Dear Comrade,
It has come to our notice that Sri Nataraja Murti Committee on GDS is obtaining same information from GDS employees' uncertain items utiliseing the official power of the postal administration. We have prepared a short note on such items which is enclosed (you may elaborate/improve the suggestions by giving suggestions explaining practical aspects). The GDS employees should send the same at the space provided and forward on copy to the GDS Committee with copies to the Hon'ble Minister D.G. (P) and the Prime Minister. You should not forget to send a copy to the CHQ.
We further suggest that the Divisional/Branch Secretaries should organize a rally/dharana before the office of the Divn. Supdt of Post offices on 07.12.2007 and submit to him a consolidated list of such report him with request that he should forward the same to Sri Nataraja Murti Committee.
Sri Nataraja Murti Committee is also obtaining same suggestions from M.P's we have also prepared short note to be submitted by the Hon'ble Members of Parliament.
You are requested to contact your M.P. (Lok sabha and Rajya Sabha) and request him to send a note to Sri Nataraja Murti Committee on that line.
Since our protests have been over looked and not considered. We have to remain prepared for more penetrating agitation. We call upon you to remain ready for the same. You may mobilize GDS Comrades related to FNPO and BPEU to support the cause of the entire GDS Staff.

Sir,
Probably yours is the 5th E.D. (GDS) Committee to be appointed in the name of studying the conditions of service of the E.D. (GDS) employees. What has been done to the recommendations of the earlier committees indicates a very sorry state of affairs. Justice Talwar Committee carried out a detailed study of the things and submitted exhaustive recommendations. Not even a single recommendation was implemented is its original form while some four recommendations were twisted and diluted before implementation. The similar was the fate of Savoor Committee and Madan Kishore Committee where not even one recommendation was implemented. In view of such attitude, the Committee formed under your Chairmanship does not command much confidence. Besides there is a general feeling that your committee has been appointed against the protest of the Unions which reduces the confidence of the workers still more.
As regards our view on the given points, the same ore given below:
Improvement in the working conditions of GDS:
The working conditions of the GDS are pathetic and biggar words to describe. The BPM/SPM is required to offer his own accommodation without proper house rent. No furnitures are supplied, no iron safe for security of cash and valuables. No almirah to secure records and every thing is left to the SPM/BPM. No arrangements for public to sit or to write the letters or fill up forms. No counters.
The GDSMD and GDSMC and other GDS staff are not provided with uniform. Even some identity card is not supplied that they could establish their identity. No rain coats/water proof cover to protect the mails against heavy rains. These are illustrative. In order that the rural P.O or the ED BO/SO looks like a post office and the staff as such it is necessary that the following are provided:
1) The BPM: Proper and due house rent, electrical charge should be paid to the BPM
for the accommodation he/she provides. Proper counters should be constructed at government cost. Electric meters should be secured at Govt Cost and the electric consumption bill should be paid by the Department.
2) All furniture chairs - Tables including the ones for public use should be supplied.
3) Articles like Almirahs/cuboards and iron safe/chest should be provided for security and safety of cash/valuable and records.
4) Outdoor staff should be supplied all items of informs. They should be provided, with raincoats/water proof plastic bags for safety of mails.
5) Proper delivery bags/BO bags and cash bags should be supplied.
These are the minimum requirements with regard working conditions.
Improvement in wage structure:
This issue has been studied in detail by Justice Talwar Committee and after a Judicial study no further study is required. What is now necessary for your Committee is to ensure implementation of the recommendations of Justice Talwar Committee contained in the following paras:
Paras: 7.6; 7.6.1; 7.7; 8.1; and 9 regarding status
Paras No. 6.9; 6.10 & 6.11.-removing the restriction of maximum five hours duty.
Para No. 9.1, 9.2, 9.3, 9.4, 9.5 read with paras 6.12; 7.1; and 7.2 with regard pay scales – the amounts of pay scales to be replaced by amounts with reference to the scales recommended by the 6th CPC.
Paras No. 12; 12.1;12.2 12.3; with regard to Assured career progression with amounts in the scales to be substituted with reference to the scales recommended by the Sixth CPC.
Paras 17 (split duty allowance); Para 18 (Grant of rest); 19(Compensation) detained beyond duty hoers); 20(Work done on holidays/weekly of days); 22; 22.1(HRA & CCA); 22.2(TA); 22.3(LTC); 22.4(FCA); 22.5(Uniform); 23(Medical Facilities); 25(Advances); 26(Welfare measures)
Further apart form present promotional avenues and in place of present promotional procedure to PAs cadre against left over vacancies of L.G.O's the GDS employees having 10+2 qualification should be allowed to compete against 50% to departmental quota up to at age of 45 years and further 20% of the total vacancies should be reserved to be filled up exclusively by the GDS on the basis of competitive examination by age relaxation up to 40 years. Like Casual labourers, whether Full time or short time, the services may be regularised by combination of duties or attaching additional duties.
Provision of Social Security:
Para 13 on grant of pension; gratuity and GPF read also with Para 9 and 10; 13.2.4 with regard to counting of past service; 13.3 with regard to Reckonable service, 13.4 and 13.4.1 with regard to pension formula; 13.5 with regard to minimum pension with amount of minimum pension to be replaced with reference to the recommendations of the 6th CPC; 13.7 & 13.8 on retirement and Death gratuity; 13.9 on family pension with the amount of family pension to be replaced with reference to the recommendations of the 6th CPC; 13.10 on death and disability with the "5th CPC to be substituted by "6th CPC"; 13.12 in GPF, 13.13 on Group insurance (With amounts to be substituted with reference to the 6th CPC); 13.14.1 & 13.14.2 on voluntary retirement, This again has been studied and discussed in detail by Justice Talwar Committee. This leaves no further scope for study. Only the following well founded and elaborately discussed recommendations contained in the report of Justice Talwar Committee need to be implemented, and you may recommend accordingly;
Items of work that need to be added in the assessment of work load.
In addition to the present items of work, the following may be added:-
Deposit of PLI/RPLI premia, delivery of if PLI/RPL policies/pass books;
Payment PLI/RPLI amounts on sanctioned.
Collection of Telephone bills.
Collection of Electricity bills at the P.O., and Acceptance of water Bills at B.O.s
The proposal of social security scheme for rural implemented by state Government.
Any other item of work that is done on regular basis. i.e, actual work done like assistance to the staff, impression of date stamp on the bulk pass books, arrangement of forms, idle wait at the point of exchange of mails, while on duty at the office etc.,
Payment of pension including Railway pension.
Handling of Business Post items like delivery Prasadams etc.
The Election work, like verification of Electrol, collecting statistics, census work etc.
The works related to Rural Employment Guarantee Act now entrusted to the B.O.s.
Verification of mobile phone/ Bills.
Opening of New Accounts in SB.RD etc.
Norms for E.Post to other business posts
All other works related to Business Directorate.
Items of present work and new items of work that can be done in incentive/Commission basis.
1. Obtaining new PLI policies;
2. UTI and related works pass port service.
3. Popularizing /Propagating Postal Certificates or Postal Time deposits.
4. All other work beyond a particular Justified level;
Improvement in rural Postal Services and introduction of new products and services;
Adequate supply of necessary forms must be assured;
Supply of proper bags – cash bag, B.O. bag; stamp bag and delivery bag to be ensured;
Adequate financing of the B.O. to expedite payment of MOs/warrants of Payment must be ensured else this is one count on which the BOs and staff are subjected unjustified but avoidable criticism.
Arrangements for prompt removal of surplus cash must be made to protect the GDS,BPM/GDS,SPM from risk robbery/dacoity/theft;
Proper promotion and strengthening of conventional services which will ensure more revenue and work – especially end services have to be strengthened.
New products Telephone bills, Electric bills, UTI services, Pass Port work etc or those that can emerge letter.

