PROVIDING SOCIAL SECURITY TO CONTRACTUAL LABOUR

Comrade,

 The
 Honorable Union Labour & Employment Minister Shri Mallikarjun Kharge gave this information in a written reply  in  Rajya Sabha.
In cases where  the contract worker perform  the same or similar kind of work as the workmen directly employed  by the principal employer of the establishment, the wage rates, holidays , hours of work and other conditions of service  shall be the same as applicable to the workmen directly employed by the principal employer doing the same or similar kind of work.    The liability to ensure payment of wages and other benefits is primarily that of the contractor and, in case of default, that of the principal employer. 

In that case the contract labour working in the Central Government offices who are actually performing the duties that of the regular workers/ employees example such as MTS, Driving a vehicle, peon jobs, safiwala. Postal jobs by GDS workers should be provided with the wage rates, holidays , hours of work and other conditions of service  shall be the same as applicable to the workmen directly employed by the principal employer (Central Government ) doing the same or similar kind of work.      

PROVIDING SOCIAL SECURITY TO CONTRACTUAL LABOUR
                 The Contract Labour are engaged in the industrial sector  by the Government and Private establishments  as per their terms of contract and requirement and   no centralized data is maintained. However, the estimated number of contract labour  engaged by licensed contractors  in central sphere including the industrial sector in  the last three years is as under:

                Engagement of  contract labourers is regulated under   the Contract  Labour (Regulation & Abolition) Act,  As far as the security  in term of  wages and other service conditions is concerned,  as per the  Contract Labour (Regulation & Abolition) Central Rules, 1971 , the wages of the contract labour shall not be less than the rates prescribed under  Minimum Wages Act, 1948 and in cases where  the contract worker perform  the same or similar kind of work as the workmen directly employed  by the principal employer of the establishment, the wage rates, holidays , hours of work and other conditions of service  shall be the same as applicable to the workmen directly employed by the principal employer doing the same or similar kind of work.    The liability to ensure payment of wages and other benefits is primarily that of the contractor and, in case of default, that of the principal employer. 
                 In the central sphere, the Complaints are received in the field offices of Chief Labour Commissioner(Central) Organization under the Contract Labour (Regulation & Abolition) Act, 1970, Minimum Wages Act, 1948 and by   other laws applicable on contract labour which are investigated and action is taken. Social security aspects of contract workers under Employees Provident Fund and Miscellaneous Provision Act, 1952 and Employees State Insurance Act 1948 are enforced by the Employees Provident Fund organization and Employees State Insurance Corporation respectively provided the establishments in which outsourced workers are working are covered under the said Acts.  Central Government hasalso prohibited employment of contract labour in various establishments in central sphere through 84 Notifications issued from time to time under the Contract Labour (Regulation & Abolition) Act, 1970. To safeguard the interests of the contract labour further in term of wages and social security, a proposal to amend the Contract Labour (Regulation & Abolition) Act, 1970 is under consideration of the Government.
                The Union Labour & Employment Minister Shri Mallikarjun Kharge gave this information in a written reply  in  Rajya Sabha today.

DECLARATION

 

Dear President and Comrades,

We have discussed elaborately and deeply the most pressing problems of Gramin Dak Sevaks and made resolutions unanimously in the 7th All India Conference held at Mozri from 6th April, 2012 to 8th April, 2012. We have also discussed the situation arising after implementation of Natarajamurthy Committee recommendations from 9.10.2009. A four phased programmee was given in the 7th AIC to settle the burning problems of Gramin Dak Sevaks. The three phased programmes were successfully conducted at Division/Regional/Circle levels. Congratulations to all the leaders and members of our union of successful implementation of CHQ programmes. Our General Secretary submitted all the resolutions resolved unanimously in 7th AIC to the Secretary posts. There is no action from the Department.
 
Our General Secretary met Shri Sachin Pilot. At his residence along with other leaders and explained the problems facing by Gramin Dak Sevaks after implementation of Nataraja Murthy committee reconsideration half an hour time.

