Com. Umraomal Purrohit a legendry leader of trade union movement , Secretary Staff Side JCM National Council and the President of All India Railwaymen’s Federation expired at Mumbai in hospital at 4.15 AM on 27th February, 2014 . He was a great statesman and visionary leader of working class.Veteran leader and AIRF President . Late Umraomal Purohit has done yeomen service not only to the Railway Trade Union movement but also to the Central Government employees during the last six decades The Federations on common issues. Being senior leader, late Umraomal Purohit has all along been the source of inspiration for the overall good of not only Railways but also nation as well as working people' As HMS General Secretary late Umraomal Purohit has played very vital role in the national trade union movement. Relations between AITUC , CITU, INTUC & Federatons of Central Government Employees and HMS have always been cordial due to the initiatives of late Umraomal Purohit. In his death the trade union movement as well as working class suffered an irreparable loss.
AIGDSU condole the death and pay our condolences to the bereaved family members and also to the comrades of HMS & Railways.

UPA. Govt. on pre-poll announcements
UPA govt. working ‘feverishly’ on pre-poll announcements
With the schedule for the Lok Sabha election likely to be announced on Saturday, the UPA government is working “feverishly” on a record number of announcements, appointments and initiatives before the model code of conduct kicks in.
The Cabinet meeting on Friday is expected to be a “marathon” session as it will be the last opportunity for the government to take policy decisions as well as announce ‘populist’ sops, top Finance Ministry sources told The Hindu .
The proposals lined up for Friday’s Cabinet meeting include 54 new Kendriya Vidyalayas, space programme GSLV-Mark III, a six-lane bypass for Delhi, and terms of reference for the Seventh Pay Commission, which was set up by the government recently.
It is expected to consider Rs. 3,500 crore budget for new broadcasting infrastructure for All India Radio and Doordarshan, 10 per cent dearness allowance for government employees and 600 MW hydro-power projects in Bhutan.
The dearness allowance hike to 100 per cent from the existing 90 per cent is expected to benefit 50 lakh employees and 30 lakh pensioners.
New schemes have been put up for approval by the Ministries for health, tourism, water resources, human resource development and agriculture. These include expansion of government-funded Ph.D seats for electronic systems design and manufacturing of hardware, a new investment scheme for urea, two new highways and a health research scheme from the Human Resource Development Ministry. Some shipping and steel projects will also come up for approvals.
Officials believe some more items could be put on the block-buster agenda. A Cabinet Minister told The Hindu that the government expects the Election Commission to announce the election schedule on Saturday or latest by Monday.

MEMORANDUM
Most
respectfully, on behalf of 2.7 Lakhs of Gramin Dak Sevaks in the Department of
Posts, We submit the memorandum on the pressing problems of Gramin Dak Sevaks
for your kind perusal and favourable action.
I) Inclusion
of GDS wage structure & service conditions in the purview of 7th
Central Pay Commission.
Except Justice Talwar Committee, all the Committees appointed
by the Government for revision of the wage structure and other service
conditions of Gramin Dak Sevaks made so many retrograde recommendations done
injustice to the low paid employees. Though the GDS system is unique to the
Department of posts, it is not falling under any of the classified group, EDAs
were included within the purview of First Central Pay Commission for revision
of the wage structure and other service conditions. The GDS system will really
be an invaluable asset to the department of posts, if the department utilizes
properly.
2) The 4th Central Pay Commission have
categorically observed and held in Para 1.18 of their report thus:
The matter is however beyond controversy after the
decision of the supreme court in Gokalnanda’s case where it has been declared
that the extra departmental agent is not a causal worker but holds a post under
the administrative control of the State” and that there is no doubt that it is
a post under the “State”. In view of this pronouncement we are unable to accept
the contention that the extra departmental employees were outside the purview
of the terms of our commission.
Thus
the 4th Central Pay Commission were not inclined to exclude the ED
agents from the terms of their purview and have termed the ED Agents as Central
government employees.
3) The Central
Administrative Tribunal Ernakulam Bench has rejected the arguement that by the
Judgement dated 22.4.1977 of the Supreme Court ED agents have been declared
holders of Civil Post only for the purpose of protection and safeguards in
article 311(2). The Bench in O.A No. 584/95 decided on 23.1.1996 observed:
We find no warrant for reading the restriction into
the declaration of law in the Rajamma’s case and limiting it to article 311 the
declaration is that extra departmental agents are holders of Civil Post.