Dear Comrade,
It has come to our notice that Sri Nataraja Murti Committee on GDS is obtaining same information from GDS employees' uncertain items utiliseing the official power of the postal administration. We have prepared a short note on such items which is enclosed (you may elaborate/improve the suggestions by giving suggestions explaining practical aspects). The GDS employees should send the same at the space provided and forward on copy to the GDS Committee with copies to the Hon'ble Minister D.G. (P) and the Prime Minister. You should not forget to send a copy to the CHQ.
We further suggest that the Divisional/Branch Secretaries should organize a rally/dharana before the office of the Divn. Supdt of Post offices on 07.12.2007 and submit to him a consolidated list of such report him with request that he should forward the same to Sri Nataraja Murti Committee.
Sri Nataraja Murti Committee is also obtaining same suggestions from M.P's we have also prepared short note to be submitted by the Hon'ble Members of Parliament.
You are requested to contact your M.P. (Lok sabha and Rajya Sabha) and request him to send a note to Sri Nataraja Murti Committee on that line.
Since our protests have been over looked and not considered. We have to remain prepared for more penetrating agitation. We call upon you to remain ready for the same. You may mobilize GDS Comrades related to FNPO and BPEU to support the cause of the entire GDS Staff.

Sir,
Probably yours is the 5th E.D. (GDS) Committee to be appointed in the name of studying the conditions of service of the E.D. (GDS) employees. What has been done to the recommendations of the earlier committees indicates a very sorry state of affairs. Justice Talwar Committee carried out a detailed study of the things and submitted exhaustive recommendations. Not even a single recommendation was implemented is its original form while some four recommendations were twisted and diluted before implementation. The similar was the fate of Savoor Committee and Madan Kishore Committee where not even one recommendation was implemented. In view of such attitude, the Committee formed under your Chairmanship does not command much confidence. Besides there is a general feeling that your committee has been appointed against the protest of the Unions which reduces the confidence of the workers still more.
As regards our view on the given points, the same ore given below:
Improvement in the working conditions of GDS:
The working conditions of the GDS are pathetic and biggar words to describe. The BPM/SPM is required to offer his own accommodation without proper house rent. No furnitures are supplied, no iron safe for security of cash and valuables. No almirah to secure records and every thing is left to the SPM/BPM. No arrangements for public to sit or to write the letters or fill up forms. No counters.
The GDSMD and GDSMC and other GDS staff are not provided with uniform. Even some identity card is not supplied that they could establish their identity. No rain coats/water proof cover to protect the mails against heavy rains. These are illustrative. In order that the rural P.O or the ED BO/SO looks like a post office and the staff as such it is necessary that the following are provided:
1) The BPM: Proper and due house rent, electrical charge should be paid to the BPM
for the accommodation he/she provides. Proper counters should be constructed at government cost. Electric meters should be secured at Govt Cost and the electric consumption bill should be paid by the Department.
2) All furniture chairs - Tables including the ones for public use should be supplied.
3) Articles like Almirahs/cuboards and iron safe/chest should be provided for security and safety of cash/valuable and records.
4) Outdoor staff should be supplied all items of informs. They should be provided, with raincoats/water proof plastic bags for safety of mails.
5) Proper delivery bags/BO bags and cash bags should be supplied.
These are the minimum requirements with regard working conditions.
Improvement in wage structure:
This issue has been studied in detail by Justice Talwar Committee and after a Judicial study no further study is required. What is now necessary for your Committee is to ensure implementation of the recommendations of Justice Talwar Committee contained in the following paras:
Paras: 7.6; 7.6.1; 7.7; 8.1; and 9 regarding status
Paras No. 6.9; 6.10 & 6.11.-removing the restriction of maximum five hours duty.
Para No. 9.1, 9.2, 9.3, 9.4, 9.5 read with paras 6.12; 7.1; and 7.2 with regard pay scales – the amounts of pay scales to be replaced by amounts with reference to the scales recommended by the 6th CPC.
Paras No. 12; 12.1;12.2 12.3; with regard to Assured career progression with amounts in the scales to be substituted with reference to the scales recommended by the Sixth CPC.
Paras 17 (split duty allowance); Para 18 (Grant of rest); 19(Compensation) detained beyond duty hoers); 20(Work done on holidays/weekly of days); 22; 22.1(HRA & CCA); 22.2(TA); 22.3(LTC); 22.4(FCA); 22.5(Uniform); 23(Medical Facilities); 25(Advances); 26(Welfare measures)
Further apart form present promotional avenues and in place of present promotional procedure to PAs cadre against left over vacancies of L.G.O's the GDS employees having 10+2 qualification should be allowed to compete against 50% to departmental quota up to at age of 45 years and further 20% of the total vacancies should be reserved to be filled up exclusively by the GDS on the basis of competitive examination by age relaxation up to 40 years. Like Casual labourers, whether Full time or short time, the services may be regularised by combination of duties or attaching additional duties.
Provision of Social Security:
Para 13 on grant of pension; gratuity and GPF read also with Para 9 and 10; 13.2.4 with regard to counting of past service; 13.3 with regard to Reckonable service, 13.4 and 13.4.1 with regard to pension formula; 13.5 with regard to minimum pension with amount of minimum pension to be replaced with reference to the recommendations of the 6th CPC; 13.7 & 13.8 on retirement and Death gratuity; 13.9 on family pension with the amount of family pension to be replaced with reference to the recommendations of the 6th CPC; 13.10 on death and disability with the "5th CPC to be substituted by "6th CPC"; 13.12 in GPF, 13.13 on Group insurance (With amounts to be substituted with reference to the 6th CPC); 13.14.1 & 13.14.2 on voluntary retirement, This again has been studied and discussed in detail by Justice Talwar Committee. This leaves no further scope for study. Only the following well founded and elaborately discussed recommendations contained in the report of Justice Talwar Committee need to be implemented, and you may recommend accordingly;
Items of work that need to be added in the assessment of work load.
In addition to the present items of work, the following may be added:-
Deposit of PLI/RPLI premia, delivery of if PLI/RPL policies/pass books;
Payment PLI/RPLI amounts on sanctioned.
Collection of Telephone bills.
Collection of Electricity bills at the P.O., and Acceptance of water Bills at B.O.s
The proposal of social security scheme for rural implemented by state Government.
Any other item of work that is done on regular basis. i.e, actual work done like assistance to the staff, impression of date stamp on the bulk pass books, arrangement of forms, idle wait at the point of exchange of mails, while on duty at the office etc.,
Payment of pension including Railway pension.
Handling of Business Post items like delivery Prasadams etc.
The Election work, like verification of Electrol, collecting statistics, census work etc.
The works related to Rural Employment Guarantee Act now entrusted to the B.O.s.
Verification of mobile phone/ Bills.
Opening of New Accounts in SB.RD etc.
Norms for E.Post to other business posts
All other works related to Business Directorate.

