NOTICE

Notice under article 25 of the constitution of A.I.P.E.D.E.U, is hereby given that a meeting of the Central Working Committee of this union, will be held at Shri Kunvarbai Jain Dharmshala New Jail Road Jamnagar, Gujarat-361005 on 20th to 22nd November, 2009.The meeting will start at 11.00 hours on 20-11-2009.

All members of the Central Working Committee are requested to attend the meeting in time.

The following shall be the items of agenda for the meeting of the Central Working Committee.

AGENDA:

1. Organizational review:

(i) Position after membership verification in June 2009-Efforts required to be made for furtherance of membership. Results of the membership verification.

(ii) Remittance of quota to higher organizations i.e. CHQ and Circle union.

(iii) Financial review.

2. Government orders on recommendations of the G.D.S Committee with regard to Pay and allowances. Anomalies and discriminations arising out of 09-10-2009 orders, demand placed by the union and related matters. Further course of action.

3 Review of the strike called by this union/JCA and response of the Circles/Branches and necessary decisions.

4 Regularization and grant of Pension: (a)Terminal benefits such as Gratuity and Severance amount w.e.f1.1.2006 b) Pension as recommended with due consultation with unions.

5 Supreme Court Judgment on Gratuity to Gramin Dak Sevaks and further efforts thereof.

6 Promotion/ACP/HRA/Transport allowance and related issues.

7 NREG,RPLI and new schemes and harassment to GDS etc.

8 Grant Trade Union Facilities to GDS Union/non-grant of LWA beyond 180 days to CHQ office bearers.

9 Any other matter with the permission of the Chair.

Best Documentary film award.


Rural Postal Employees (English & Kannada/ 9 min/Deepaka Bharadwaj) Best Documentary film award.

It is a film on the lives, difficulties and challenges of issues faced by GDS employees of the rural postal service. Although they are classified as government employees, they hardly receive the benefits a government employee gets. It's a film that shows the hardships of their job, and the struggle for a better life.

Award Function was held under the Chairmenship of Sri Gurucharan Das, Chairman of Centre for Civil Society. Chief Guest of the function Hon’ble Minister of state for Rural Development, Govt of India, Ms. Agatha Sangma, addressed the gathering, Mr.Raj Liberhan, India Habitat Center Director,Ms. Shriya Kishore, Miss India Earth 2009,Ms. Gargi Sen, Film Maker, and others also present on this occasion.
Asia Livelihood Documentary Festival

Jeevika since 2003, aims at capturing the livelihood challenges faced by the rural and the urban poor and bringing it to the attention of the public, media, judiciary, and most importantly, policy makers.

This competitive festival is the first of its kind in Asia. Over the years, Jeevika has been successful in advocating for the cause of numerous small entrepreneurs, self employed, rickshaw pullers, street vendors, sex-workers, child labourers, farmers and forest dwellers.
Objectives

1. Document the livelihood challenges of the rural and urban poor across Asia.
2. Identify and bring to light policies and social, religious and cultural practices which prevent people from earning an honest living.
3. Advocate with the policy makers for changes in policies and with social leaders for changes in practices that can have far-reaching impacts on the lives of the poor.

Livelihood Freedom Campaign
The Livelihood Freedom Campaign is based on the principle that the quality of life is intrinsically related to the degree of livelihood and economic freedom.

Therefore the Centre promotes public policy measures to clear the path for free enterprise and through research, advocacy and outreach activities shifts the terms of public debate in favor of removal of barriers for pursuit of an honest livelihood.

THE GRAMIN DAK SEVAKS—THE SHOCKING STORY OF THE FOUNDATION STONES OF RURAL POST


The Postal services are provided by two sets of employees: (1) In urban areas by the full time Departmental Employees and (2) in rural areas by employees known as GRAMIN DAK SEVAKS (G.D.S.) who is put on duty for shorter period.

DO THE FOLLOWONG FACTS SURPRISE YOU?

The origin of the Extra Departmental Postal System to serve the rural areas of the country can be traced to 1866-67. Record also shows that these 'Miscellaneous Agents' of Postal service were also called "Extraneous Departmental Agents". And now although the nomenclature of these employees stands altered to 'Gramin Dak Sevaks'; their work, shockingly, continues to extend to the city areas as well!!

While the Pay and allowances and other benefits of other Central Government employees have already been revised, upwards, the same in respect of the G.D.S. employees is still to be done and there is a more to reverse the benefits already available!

GDS and their working conditions are governed by GDS (Conduct & Employment) Rules 2001. The GDS (Conduct & Employment) Rules are non-statutory. Such being the case they cannot simultaneously be governed by a different set of provisions under Industrial Disputes Act. This anomalous position has created administrative problems in administrating the ED System. As such it is necessary to make suitable amendment in the Industrial Disputes Act.

Service conditions of GDS are at a stark difference from the 'full time' departmental employees in urban areas! Why this discrimination is a question that clearly demands a convincing answer! Quite shockingly, they enjoy no pension; no constitutional gratuity; no leave similar to departmental employees and no allowances except the dearness allowance.