The minister paid very much patience to listen the General Secretary AIPEDEU and assured the General Secretary to settle the problems brought to his notice.

Unfortunately, the assurances of the minister was not been put into practice. Again a delegation consisting of Com. S.S. Mahadevaiah, General Secretary, Com. B.V. Rao, Asst. General Secretary and Com. Rajendra Diwaker, Treasurer met Sri Sachin Pilot and requested his intervention to take necessary action to settle the problems which have been already brought to the notice of the minister. Here assured us to take necessary action.

Later the General Secretary and Asst. General Secretary approached the concerned officers in the Directorate and discussed about the regularization of GDS Grant of Bonus ceiling of Rs. 3500/-, pay protection to GDS, remove Rs. 20000/- per one point, implementation of Medical Scheme, Grant of Compassionate appointments for all, Grant of three promotion to GDS, Stop abolition of GDS posts and grant all other benefits and facilities par with departmental employees.

We suggest the department of posts to modify the new recruitment rules of Postman/MTS. Previously 25% posts are to be filled up by senior GDS officials. Per the new recruitment rules the provision has been removed. We demand that 25% postman posts have to be filled up by senior GDS officials and Stop unfiled vacancies has to be filled from open Market.

In the previous recruitment rules 75% MTS/Gr-D posts have been allotted to GDS. But in the new recruitment rules 25% has been curtailed. WE demand that the previous position may be restored.

The Secretary Department of Posts agreed in principal to settle the above mentioned problems as early as possible. But no action has been taken to settle the single problem.

In this back ground we are compelled to go for serious trade union action. To discuss and decide the trade union action to settle the most pressing problems of GDS, this All India convention is being conducted in Delhi. You are all aware that we were sent out from JCA unilaterally by NFPE after April, 2012. We wish to from another JCA with other unions/federations to fight against the retrograde recommendations of Natarajamurthy committee. We wish to take up the serious trade union action as there is no alteration to settle our justified demands under the banner of proposed JCA. The programme of action will be decided soon after with the consultation of the above mentioned federations and our well wishers.

We are also seeking your advices in this regard. We do believe that there is no way except struggle to settle our justified demands.

HISTORICAL AND COLOURFUL CONVENTION

 
                An historical and colourful convention of AIPEDEU with 1800 delegates from 21 circles was held at Aggarwal Dharamshala Delhi on 24th August 2012. Com. Gurudas Das Gupta, M.P. Lokshaba and General Secretary  AITUC inaugurated the convention among the thundering slogans on GDS fraternity Com. S.S. Mahadevaiah, General Secretary, AIPEDEU elaborately discussed the problems of GDS of all cadres and sought the advice of the comrades for future agitation to achieve the justified demands. All the delegates suggested indefinite strike with one voice.
                Com. G.L. Dhar, Secretary, AITUC, Com. P. Suresh, R-IV General Secretary, Com. K.K. Sharma, Vice President, NFPE, Com. H.S. Guleria, Circle Secretary, P-III, Com. B.G. Thamenkar, Ex. President, NFPE, Com. Shiv Ram Shukla, Ex. All India President, R-III, Com. G.S. Asiwal Ex. AGS and Circle Secretary, P-III, Com. D.P. Diwakar, Com. Bhim Singh Sharma, Com. Gulab Singh, NFPE Leader Punjab and P-III, P-IV leaders also attended the Convention.
                Declaration of Convention was unanimously adopted all the resolutions proposed by Com. B.V. Rao, AGS and seconded by Com. Mahendra Pratap Singh  were also unanimously adopted.

                AIPEDEU Central Working Committee Meeting was held at Aggarwal Dharamshala, Delhi on 23rd August, 2012. Out of 22   Circle attended.

SUCCESSFUL  CWC OF AIPEDEU


The first Central Working committee after 7th AIC was  successfully conducted on 23rd August  2012 at Agrawal Dharamasala, Delhi. Out off 22 Circles 21 Circles attended the meeting and discussed at length on pressing problems of GDS. Out of 15 office bearers 14 office bearers attend.