The Central Government had already through its Ordnance amended the Bonus Act to raise the bonus ceiling from Rs.2500/- to Rs.3500/- and the same was Gazette notified also.
The Staff Side Secretary to the National Council JCM had already written letters to the Secretary Expenditure and the Secretary DOPT demanding immediate orders to raise the same in respect of all Central Government Employees also.
The leaders of the Confederation also have been moving with the Finance Ministry to get the orders issued by the Ministry of Finance but the issue is being delayed unnecessarily. We are given to understand that the file is on the table of the Honourable Finance Minister who will decide about the course of action to be taken in this matter.
The Central Government Employees all over the country are very eagerly awaiting the orders and the delay is causing lot of resentment and anxiety. It was anticipated that the orders will be issued before Diwali Festival but even after the festival no orders are forthcoming from the Ministry of Finance. The Central Government Employees cannot be ignored when the Bonus Act had already been amended by the Government with retrospective effect from 1.4.2006 and all other section of the workers are being paid the bonus at the enhanced level.
The Confederation of Central Government Employees has therefore issued a call to all its affiliates to organise immediate protest demonstrations and dharna all over the country by mobilizing the entirety of our work force and send Telegrams / Savingrams to Shri. P.Chidambaram, Honourable Finance Minister, Government of India, North Block, New Delhi – 110001. The Call of the Confederation and the text of the Telegram are reproduced below. The AIPEDEU calls upon all its Circle Unions / Divisional and Branches to launch the above programme of action with all our might. The Circle Secretaries are requested to circulate this call to all their branches requesting them to hold the programme successfully.

2. Scrap the PFRDA Bill and cancel appointment of the Pension fund Managers; introduce statutory pension scheme for the new recruits;
3. Grant Trade Union rights including the right to strike to all Government employees through appropriate legislation;
4. (a) Stop downsizing the Governments, privatization and contractorization/casualisation of Governmental and teaching functions. Stop contractual appointments of teachers and workers; regularize all daily rated, casual and contingent employees.
(b) Lift the ban on recruitment and fill up the existing vacancies of all Government departments, educational institutions and State undertakings; Provide job to jobless.
5. Grant Interim relief of minimum of Rs.1000/-to all Central Government employees. Implement the 6th CPC Recommendation with effect from 01.01.2006.
6. Bring down the abnormally rising process of essential commodities and strengthen subsidized public distribution system.
7. Merge of 50% DA with basic pay with all consequential benefits and release of all DA installments to the State Govt. Employees.
8. Withdraw the 5% cap and other restrictions on compassionate appointment. Restore the compassionate appointment scheme wherever it stands abolished.
9. Stop the proposal to replace the CGH by Medicare insurance scheme.
10. Implement all pending awards of the Board of Arbitration.
11. Remove the quantum ceiling on Bonus and grant bonus to all.
12. Increase GPF & Small Savings’ interest and restore to its early level.

