider the issue in hight of the principles and circumstance compelling the G.D.S employees employed as substitutes against departmental Posts to incur extra expenditure in respect of house rent and conveyance and improve the letter under reference as submitted above. This will be in accordance with the Judgement of the Hon'ble Madras High Court.

Sir/Madam,



Consequent upon grant of another installment of dearness allowance w.e.f. 01-01-2009 to Central Government Employees, continuing to draw their pay in their pre-revised scales or to those whose pay and allowances have not been revised vide Government of India, Ministry of Finance, Department of Expenditure New Delhi O.M. No. 1(3)/2008-E.1I (B) dt. 19-03-2009, the Gramin Dak Sevaks whose TRCA has not been revised have also become entitled to the payment of Dearness allowance at the revised rate with effect from 01-01-2009. It has therefore been decided that, the dearness allowance payable to the Gramin Dak Sevaks shall be enhanced from the existing rate of 104 % to 114% ( One Hundred and fourteen percent) on Time related Continuity allowance with effect from 01-01-2009.



2. The Additional installment of dearness allowance payable under this order shall be paid in cash to all Gramin Dak Sevaks. The payment of arrears of dearness allowance for the months of January and February, 2009 shall not be made before the date of disbursement of TRCA of March 2009.



3. The expenditure is debatable to the Head of account" salaries" under the relevant head and should ,be met from the sanctioned grant.



4. This issues with the concurrence of Integrated Finance wing vide theirDiary no. 52/FA/09 /03 dt. 27.3.2009.

Subject: Remuneration to be paid to the Gramin Dak Sevaks engaged as substitutes inshort-term vacancies of Postmen/Mail Guards and Group 'D'



Consequent upon the implementation of the Sixth Central Pay Commission's recommendations, the matter regarding the rates of remuneration payable to Gramin Oak Sevaks engaged as substitutes in short term departmental vacancies of Postmen, Mail Guards & Group 'D' (Future Multi Skilled Employee) has been reviewed.



2. It has now been decided that the remuneration of the Gramin Oak Sevaks engaged as substitutes in short term departmental vacancies of Postmen, Mail Guards & Group 'D' (Future Multi Skilled Employee) may be calculated on the basis of the minimum of the pay in the respective revised pay band of the post plus grade pay concerned i.e. Postmen, Mail Guards RS.5200 + RS.2000 and Group 'D' RS.5200 + RS.1800 as the case may be as defined in the CCS (Revised Pay) Rules, 2008 plus admissible Dearness Allowance thereon only excluding House Rent Allowance and Transport Allowance with effect from 1-1-2006.



3. In future, GDS who are willing to work as substitutes with the minimum pay of the revised pay band of the respective post plus admissible DA excluding House Rent Allowance and Transport Allowance, should be engaged as substitutes only after obtaining an undertaking in this regard.



4. The issue relating to grant of revised wages to casual labourers of Full time/part-time contingent workers is under examination and orders will be issued separately.


5. This issues with the concurrence of Ministry of Finance, Department of Expenditure,I.C. vide their U.O. NO.7.6/7/2009-IC dated 12-3-2009.

Conciliation proceedings with Chief Labour Commissioner (Central) – Ad hoc payment to G.D.S employees.

Subject: -    Conciliation proceedings with Chief   Labour Commissioner (Central) – Ad hoc payment to G.D.S employees.

 

Sir,

 

 A kind reference is invited to the minutes of the Conciliation proceedings dated 17.03.2009. The CLC(C) has suggested an ad-hoc payment to the G.D.S employees. The basic issues of pay-bands and pay-fixation are subjects to have detailed examination and consultation with several institutions including this union. But the suggestion or advice of the CLC(C) for ad-hoc payment is to be considered seriously and an adhoc payment to G.D.S employees, adjustiable against the amount of arrears finally calculated may be keenly considered. We on our part suggest an ad-hoc payment of Rs.20,000/- to each G.D.S employee adjustiable as mentioned above.

 

You are, therefore, requested kindly to take necessary action is this matters for early payment of the adhoc amount.

To day consolation meeting was held with CLC(C) New Delhi. The said meeting minutes below as produced. In this CLC(C) meeting, General Secretary, Com. S.S. Mahadevaiah, along with Com. Datta Ram, Circle Secretary, H.P., & AGS CHQ, Com. R.P. Diwaker, Treasurer CHQ, Com. R.S. Maheswari, Circle Secretary, Rajasthan, Com. Lakhwinder Pal Singh, Circle Secretary, Punjab Circle have attended. From Deptt. was represented by Shri A.K. Sharma, DDG(Estt.) and Shri Subhash Chandra, Director(SR&Legal).

Minutes of the conciliation proceedings in the dispute between the All India Postal Extra Departmental Employees Union and management of Postal Department on 17-03-2009 before the Chief Labour Commissioner (Central)



Parties are present as per the attached attendance sheet.



The representatives of All India Postal Extra Departmental Employees Union. Shri S.S. Mahadevaiah, General Secretary, has informed that they had discussed the demands with Member (Personnel)/Postal Services Board on 27-02-2009 but they did not get any assurance form the management on their demands. When asked he demanded that pending finalization of the demands of the trade union some ad hoc payments within this financial year be made to the workmen to mitigate their hardship. On the other hand the representatives of the management have informed that management has taken up the matter with the Government and it is likely to be finalized shortly. However, as advised by CLC[C] Department may examine the feasibility of making ad hoc payment to the workmen as early as possible in consultation with the nodal Ministry and the Election commission. The Union has agreed not to go on strike. Management has also agreed to consider the demands of the Union sympathetically. Accordingly no further action is necessary for the present.

Subject: Modifications sought for pay and allowances

and service conditions to the G.D.S employees.


Madam,


Further to our letter of even no. dated 27.02.2009 on the above subject we are to submit that the principle of relating the pay and allowances of G.D.S employees including the rate of annual increment with the existing pay and allowance of corresponding category of departmental employees was adopted and put into action by a group of Ministers of the union Government after the submission of Justice Talwar Committee. It will only be in interest of administrative propriety that the policy and principle accepted by the Government and on the recommendations of the Group of Ministers are continued and no otherwise twist to the principles are given. Based on that principle, the wage-structure suggested by us is our letter of even no dated 27.02.2009 are accepted and orders issued accordingly.


We, therefore, request you kindly to accept the principle and accordingly the pay structure suggested by us is interest of Justice to 2.80 lac G.D.S employees.
