SUB:  RESOLUTION ON GDS PROBLEMS—REG.

Respected Madam,                                  

          A resolution adopted at the All India Convention of the AIPEDEU held on 24^th August, 2012 at Aggrawal Dharmasala, Model Town Delhi resolved unanimously the following Resolutions. On the above subject is submitted herewith for consideration and necessary action.

Resolutions:

The Central working commttee and National Convention of AIPEDEU held at Agrawal Dharmsala on 23rd and 24th August, 2012 unanimously resolved the following resolutions.

 

1)  The Gramin Dak Sevaks whose strength is formidable around 2 lakhs 50 thousand employees in the department of Posts are the worst sufferers by erosion of their wages since they are at the lowest rung of pay structure. They are most anxiously looking forward to the setting up of 7^th pay commission. This All India Convention of All India Postal Extra Departmental Employees union most vehemently urges upon the Government to include the postal Gramin Dak Sevak employees in the purview of the coming 7^th pay commission.

2)    Grant Status/Regularisation as government servant to GDS employees as recommended by Justic Talwar Committee. The Hon’ble Supreme Court of India in its land mark judgement date 22-04-1977 held that the Extra Departmental agents (now Gramin Dak Sevaks) are holders of civil posts.

3)    Grant Bonus ceiling of Rs. 3500/- at par with Departmental staff. It is grass injustice and discrimination has been to Gramin Dak Sevaks by denying Bonus ceiling of Rs. 3500/-.

4)    Implement Government officers committee recommendations regarding cash handling points to BMPs, cash conveyance, Pay protection etc.

5)    Implement immediately Restriya Swasthya Bhima Yojana (RSBY). The scheme has already been approved by the cabinet.

6)    Grant compassionate appointments to all by removing conditions and norms prescribed recently.

          7)    Grant ACP promotion or Financial upgradation to GDS.

8)    Stop abolition of GDS posts and filling up of all vacant posts in all cadres of GDS in postal and RMS offices.

9)    Scrap new recruitment rules of Postman/Mailguard and MTS. Restore the previous recruitment rules.

10) Restore Dearness allowance to casual labour, contingent,  part time and MMC workers which has been stopped for four years.

11) Implement VI pay committee recommendations and grant revised scales to casual labour, cntingent, part time and MMC workers.

Dear Comrades,

An Historical and colourful convention of AIPEDEU in Delhi

All India Convention of AIPEDEU was successful held on 24^th August, 2012 at Agrawal Dharmasala, Model Town-II in Delhi. No doubt it remained ever least an historical and colourful convection in the history of Postal Trade Union movement as adopted for most important resolutions and decided the serious Agitational programme for the settlement of GDS problems which has been long pending.

The convention commenced at 10:00 hours starting with flag hosting. Our All India president Com. D.N. Giri and our General Secretary Com. S.S. Mahadevaiah hoisting the National and AIPEDEU flags followed by thunderous slogans raised by more than 1800 delegated from 21 Circle to the convention.

After the flag hoisting all the C.W.C. members, Circle Secretaries and veteran leaders of the postal trade union movement were honored with garlands and mementos.

Com. Gurudas Das Gupta, M.P.  Loksabha and General Secretary AITUC inaugurated the convention and extend all his support on behalf of AITUC to the struggles of AIPEDEU. He assured us the long pending problems such as Regularisation, Bonus Ceiling of Rs. 3500/-, Pay protection etc. would be raised in the parliament to put pressure on the Government. He suggested us that there is no way expect struggles to achieve our justified demands. Com. G.L. Dhar, Secretary, AITUC, Com. P. Suresh, General Secretary, R-IV, Com. K.K. Sharma, Vice President, NFPE, Com. B.G. Thamankar, Ex-President, NFPE, Com. S.R. Shukla, Ex- All India President, R-III, Com. H.S. Guleria, Circle Secretary, P-III, H.P. Circle, Com. G.S. Asiwal, Ex-AGS and Ex-Circle Secretary, P-III, Com. Niranjan Rawat, Ex. Circle Secretary, P-III, Odiss, Com. D.P. Diwaker, Ex-Circle President, P-IV, Com. Bhim Singh, Ex-Circle Secretary, P-IV, Com. Gulab Singh, NFPE leader Punjab Circle, Com. Ajay Singh, P-III, UP, Com. R.K. Soni, P-III, M.P. and other P-III, P-IV leaders greeted and addressed the Convention and extended their full support to AIPEDEU.