Dear Comrades,
At the outset we extend the heartiest Eid and Puja greetings to all our members, their family members and friends and to the entire postal fraternity. These festivals, we are confident, will infuse new enthusiasm and strength in us to fight out all that is unjust, unfair and exploitive our struggle will continue till we achieve our goal. We offer our thanks to our members for the unqualified support our struggle has received from them.
Calcutta Federal Council:- In this Connection the least said the better. All bounds of courtesy and niceties were crossed. The Reception Committee played the role of a partisan party and the volunteers worked as watch and watch of certain quarters. Due representation of our union was not admitted. Defying all norms of constitutional propriety, the working president Com. Narayan Chaudhary was not allowed to preside over the meeting when the President was not present. These actions, prima facie, are in disregard of the directions of the Hon’ble Delhi High Court. We have brought all these to the notice of the Hon’ble High Court. Everything was done to de-affiliate the AIPEDEU from NFPE, even at the Cost of disintegration of the NFPE.
One Day Strike On 30.10.2007:- Notice for one day taken on 30.10.2007 has been served by the NFPE which is an affiliate of the Confederation of Central Government employees and workers. We have been a part and parcel of the NFPE and Continue to be so and hence we have also served notice to go on strike on 30-10-07. As always we shall contribute our share to the strike. We support the call and our members will participate in the strike with all zeal and valour. We do support the demands. We, therefore, call upon our members to mobilize and organize the strike with all strength.
Bonus: - 60 days’ bonus has been announced for the postal employees. Though the cabinet has decided to enhance the pay-limit ceiling from Rs. 2500/- to Rs. 3500/-, necessary executive order probably has not been issued and hence orders for calculation of bonus on pay limit of Rs. 2500/- only has been issued.
GDS Committee:- our struggle to have an GDS Committee under the chairmanship of a High Court Judge has, so far, fallen on deaf years of the powers. Though we have been able to build up sufficient pressure and compulsions but the final break-through is yet to be achieved. Our fight is on and we shall succeed.

22nd Aug,2007 programme of ‘Parliament Chalo’ was an unparalled postal movement as about 6000 employees, GDS and departmental staff from all corners of the country gathered at Jantar Mantar, New Delhi to register their strong protest against appointment of official Committee, demanding Judicial Committee. Congratulations to the leaders and participants in the programme, making it a grand success.

Soon after the chalo and massive meeting, a big delegation met Shri.Oscar Fernandes, Union labour Minister, Shri.George Fernandes, Ex.Defence minister, Shri.Vikram Madam, MP of Gujarat and other MPs and submitted memorandum apprising the situation seeking kind intervention. There was good response from the public representatives. It was also observed that hundreds of e.mails and letters containing memorandum have been sent to MPs for kind intervention demanding social Justice to GDS employees.

The G/S AIPEDEU expressed the same in the CWC of P-III, held at Allahabad on 26.08.2007 and appealed all concerned to reconsider the issue in the interest of total unity/struggle. If we succumb to the dividing tactics of the bureaucracy, irreparable damange will be caused to the postal movement.

MEMORANDUM TO LOK SABHA SPEAKER 0N 22-08-2008

MEMORANDUM
Respected Sir,
We venture to draw your benign attention and through you the kind attention of the parliament, the highest temple of democracy, towards the plight of the Gramin Dak Sevaks of the Department of posts, by way of this memorandum. These Gramin Dak Sevaks who were earlier known as E.D.Agents are responsible for providing and maintaining the postal services to Rural India, more than two thirds of the total population. But these employees have been subjected to serious neglect and exploitation. The Government of India have not only kept these employees out of the purview of the sixth pay commission, but have also refused to appoint a separate Pay Commission for them under a retired judge of a High Court. The plea of the Government that the Gramin Dak Sevaks or the E.D.Agents, as they were previously known, are not government employees does not hold any water in view of the judgement of the Hon’ble Supreme Court of India in Gokulnanda Das’s case delivered on 22.04.77. The Hon’ble Supreme Court of India has declared that the E.D.Agents are holders of civil post under the union of India which means that they are Government employees.
Since last several decades Government have been confusing the issue of legal status of GDS as Government servants and taking ambiguous stand on their service conditions. Out of 1, 55,000 Post offices in the country, 1, 25,000 post offices are run by GDS. After sustained agitation, a Committee headed by justice Talwar was constituted by the Government in 1997. The committee came to the conclusion that GDS are Central Government employees and recommended accordingly.
The GDS have always been counted and treated as part and parcel of total work force of the Department of posts. According to Justice Talwar Committee their earlier designation of “Extra Departmental Agent” does not imply that they are a category distinct from departmental employees. The GDS are doing same work which the departmental employees are doing. In fact they are doing it in Rural India and therefore facing much greater hazards than others. The Talwar Committee also observed that the word "Extra" does not mean that they are not departmental employees. The most important recommendation which Justice Talwar Committee made was that in future these employees should be included within the purview of the Pay Commissions, keeping in view their number, their work profile, effectiveness to the postal system and the services rendered to the public.
The staff side of the National council (JCM) also demanded the inclusion of the GDS in the terms of reference of the Sixth Pay Commission which was not agreed to. These employees were therefore left with no option but to organise strike. When they decided to go on strike in April 2007, the Postal authorities held out an assurance that their claims would be referred to Sixth Pay Commission with the approval of the Government. This was eventually denied. Finally, the Government have appointed a committee headed by a retired bureaucrat known for his anti GDS bias. Nothing could be more contemptuous.
At the time of Fifth CPC, the GDS were given a separate committee which was headed by a retired Judge of Delhi High Court. There is, therefore, strong resentment against appointment of the GDS Committee under a retired bureaucrat. We demand that at least a separate committee headed by a Judge of a High Court as was done on last occasion. If a judge is appointed as head of the committee, he will take an unbiased and impartial view unlike a bureaucrat who will be influenced by the Government by his own anti GDS bias held all along during his service.
Our humble demand is that if the service conditions of the GDS have not been included in the terms of reference, a one man committee under a retired High Court Judge be appointed. This will be a great step towards justice to the Gramin Dak Sevaks and will ensure more congenial and tranquil atmosphere and satisfaction to the Gramin Dak Sevaks.
We, therefore, most respectfully solicit your kind intervention and advice to Government to accept our genuine demand.