Justice
Talwar Committee has entirely agreed with this observation.
4) The sum
total is that by the observation and declaration of experts and Judiciary, the
Gramin Dak Sevaks fulfill the requirement of being included in the purview and
terms of the Central Pay Commission.
Hence you are requested
to consider this demand positively.
II.) Civil
Servant status to Gramin Dak Sevaks
It is not irrelevant to mention
EDA(Conduct & Service) Rules, 1964: Supreme Court ruling that EDA are
holders of Civil Posts.
“The question whether Extra Departmental agents are holders
of Civil Posts under the Government of India has been the subject matter of
contention for a long time. The Department has always held the view that EDAs
are part time employees, who are expected to have independent source of income
Generally school teachers, small shop keepers, farmers, village headman,
employees of local Government’s etc. Work as EDAs. The EDAs are not work for
full time and as such are not eligible for concessions and privileges
admissible to regular Government servants. This view of the Department and as
such entitled to protection under article 311(2) of the constitution. Not
satisfied with the judgement of the learned High Court, the department went in
appeal against their judgement to the Supreme Court. The Supreme Court in their
judgement delivered of civil posts under the Government and protection available
to regular Government servants under provisional of article 311(2) of the
constitution. After examining the relevant features of the EDA(Conduct &
Service) Rules, 1964, which according to the Supreme Court, contained elaborate
provision controlling the Payment, leave, termination of service, nature of
Penalties, Procedure for imposing penalties, right of appeal etc. The Supreme
Court hold that.
“It is thus clear that an Extra Departmental Agents is not a
casual worker but he holds a post under the administrative control of the
state. It is apparent from the rules that the employment of Extra Departmental
Agent is in a post which “exists apart from” the person who happens to fill it at any
particular time. Though such a post is outside the regular Civil Services,
there is no doubt it is a post under the state. The tests of Civil Post
laiddown by this court in Rana Chandra Dutta’s case (Suprav) are clearly
satisfied in the case of Extra Departmental Agents.”
The rules make it clear
these Extra Departmental agents work under the direct control and supervision
of the authorities who obviously have the right to control the manner in which
they must carry out their duties. There can be no doubt therefore that the
relationship between the postal authorities and the extra departmental agents
is one of master and servant.
The implication of the
judgement of the Supreme Court is that EDAs who have till now been not regarded
as holders of Civil Post will hence forth be entitled to be treated as holders
of Civil Post and as such safeguards available to regular Government servants
under Article 309 and 311(2) of the constitution will also have to be extended
to them.
It time factors for all
the work performed by the GDS is formulated, certainly it will pave way for the
regularization of many GDS who are actually working for more than six hours but
not availed the benefits of departmentalization. We don’t want any incentives
or perks denying our regularization.
The present Minister of
Communications & IT Sri Kapil Sibal has sought recently to the department
about the regularization of all the GDS for which the department has furnished
that it will cost around same crores. If new norms are fixed for the work and
taking consideration of providing computers at BOs to expand the services to
the public, We should not mind about the cost involved.
We,
therefore, request you kindly to utilise your good so that the issue relating
to the GDS employees are included in the preview and terms of the 7th
CPC.

IN CASE THE GOVT. DOES NOT INCLUDE GDS IN 7TH
CPC, A JUDICIAL COMMITTEE WILL BE APPOINTED UNDER RETIRED HIGH COURT OR SUPREME
COURT JUDGE.
CONGRATULATION
CHQ congratulates all
C.W.C Members, Circle Secretaries, Divisional/Branch Secretaries, our members,
well wishers, and the leaders of sister unions and members for their valuable
support during indefinite strike. With the co-operation of all, we got the
victory.
NEGOTIATIONS
Our leaders were invited
for negotiations on 12-02-2014 to discuss and decide the charter of demands.
Talks were held in the G.P. Roy committee hall between our leaders and
Departmental officers. The Dept. again denied to settle the demands and
requested our leaders to withdraw the strike. Our leaders decided to continue
the strike till the demands will be achieved.