General Secretary Com. S.S. Mahadevaiah discussed elaborately the most-pressing problems of GDS employees and the attitude of the Dept. of posts and the Govt. of India towards its settlement. He appealed to all comrades to strengthen our union and put all efforts to build unity among the GDS. Com. B.V. Rao, Assistant General Secretary, Placed the declaration in the house for adoption and it was seconded by Com. Mahendra Pratap Singh, Vice President CHQ the declaration was unanimously adopted by the house without any alterations and modifications.

The first Central Working committee after 7^th AIC was successfully conducted on 23^rd August  2012 at Agrawal Dharamasala, Delhi. Out off 22 Circles 21 Circles attended the meeting and discussed at length on pressing problems of GDS. Out of 15 office bearers 14 office bearers attend.Com. B.G. Thamankar, Ex-President, NFPE , was inaugurated  the CWC.

Later Com. B.V. Rao, Asst. General Secretary proposed following resolutions for the acceptance of house. After explanation the resolution by Com. S.S. Mahadevaiah, General Secretary, all the resolutions have been unanimously accepted.

6)    Grant ACP promotion and financial up gradation to GDS.

7)    Stop abolition of GDS posts and filling up all vacant posts in cadres of GDS in postal and RMS wings.

8)    Scrap the new recruitment rules for appointment of postmen/MTS. Restore the old rules. Provide 25% promotion as postmen to senior GDS officials. Stop 25% recruitment from open market.

9)    Grant Dearness allowance to casual labour, contingent part time and MMC workers which has been stoped without any reason for four years.

10) Grant revised wages to casual labour, contingent part time and MMC workers on the basis of committee recommendations.

The CHQ sought the opinions of Divisional Secretaries for the future course of agitation. All the Divisional Secretaries attended the convention suggested and demanded in one voice to go uncompromised indefinite strike to achieve our justified demands. All the C.W.C members and Circle Secretaries supported it keeping the vies and opinions of the Divisional, Circle Secretaries and C.W.C members CHQ issued the following programme of action.

1)    Conduct hunger fast on 1-10-2012 at public place all over India. 

2)    Sent memorandum to the finance minister, Communication minister and Secretary Posts by Fare on 5-10-2012. The memorandum copies are sending along with this circular.

3)    Conduct rally at Divisional Head Quarters on 9-10-2012.

4)    Dates of Agitation will be announced later in consultation with our well wishers, other unions and Federations.

Dear Comrades, you are all aware that we were sent out from JCA unilaterally by NFPE after April, 2012. We wish to form another JCA with other unions and Federations to fight against the retrograde recommendations of Nataraja Murthy Committee.

ALEART ALL CIRCLE/ DIVISIONAL SECRETARIES

It is informed by the dept. of posts that only 175,129 applications have been received regarding service Discharge Benefit Scheme (SDBS). Most of the applications submitted to the Divisional heads by the GDS have been retained by themselves. Kindly approach the Divisional Heads and pursue to speed up the process to avoid delay for implementation of this scheme. Ask the GDS who have not joined the scheme to join and get benefit.

REMITTANCE OF QUOTA & DUES TO CHQ:-

Comrades, May we remind you once again that the Quota and Dues will add to our strength in fighting out our demands. The receipt of Quota is not satisfactory. May I hope that you will pay serious attention to this matter?

Formation of “AllIndia Postal ,RMS casual labour, contingent part time and MMS workers Union” at circle and divisional levels as Associate member of AIPEDEU.

 The central working committee and National convention  of AIPEDEU HELD ON 23-08-2012 at agrarwal dharmashala model town Delhi unanimously resolved to form “All India Postal ,RMS casual labour, contingent part time and MMS workers Union” at circle and divisional levels as Associate member of AIPEDEU. All our circle /division/Branch secretaries are requested to intimate the task immediately our comrades have already formed the union at circle and divisional level in Andhra Pradesh.