Respected Sir,
A kind reference is invited to our letter of even No. dated 26-07-07 on irregular and arbitary appointment of G.D.S. Committee under a retired bureaucrat. In that letter we had vehemently protested against the appointment of the Committee under a retired bureaucrat. We had openly voiced our apprehension that the bureaucrats have an inherent bias against the Gramin Dak Sevaks and they do not deserve sit on judgement to decide the fate of these employees. Even four days have not clasped that our apprehensions are proving to be solidly right.
Sri. Nataraja Murthi, who probably took over charge of the Committee an the very day of appointment. (We donot know how it happened and what was looking behind the appointment and his immediate taking over charge). We have received several complaints that the said Sri.Nataraja Murthi who had previously worked as chief Post Master General in Andhra Pradesh Circle also, utilising his clout and previous influence an officers in obtaining memorandum under threat and duress from GDS employees and our Branch Unions in Andhra. This is not only unfair, illegal and liable to be condemned but is also against the norms set by previous commissions and committees in inviting memoranda and also below the dignity of a person who claims to sit on a judicial Chair ton the GDS issues and to give just recommendations.
This harassing and terrorising action of Sri. Nataraja Murthi has created great resentment and fury among our members and Branch Unions and is likely to stir the tranquillity prevailing in the Department.
Certainly, we are fighting constitutionally and peacefully against the appointment of this Committee and for appointment of Commission/Committee under retired judge of a High Court. And we did not expect such a terror-tactics of the hands of the so called Chairman of this illegally appointed committee. We are peace loving employees but we are committed to fight out any terror tactics and harassing action.
We, therefore, very humbly appeal to your honour to take necessary steps that Sri.Nataraja Murthi desists from resorting to Terror threatening and harassment. Arbitrarily as this Committee is appointed, the said Nataraja Murthi is resorting to illegal and unlawful actions. This needs to be immediately halted.

Sub: - Unilateral and high handed action of the Department of Posts in appointing an E.D. Committee.
Dear Comrades,
Ultimately the cat in out of the bag and the Department of Posts defying all logic, legality and transparency has suddenly and arbitrarily appointed an one-man E.D. Committee under a retired Member of Postal Services Board. The intentions of the Department have not been transparent.
You rember that our demand was appointment of a Judicial Commission/Committee under a retired Judge of a High Court. The bureaucrats in the Directorate twisted the demand and offered to make sincere efforts for inclusion its the E.D. (GDS) issues in terms of reference of The Sixth Pay Commission. Since the Fourth Pay Commission has agreed that in view of the decision of the supreme court in 1977, the E.D. agents were covered under purview of the terms of reference of the Pay Commission and Justice Talwar Committee had also recommended that the E.D. issues should be included in terms of reference of the pay Commissions to be appointed in future, we did not suspect that the demand was being wrongly twisted. An element of doubt arose some time back when a high bureaucrat in the Postal Services Board issued a letter that an E.D. Only two days back we were assured that a fresh effort for inclusion of G.D.S. issues in terms of reference of Central Sixth Pay Commission was being vigorously pursued. This has come to us as a rude shock. That the bureaucrats have an inherent bias against the G.D.S. is an open secret. In protest against this arbitrary and high handed action of the department in appointing an E.D. Committee under a retired postal bureaucrat, we immediately expressed our indignation in a letter addressed to the Prime Minister, a copy of which has been endured to several political party leaders urging their help for Justice to G.D.S. employees. We have also earnestly urged all M.P’s to come forward to our help in interest of Justice. We are enclosing copies of these letters for your information and necessary action. We call upon you all to urgently meet address your M.P’s and impress upon them to come forward to our help. The letter addressed to the M.P’s by us may be translated into local language and sent through you or through local leaders to the M.P’s. You should send a letter to the Prime Minister also. Let the Prime Minister’s office be flooded with three lakh letters/faxes.
Apart from it we are required to chalk out immediate trade union actions to press our justified demand for Justice and appointment of one-man-commission under a retired Judge of a High Court. Accordingly you are called upon to observe the following programme of action. In this struggle, we have to have confidence in ourselves we have requested all concerned to come forward to our help. Any help in our struggle and to any title extent will be welcome.
i) Contact, your M.P. and local/state political leaders immediately, impress effectively on them how the G.D.S. employees have been subject to injustice, and arbitrariness.
ii) Observe Protest Day on 3-8-2007.
iii) Organise massive Dharna and protest rallies at all Circle/Regional Head quarter’s where all available local leaders/dignitaries should be invited – on 8-8-2007.
iv) March to Parliament and in the evening deputation on your M.P. on 22nd August, 2007.All divisional secretaries are requested to come along with big delegation compulsorily to Delhi.
v) In case, still Justice is not done to us, prepare for indefinite strike in first week of September 2007. Notice for the strike will be served in time.
Comrades, this a do-or-die situation for us. Therefore the programmes should be organized with entire seriousness and to the fullest of the energy.

Dear Comrades,
Ultimately the cat in out of the bag and the Department of Posts defying all logic, legality and transparency has suddenly and arbitrarily appointed an one-man E.D. Committee under a retired Member of Postal Services Board. The intentions of the Department have not been transparent.
You rember that our demand was appointment of a Judicial Commission/Committee under a retired Judge of a High Court. The bureaucrats in the Directorate twisted the demand and offered to make sincere efforts for inclusion its the E.D. (GDS) issues in terms of reference of The Sixth Pay Commission. Since the Fourth Pay Commission has agreed that in view of the decision of the supreme court in 1977, the E.D. agents were covered under purview of the terms of reference of the Pay Commission and Justice Talwar Committee had also recommended that the E.D. issues should be included in terms of reference of the pay Commissions to be appointed in future, we did not suspect that the demand was being wrongly twisted. An element of doubt arose some time back when a high bureaucrat in the Postal Services Board issued a letter that an E.D. Letter to Prime Minister on GDS Committee.