Again the negotiations
were held in the office of Sri S.K. Das Regional labour commissioner (Central)
on 14-02-2014 and 17-02-2014. Com. S.S. Mahadevaiah, Com. B.V. Rao, Com.
Lakhwinder Pal Singh and Ram Singh M.P. Circle attended.
The Dept. of Posts handed
over the letter to our leaders in presence of labour commissioner written by
Member (P) to the Joint Secretary DOPT requesting clarification regarding GDS
inclusion in 7th Central Pay Commission and requested us to withdraw
the strike. We did’nt accept the request of the Dept. and decided to continue
the strike. It is a pity and shame that some leaders claimed that the
Departments letter to DOPT was the out come of the two days strike.
Our leaders were invited
for Negotiations after the strike started on 20th February, 2014 and
21st Feb, 2014 Com. S.S. Mahadevaiah, General Secretary, Com. B.V.
Rao, Asst. General Secretary, Com. D.N. Giri, President, R.P. Diwaker,
Treasurer, Com. C.B. Tiwary, Org. Secretary attended the meeting on 21st
Feb, 2014. After the negotiations in congenial atmosphere, an agreement was
accepted. We are herewith enclosing the agreement copy.
As per
the agreement
POSITION
OF CHARTER OF DEMANDS
(1) Grant of Civil Servant status to Gramin Dak
Sevaks.
The Dept of post is not competent
to settle this demands, After appointment of the 7th CPC or judicial
committee it will recommend to the Govt. of India for consideration.
(2) Inclusion
of GDS wage structure and service conditions in the purview of 7th
CPC.
The Dept. of Post started
sincere efforts for inclusion of GDS in 7th CPC. In case the Govt.
does not include GDS in 7th CPC A Judicial committee will be
appointed under retired high court or supreme court judge.
(3) Provide cent percent compassionate
appointments to the wards of deceased GDS employees.
This demand was denied.
Some modifications suggested by the staff side are taken into consideration in
due course.
(4) Revised
Recruitments Rules.
Revised Recruitment Rules
will be reconsidered and revised after two examinations.
(5) Merger
of 50% with pay for GDS.
It will not be not
decided by the Govt. to the Departmental employees at the time of negotiations
held. After the decision of the Govt. it will be discussed with union and
decide.
(6) Regularization of casual, part time and
contingent employees and revision of their wages w.e.f. 01.01.2006 and grant
D.A.
It is under active
consideration. DOPT submitted its report to IFS. It may be settled in short
time.
The Mean, Shameless, Anti-Trade union activities of
Com. M. Krishnan, Secretary General NFPE during our strike His deeds are shameful
to all working class.
He is unfit for hold the highest post of mighty
NFPE.
In the history of postal
trade union movement, No Secretary General of NFPE behaved like com. Krishnan
when struggles are launched against ruling class. It is shame to all working
class.
From the very first day
of the strike, he started to act in favour of administration and false
information was circulated through his website that the strike rate was only
5%. In the time of 2012 he made such type of false propaganda. Later we proved
that this narrow-minded leaders figures were absolutely wrong as per the
information of RTI Act. Then all the GDS spat on his face. Though he did not
get any realization. Again he started the same tactics. We don’t want to waste
our time on the mean, narrow-minded, down trodden leaders falls words. Time
will decide who are true? Or who are false? And GDS are with whom?
CHQ
STRUGGLES FOR JUSTIFIED DEMANDS OF GDS
The
General Secretary of AIGDSU submitted the charter of demands unanimously
resolved in the GDS National convention held at Delhi on 13-12-2014 in Agarwal
Dharmasala and requested to settle the demands. GDS convention issued
countrywide relay hunger fast programme at Circle offices from January 20-24th,
2014. Dept. of Posts denied to settle single demand and negative reply has been
given to the General Secretary. To put pressure on the Department Relay hunger
fast programme was successfully conducted in all Circles at Circle head
quarters from 20-24th January, 2014. The General Secretary Com. S.S.
Mahadevaiah attended the relay hunger fast in Hyderabad on 24-02-2014.
Due to
the adamant steps of Dept. We were compelled to initiate serious trade union
action. The General Secretary announced Indefinite strike from 18th
February, 2014 amidst thundering claps of 700 GDS employees who attend relay
hunger fast. The Indefinite strike notice was served to the Dept. of Posts on
29.01.2014.