Women convention in Gujarat circle

All India women convention of AIPEDEU will be held in themonth of December 2012 at Jamnagar , Gujarat CHQ vice-president and circle secretary Gujarat circle com. Asha ben Joshi is started to make all efforts to success the convention all our circle /divisional /branch secretaries are requested to circulate about the all India convention among our women comrade sand make them to attend the convention in good manner.

National Workers Convention of Central TU was held at Talkatora Stadium, New Delhi on 4^th September, 2012 delegaton under the Leadership of Com. SS Mahadevaiah, GS AIPEDEU, Com. Vijay Sharma CS Haryana; Com. Rambier Singh CS Delhi Circle; Com. Baljit Singh, Circle President , and others participated in the said convention on behalf of AIPEDEU.

The meeting of the representatives of the eleven Central Trade Unions held at the BMS Head Quarters on 11^thJuly, 2012 adopted a resolution to call upon the Indian Working Class to intensify the united battle to higher form to force the Government to change its economic policies, which had been the prime cause for the higher level of inflation in the economy and pauperisation of workers. The Central Trade Unions which sent in their representatives to participate in the July meeting were the CITU, AITUC, INTUC, BMS, HMS, AIUTUC, TUCC, ATCCTU, UTUC, LPF and SEWA.

In order to decide upon a massive Trade Union action, the meeting has decided to convene a National Workers Convention at Talkatora Stadium, New Delhi on 4^th September, 2012.   AIPEDEU has been asked to deploy delegates to participate in the said convention.

PROVIDING SOCIAL SECURITY TO CONTRACTUAL LABOUR

Comrade,

 The  Honorable Union Labour & Employment Minister Shri Mallikarjun Kharge gave this information in a written reply  in  Rajya Sabha.

In cases where  the contract worker perform  the same or similar kind of work as the workmen directly employed  by the principal employer of the establishment, the wage rates, holidays , hours of work and other conditions of service  shall be the same as applicable to the workmen directly employed by the principal employer doing the same or similar kind of work.    The liability to ensure payment of wages and other benefits is primarily that of the contractor and, in case of default, that of the principal employer. 

In that case the contract labour working in the Central Government offices who are actually performing the duties that of the regular workers/ employees example such as MTS, Driving a vehicle, peon jobs, safiwala. Postal jobs by GDS workers should be provided with the wage rates, holidays , hours of work and other conditions of service  shall be the same as applicable to the workmen directly employed by the principal employer (Central Government ) doing the same or similar kind of work.      

PROVIDING SOCIAL SECURITY TO CONTRACTUAL LABOUR

                 The Contract Labour are engaged in the industrial sector  by the Government and Private establishments  as per their terms of contract and requirement and   no centralized data is maintained. However, the estimated number of contract labour  engaged by licensed contractors  in central sphere including the industrial sector in  the last three years is as under:

                Engagement of  contract labourers is regulated under   the Contract  Labour (Regulation & Abolition) Act,  As far as the security  in term of  wages and other service conditions is concerned,  as per the  Contract Labour (Regulation & Abolition) Central Rules, 1971 , the wages of the contract labour shall not be less than the rates prescribed under  Minimum Wages Act, 1948 and in cases where  the contract worker perform  the same or similar kind of work as the workmen directly employed  by the principal employer of the establishment, the wage rates, holidays , hours of work and other conditions of service  shall be the same as applicable to the workmen directly employed by the principal employer doing the same or similar kind of work.    The liability to ensure payment of wages and other benefits is primarily that of the contractor and, in case of default, that of the principal employer. 

                 In the central sphere, the Complaints are received in the field offices of Chief Labour Commissioner(Central) Organization under the Contract Labour (Regulation & Abolition) Act, 1970, Minimum Wages Act, 1948 and by   other laws applicable on contract labour which are investigated and action is taken. Social security aspects of contract workers under Employees Provident Fund and Miscellaneous Provision Act, 1952 and Employees State Insurance Act 1948 are enforced by the Employees Provident Fund organization and Employees State Insurance Corporation respectively provided the establishments in which outsourced workers are working are covered under the said Acts.  Central Government hasalso prohibited employment of contract labour in various establishments in central sphere through 84 Notifications issued from time to time under the Contract Labour (Regulation & Abolition) Act, 1970. To safeguard the interests of the contract labour further in term of wages and social security, a proposal to amend the Contract Labour (Regulation & Abolition) Act, 1970 is under consideration of the Government.