Subject;- Examination of service conditions and wage-structure of Gramin Dak Sevak employees-appointment of judicial Committee.
Hon’ble Sir,
You will kindly agree that the Gramin Dak Sevaks (formerly known as E.D. agents), the most exploited and discriminated employees are the humble servants of rural population with regard to provision and maintenance of Postal services. The Supreme Court has declared these employees to be holders of Civil Post. The Fourth Central Pay Commission agreed that in view of this judgement, the E.D. employees were covered under the purview of terms of reference of the Commission.
The Department of Posts realised the position and a conscious decision, after appointment of the Fifth Pay Commission, and appointed a one man-judicial Committee to examine the issue under Justice Charanjit Talwar, a retired judge of Delhi High Court. Justice Talwar Committee made several land mark recommendations.
The Department of Posts unilaterally and in a high handed manner has overturned its conscious decision made in consultation with unions and has finalised appointment of an E.D. Committee under a recently retired Additional Secretary in the Department of Posts. This person during his incumbency demonstrated deep anti-Gramin Dak Sevak bias and got several orders issued which are to the detriment of the G.D.S. employees. He has lost his credentials to sit on judgement to decide the fate of the Gramin Dak Sevaks.
We as the only recognised representatives of the Gramin Dak Sevaks do solemnly declare that we are being pushed to the wall and being compelled to totally boycott this Committee. We demand appointment of a one man commission under a retired Judge of a High Court.
We on behalf of three lakh Gramin Dak Sevaks humble servants of rural population urge upon you to intervene and utilise your good offices to ensure appointment of a one man Commission under a retired Judge of a High Court.
If the Department of Post insists on its arbitrary action we are afraid, they want to threaten the tranquillity in postal services.

Gist of discussions of the meeting taken by Secretary(Posts)
19.04.2007 with N.F.P.E./F.N.P.O. to discuss the Charter of Demands.
A meeting with Secretary (Posts) and the Staff side was held on 19.04.2007 to discuss the Charter of Demands submitted by the N.F. P.E. and F.N.P.O. on 09.04.2007. At the very outset, Secretary (Posts) impressed upon the Staff side to present a united front in view of the stiff competition that the Department is facing from the couriers and the challenges from other vested interests as well. Secretary (Posts) stressed that any disruption in the services at this stage would distract from our efforts to strengthen and expand the postal business in the country. Secretary (Posts) thereafter, discussed the Charter of Demands with the Staff side. The gist of discussions is as under:
With most of the issues mentioned in the Charter of Demands, having been resolved, the Secretary (Posts) expressed the hope that the Staff side would continue to extend their cooperation in furthering the growth of postal services in the country.
CHARTER OF DEMANDS
Item No.1-
Appointment of Judicial Committee I Commission for GDS and grant status and Pension to GDS Employees.
Staff side was apprised that in view of special status of GDS, they were out of the purview of JCM scheme which also takes them beyond the scope of 6th Central Pay Commission. However, the Staff Side insisted on another attempt to be made for consideration of GDSs issues by the 6th CPC, set up for Central Government Employees. The request of the Staff Side that the matter may be referred to 6th Central Pay Commission by the Department has been considered. The Department will make the request to the Government that 6th Central Pay Commission may look into GDS also.
Item NO.2-
Exempt Department of Posts from the purview of reduction of staff strength and fill up all vacant posts in all cadres in Postal/RMS/MMS/Circle/Regional Offices/Postal Accounts and GDS including residual vacancies.
All efforts will be made by the Department to seek exemption of Department of Posts from the purview of the Screening Committee. Action will be taken to fill up the residual vacancies in various cadres. Heads of Circles will be advised to fill up residual vacancies in a time bound manner. . This will be monitored in the Directorate. In addition, it is also proposed to review the LGO examinations syllabus etc., to bring it in line with requirements of the job and thereby improve the success rate. An additional LGO examination will also be conducted with the revised syllabus.

Drop Franchising of Posta1 Scheme, stop closure of Post Offices' RMS Offices, Transit Sections' Relocation & merger of offices and Divisions, stop combination of beats of Postmen' stop curtailment of Postal deliveries, Outsourcing of PAO functions etc.
With regard to the Franchising of Postal Outlets, it was explained that as already discussed with the Staff Side, the Scheme is being introduced as a pilot project in those areas where the Department has not been able to reach and extend postal facilities. The Scheme also provide for a review after six months of its introduction the results of which will be shared with the Unions.
With regard to closure of RMS offices, Staff Side was informed that the Mail Offices will be rationalized in accordance with the agreement reached with the Federation. The isolated case of Bihar Circle pointed out by Staff Side will be reviewed. Secretary stated that intention is to compete with the couriers and not curtail delivery.
Item No.4-
Ensure monopoly of collection, conveyance and delivery of letter mail by the--Department of Posts as recommended by the Parliamentary Standing Committee.
It was explained that adequate care is being taken to safeguard the monopoly of the Department while proposing amendment to IPO Act.
Item No.5
Regularize Casual Labourers /Full Time/Part Time Contingency paid.
Staff Side stated that the part time casual labourers may be considered against the GDS vacancies. This will be examined.
Item No.6
Filling up of all norm based LSG / HSG-II / HSG - I posts & Restore periodicity of Junior Accountant promotion to Senior Accountant as 3 years.
Information has been collected from all Circles on the number of LSG/HSG-IIIHSG-I posts lying vacant. Action has already been taken to promote HSG-II officials in HSG-I as per the relaxation granted by DOP&T. All Heads of Circles will be addressed to take time bound action to ensure that LSG/HSG-II posts are filled up without any delay. Action taken to fill up the post will be monitored by the Directorate. Issues on bench mark for LSG etc., will be examined. The issue regarding periodicity of promotion as Sr. Accountant will be got examined.

Encashment of all pending bills OTA / TA / Medical/ RPLI Commission etc.
Instructions have already been given to all the Heads of Circles to clear the pending liabilities with the funds already allocated to them and intimate to Head Quarters the status of pending liabilities for release of additional funds where required. It was further decided to write to all Heads of Circles that wherever justified as per rules/guidelines, OTA will be paid to Post Office staff.
Item No.8
Grant of compassionate appointments to eligible candidates and absorb all approved candidates.
All eligible candidates for- compassionate appointment will be considered in accordance with the rules on the subject. Regarding certain cases pending in a few Circles, the matter will be examined separately.
Item NO.9
Complete take over of POSB and PLI by the Postal Department and accord full Autonomy to the Postal Board as in the case of Railway Board.
It was stated that the matter relating to Investment of P.O. Insurance Fund is under consideration of Government As regards POSS, the suggestions of Staff Side will be looked into.
Item No. 10
Recognition of Federations and setting up of councils at all level.
Subject to certain changes I inclusions in the Constitution of NFPE, the proposal has been agreed by Ministry of Personnel, Public Grievances and Pension. The Federation is being addressed in this regard.