The Hon'ble Supreme Court has held them to be holders of Civil Post i.e. Civil Servants. However, Gramin Dak Sevaks are not governed by Central Civil Service (CCS) (Conduct) Rules 1964, CCS (Pension) Rules 1972, FRs & SRs, Central Civil Service (Recognition Service Association) Rules 1993, which apply only to the regular Government Servants. The Gramin Dak Sevaks are governed by separate set of rules. Thus GDS and Regular Employees of the Government belong to two distinct and separate groups. There is no parity in terms and conditions of employment between the regular Government employees and the Gramin Dak Sevaks!

What the GDS's desperately seek is a revision of their pay and allowances in light of the recommendations of the 6th Central Pay Commission.

Subject: -   Government orders on recommendations of the GDS Committee with regard to Pay and allowances.

Dear Comrades,

                 By this time you must have gone through the orders issued by the Government Dept. of Posts letter No. 6-1/2009-PEII dated 9.10.2009 and come to some conclusion regarding its implications. We feel that you must have also underlined the areas where improvements/modifications in the order or its implementation is required.

                 Comrades, many queries are forthcoming as to whether the recommendations of Gopinath Committee were given any weightage. Though Gopinath Committee was not a pay committee, still it was a Committee on implementations and several recommendations of this committee as to pay and increments should have been taken into considerations. If the pay scales and rate of increments suggested by the group of officers under Sri Gopinath were not to be implemented, serious doubts naturally arise why this group of officers was at all constituted. Any way, the orders have been issued.

                 We request you kindly to suggest within three weeks the specific improvements that we should seek. We are also studying the orders very minutely and on receipt of the feedback from Circle/Division/Branch and CWC members we shall prepare a detailed letter seeking improvements.

                 We shall also, hold the CWC meeting sometime next month to discuss the whole issue in detail.

                   Based on the orders, we have prepared a fixation chart in respect of several stages of scales in different cadres. We have posted the same on our web site.

Appeal

                 We would make a humble appeal to all our members. You are aware of the efforts that we have made and the benefits that have come on account of the same. We are not in habit of asking for donations. But now it is the time that we should have our own union building as also a separate legal expenses fund.

                 We call upon all our members to contribute Rs.200/- per member out of the arrears towards the Building fund and the legal expenses fund. The Divisional/Branch Secretaries are requested kindly to make special efforts for collection of the fund which may be sent to us giving the details of the collection.

                 We wish all our members a very happy Diwali.

It is because of the stiff resistance from the unions negative recommendations are not touched by the department.

WE ARE COMMITTED TO FIGHT FOR JUSTICE AND WE SHALL SUCCEED IN OUR EFFORTS IN THE NEAR FUTURE. PLEASE AWAIT THE DECISIONS OF THE UNIONS MEETING SHORTLY TO REVIEW THE MATTER.

DATE OF EFFECT OF THE SERVICE DISCHARGE BENEFITS SHOULD BE W.E.F. 1.1.2006. THERE IS NO COMPROMISE ON THIS ISSUE.

PRO-RATA WAGES, IRRATIONAL FIXATION OF T.R.C.A FOR GDSMP, BPM,GDSMC etc. are to be tackled appropriately.

Sub.: Havoc wreaked by severe floods in Karnataka and A.P. Circle.

 

Madam,

 

            The news of the devastation caused by the floods in North Karnataka (Bagalkot, Raichur, Ballary e.t.,) and A.P.  (Kurnool Region) does not require to be described in so many words. The condition of the marooned people and those who have been hit by the floods is beyond description and can only be imagined rather described.

 

            The Postal employees, especially the G.D.S. employees are spread over interior parts of the country side. Those in affected areas have lost everything, like other people. These Postal employees require help from the department of Posts. The states Government are trying to rush help to the affected people but these measure are proving to be too limited and too short to mitigate the misfortune. The Postal department, therefore, has to rush immediate help to its employees - help of immediate use and help for reconstruction of the property damaged by the floods.

 

            You are, therefore, requested kindly to view the situation in the flood affected areas as that of human tragedy and natural calamity and take immediate measures to rush the following reliefs to the Postal employees - departmental and GDS employees as;-

(i)       Arrange sufficient relief from welfare fund commensurate with the severity of conditions One month advances pay(TRCA);

(ii)     Grant of house building advances/flood advance, to the Postal employees so that they may repair reconstruct the damage done to their property.

We understand your anxiety and pulse.  Please earn patience.  Do not give room for any untoward incident to occur. 

IT IS NOT TODAY'S INSTANCE, OUR PAST HISTORY REVEAL THAT BY DETERMINATION, UNITY AND STRUGGLE WE REACH THE ENDS OF JUSTICE.

It is the procedure that Department needs to release orders/details.  ANY TIME IT IS EXPECTED.   Let us patiently await and act firmly and decisively.

07.10.2009 STRIKE DEFERRED

The JCA met on 05.10.09 reviewed the situation on the background of the announcement of the Cabinet decision on GDS proposals by the Hon'ble Minister of communications through Televisions and decided to defer the proposed indefinite strike form 07.10.2009

Details of the Cabinet decision is not yet made known. After the implementation, let us review the situation and decide future course of action demanding modification in the orders as per the demands of our union.