                The Union Labour & Employment Minister Shri Mallikarjun Kharge gave this information in a written reply  in  Rajya Sabha today.

DECLARATION

 

Dear President and Comrades,

We have discussed elaborately and deeply the most pressing problems of Gramin Dak Sevaks and made resolutions unanimously in the 7^th All India Conference held at Mozri from 6^th April, 2012 to 8^th April, 2012. We have also discussed the situation arising after implementation of Natarajamurthy Committee recommendations from 9.10.2009. A four phased programmee was given in the 7^th AIC to settle the burning problems of Gramin Dak Sevaks. The three phased programmes were successfully conducted at Division/Regional/Circle levels. Congratulations to all the leaders and members of our union of successful implementation of CHQ programmes. Our General Secretary submitted all the resolutions resolved unanimously in 7^th AIC to the Secretary posts. There is no action from the Department.

 

Our General Secretary met Shri Sachin Pilot. At his residence along with other leaders and explained the problems facing by Gramin Dak Sevaks after implementation of Nataraja Murthy committee reconsideration half an hour time.

The minister paid very much patience to listen the General Secretary AIPEDEU and assured the General Secretary to settle the problems brought to his notice.

Unfortunately, the assurances of the minister was not been put into practice. Again a delegation consisting of Com. S.S. Mahadevaiah, General Secretary, Com. B.V. Rao, Asst. General Secretary and Com. Rajendra Diwaker, Treasurer met Sri Sachin Pilot and requested his intervention to take necessary action to settle the problems which have been already brought to the notice of the minister. Here assured us to take necessary action.

Later the General Secretary and Asst. General Secretary approached the concerned officers in the Directorate and discussed about the regularization of GDS Grant of Bonus ceiling of Rs. 3500/-, pay protection to GDS, remove Rs. 20000/- per one point, implementation of Medical Scheme, Grant of Compassionate appointments for all, Grant of three promotion to GDS, Stop abolition of GDS posts and grant all other benefits and facilities par with departmental employees.

We suggest the department of posts to modify the new recruitment rules of Postman/MTS. Previously 25% posts are to be filled up by senior GDS officials. Per the new recruitment rules the provision has been removed. We demand that 25% postman posts have to be filled up by senior GDS officials and Stop unfiled vacancies has to be filled from open Market.

In the previous recruitment rules 75% MTS/Gr-D posts have been allotted to GDS. But in the new recruitment rules 25% has been curtailed. WE demand that the previous position may be restored.

The Secretary Department of Posts agreed in principal to settle the above mentioned problems as early as possible. But no action has been taken to settle the single problem.

In this back ground we are compelled to go for serious trade union action. To discuss and decide the trade union action to settle the most pressing problems of GDS, this All India convention is being conducted in Delhi. You are all aware that we were sent out from JCA unilaterally by NFPE after April, 2012. We wish to from another JCA with other unions/federations to fight against the retrograde recommendations of Natarajamurthy committee. We wish to take up the serious trade union action as there is no alteration to settle our justified demands under the banner of proposed JCA. The programme of action will be decided soon after with the consultation of the above mentioned federations and our well wishers.

We are also seeking your advices in this regard. We do believe that there is no way except struggle to settle our justified demands.

                An historical and colourful convention of AIPEDEU with 1800 delegates from 21 circles was held at Aggarwal Dharamshala Delhi on 24^th August 2012. Com. Gurudas Das Gupta, M.P. Lokshaba and General Secretary  AITUC inaugurated the convention among the thundering slogans on GDS fraternity Com. S.S. Mahadevaiah, General Secretary, AIPEDEU elaborately discussed the problems of GDS of all cadres and sought the advice of the comrades for future agitation to achieve the justified demands. All the delegates suggested indefinite strike with one voice.

                Declaration of Convention was unanimously adopted all the resolutions proposed by Com. B.V. Rao, AGS and seconded by Com. Mahendra Pratap Singh  were also unanimously adopted.