Dear Comrades,
We are furnishing here under the recent developments concerning the postal employees in general and ED employees in particular.
v DEFERMENT OF CWC MEETING
Based on the requests received from various quarters to defer the CWC meeting to later date in order to enable Circle Secretaries / CHQ Office bearers to have intensive tour in their circles, the CWC meeting is deferred. The date of the meeting will be intimated later. Sorry for the inconvenience. However, we could find more time to mobilise the rank and file for the effective participation in the indefinite strike from 24-04-2007.
v 09-04-2007. STRIKE NOTICE SERVED!!
The strike notice was served on 09-04-2007 to the Department of Posts. The team was led by Com. C.C. Pillai, Secretary General. Our uncompromised on the issues like formation of Judicial Committee, shortage of staff, privatising the postal services etc. were explained before the Secretary.
v TOTAL UNITY – GO AHEAD WITH FULL PREPARATIONS
The Government is reluctant and not willing to settle our genuine demands. The JCA, as a whole is totally united and very firm in their commitments, the Bhartiya Federation & Unions have also served strike notice to the department and organising their cadres for the indefinite strike from 24-04-2007. There is a total unity.
v ROUMER MONGERS – BE AWARE!
As usual, there was a rumour floated by some vested interests that the strike notice had been withdrawn on 11-04-2007 and we were in receipt of spate of phone calls. We explained and confirmed the strike from 24-04-2007 over phone.
v NEGLECTED GDS! LAST STRAW ON CAMELS BACK
We have been treated as slaves all along. All our genuine grievances are either delayed or protracted. Nothing new issue was settled after 1998. Whatever be the demand, we have been replied by the department in a sterio typed reply that "17-12-98 order is the fullest and final settlement of ED Demands." Our legitimate demands on Social Security schemes, maternity leave to women employees are being denied. Instead of processing our scheme for the GDS, the department desired to implement through UTI which we rejected summarily.
v ENOUGH PATIENCE
If the next committee is not headed by a Judicial Member, all the recommendations of the Justice Talwar Committee will be buried once for all. We have lost our patience and our patience is as our misconstrued inability to fight against injustice.
v LAST RESORT – AGITATE, ACT & ADVANCE
Strike is the last resort. This strike is being threshed on the shoulders of the postal comrades. Under the existing shortage of staff, all staff are suffering without availing any leave. They are not being compensated for the excess work. As such, we have no other alternate except to agitate, advance and achieve our demands.
v CLARION CALL – 24-04-2007—BEGINNING OF INDEFINITE STRIKE
Let us prepare for the good show down from 24-04-2007 and continue our agitation till our genuine demands are mitigated. Let us fight unitedly against all evils and injustice and win the battle.

In the great epic, the Ramcharitmanas, Goswami Tulisi Das has said that the powerful person is beyond any sort of wrong doing. Similar is the saying: the king makes no mistakes. These sayings hold good ever today as ever. There may be no king in stricter sense of the term, but the kingship remains and the powerful do assert that what they say 'the rule'. All justifications, all legalities fail to make the powerful see the reason. So, the king and the kingship remain intact- the powerful politician behaving like kings and the kingship resting with the powerful bureaucrats.
Probably, our memory is not that short. Sometime back, the Hon'ble Minister for Communications while replying to a letter from some MP said that Justice Talwar Committee did not recommend merger of DA with Pay. When the actual recommendations of Justice Talwar Committee read with the recommendations of the 5th CPC were pointed out and explained, the power-that-be took to another track and very cleverly offered to appoint a committee of bureaucrats. Know On 12.02.07 the CHQ received a letter from the Directorate sent by Shri Harinder Singh, Member (P), vide D.O. No.F.6-1/2006-PE.II (Pt ) in which it was mentioned that the Dept had already appointed a GDS Committee to look in to the grievances of GDS employees. The Committee is headed by a Chairman and Sri A.K. Sharma, DDG (Estt.) is functioning as the Member Secretary. It is not revealed the name of Chairman of the Committee.
Thus the Dept. has decided to negate our request in formation of judicial committee for GDS demands. We are demanding the same only in order to revive and review the positive recommendation of Justice Talwar Committee which is the Magna corta of GDS workers. If we desire equality with Govt. staff, Pensionery benefits, regularisation, better service conditions, the recommendation of the justice Talwar Committee should not be buried by the subsequent committee appointed for this purpose. Its out of 42 recommendations several positive recommendations like departmentalisation, prorata basis, Social Securities like DCRG at par with regular employees, Pension, Family Pension, Maternity leave to Women employees, Leave facilities, HRA, CCA, Transport Allowance, loans and advances, Medical facilities, transfer, TA/DA facilities, Leave Travel Concessions etc., the Department has considered and implemented only five of its recommendations on 17-12-98 and closed the entire chapters of the other recommendations of the committee by repeatedly saying that the same is the full and final settlement of the recommendations. The Govt did not implement the recommendations of the Justice Talwar Committee and decided to continue the exploitation of the Rural Postal Workers. This paved way in denying the justified grant of 50% DA merger to GDS employees resulting in a continuous erosion of wages every month to the GDS for more than Rs. 100/- within these two years.
The committee or the bureaucracy can trust the things in the way it likes. If Justice Talwar Committee did not recommend the merger, it will not be given. If such merger and regulation of DA was recommended by Justice Talwar Committee and even if the same has been accepted, ever then it will not be given. Why? Because the powerful do not accept anything against what it thinks. They only win-heads or tails.

1. Appointment of Judicial Committee / Commission for GDS and grant status and Pension to GDS Employees.
2. Exempt Department of Posts from the purview of Reduction of staff strength and fill up all vacant posts in all cadres in Postal / RMS / MMS / Circle / Regional Offices / Postal Accounts and GDS, including residual vacancies.
3. Drop Franchising of Postal Scheme, stop closure of Post Offices / RMS Offices, Transit Sections / Relocation & merger of offices and Divisions, stop combination of betas of Postmen / stop curtailment of Postal deliveries, Outsourcing of PAO functions etc.
4. Ensure monopoly of collection, conveyance and delivery of letter mail by the Department of Posts as recommended by the Parliamentary Standing Committee.
5. Regularize Casual Labourers / Full Time / Part Time Contingency paid.
6. Filling up of all Norms based LSG / HSG –II / HSG-I posts & Restore periodicity of Junior Accountant promotion to Senior Accountant as 3 years.
7. Encashment of all pending bills OTA / TA / Medical / RPLI Commission etc.
8. Grant Compassionate appointments to eligible candidates and absorb all approved candidates.
9. Complete take over of POSB and PLI by the Postal Department and accord full Autonomy to the Postal Board as in the case of Railway Board.
10. Recognition of Federations and setting up of councils at all level.

Guidelines for conducting Strike
Dear Comrades/ Friends,
The Postal Joint Council of Action has already expressed its dissatisfaction on the negative approach of the Postal Department towards the problems faced by the Postal Workers and JCA in its meeting held on 20 th March 2007 has already decided and calls upon all Postal Employees to participate and make the Countrywide Indefinite Postal Strike from 24 th April, 2007 a grand success. The strike Notice would be served to the Secretary Department of Posts on 9 th April, 2007. Lunch Hour Demonstration and Rallies has to be organized all over the country at all work places by the JCA on 9 th April, 2007. Effective campaign and propaganda has to be continued by the JCA at all levels till the commencement of Strike. JCA may be formed at all levels if it is not already done.
Campaign Tour by Central JCA Leaders
Central JCA has decided to organize tour to all Circle/ Regional Headquarters. Federations and CHQs leaders of NFPE / FNPO will participate and address the meetings at all Centres. Circle /Divisional/Branch Unions are to organize meetings under JCA. Moblise entirety of Postal Staff in all meetings. All are requested to vigorously campaign for successful conduct of the indefinite strike for settlement of long pending demands of 5.5 lakh Postal Workers. Copy of strike notice which would be served to the Secretary Department of Posts, and Charter of Demands are enclosed herewith. Tour Programme of JCA Leaders are already Circulated to all Branches, by the respective Circle Secretary. All CHQ Office Bearers of NFPE/FNPO and its affiliates who are not deputed for All India campaign tour programme are requested to join the campaign meetings in their respective Circles .Follow the guide lines strictly for the success of the strike.
Guidelines for conducting Strike
1. Ensure formation of Joint Council of Action at Circle/Divisional/Branch level and complete this task without further delay.
2. The Indefinite Strike should commence at 6A.M. on 24-04-2007. In RMS Strike will commence from the commencement of duty on 24th April, 2007.
3. The Department through field officers may ask each employee to submit a declaration to state whether he/she is going to participate in the Strike or not. The declaration be returned to the Head of the Office with a statement of the concerned official that he/she will act as per the directive/decision of the Postal Joint Council of Action.
4. The Government may resort to punitive measures. All these attempts be foiled by mobilizing the entire work force in favour of the indefinite strike.
5. All who are in-charge of office and Joint Custodian should keep the keys with them. However if the Department wants surrender of those keys, the same should be done on proper quittance.
6. Employees on strike need not come to the office premises.
7. The office of the respective CHQ / Federation will function round the clock from 23-04-2007 and all Circle/Divisional/Branch level information be communicated over Telephone and also to ascertain the required information and direction. 8. Hand written Posters in regional languages be exhibited in all offices. A proforma of such posters is being published in our journals.
9. Intensive campaign be started immediately by holding General Body meetings/ gate meetings/Lunch hour meetings in each and every work places jointly.
10. Daily demonstration before opening of the office/ set during lunch hour between two shifts be arranged from 16-04-2007 to 23-04-2007. During the period eminent personalities / MPs/MLAs be contacted to get their solidarity and support to our struggle.
11. All rumors through media/Press /Interested quarters be ignored and nobody should believe such news unless it is verified from respective CHQ/Federations.
12. Do not be frightened with adverse criticism of the Government made in the Press and Electronic Media let loose to sabotage our struggle.
13. Ensure collection of strike fund and remit its share to the respective Circle/CHQ/ Federation immediately.

Indefinite Strike from 24 th April, 2007
Dear Comrades and Friends,
The National Postal Joint Council of Action comprising National Federation of Postal Employees (NFPE) and Federation of National Postal Organizations (FNPO) and its affiliated Unions met on 20th March 2007,, 5 P.M. at NFPE Office and reviewed the developments on the Charter of Demands submitted to the Secretary Department of Posts on 29th January, 2007. Com. D. Theagarajan, Secretary General, FNPO presided over the meeting.
The Department of Posts vide their letter No. 8-1/2007-SR (Pt) dated 22 nd February, 2007 communicated to the Federations item wise position of our Charter of Demands. The reply has been reviewed by the JCA. The JCA has expressed dissatisfaction on the negative approach of the Department towards the problems faced by the Postal Workers. The Dept. has not taken serious efforts to resolve the problems.
The JCA has therefore, decided : -
· to launch indefinite strike from 24th April 2007 .
· The strike notice would be issued to the Secretary Department of Posts on 09 th April 2007.
· Lunch hour demonstration has to be organized all over the country at all work places by the JCA on 09 th April, 2007.
· Effective campaign and propaganda has to be continued by the JCA at all levels till the commencement of strike.
National JCA has decided an All India Campaign Tour programme. The tour programme of JCA leaders are enclosed herewith. All Circle Unions under the JCA has to organize massive meetings at places where leaders attended the meeting. Federations and CHQ Leaders of affiliated unions of NFPE and FNPO who are not listed for tour programmes are requested to participate in all campaign meetings in their respective Circles.
JCA at all levels are requested to ensure effective and vigorous campaign among the employees for successful conduct of indefinite strike for settlement of our justified demands.
JCA may be formed at all levels if it is not already done.
