Dear Comrades,
 
The meeting of the  National Federation of Postal Employees & All India Postal Extra Departmental Employees Union  held at New Delhi on 12th August,2010 resolved to conduct joint nationwide campaign amongst the Postal, RMS, MMS, Postal Accounts, Postal Administrative Employees and GDS Employees to participate in the nationwide one day strike on 7th September, 2010 decided by the Central Trade Unions, State and Central Government Employees Organisations, Banks, LIC, College and school Teachers Organisations etc in a joint national convention held at New Delhi on 15th July 2010 in protest against unprecedented price rise of essential commodities, violation of trade union rights, ban on creation of Posts, contractorisation, outsourcing and privatization, Regularisation of Gramin Dak Sevaks and Casual Labourers fundamental trade union rights etc.  The Charter of Demands and copy of Strike notice is attached herewith for your campaign.
 
We would call upon all Circle/Divisional and Branch Secretaries of NFPE and GDS Union immediately to hold joint meetings at all offices and ensure participation of all staff and make the 7th September, 2010 strike a grand success.
 
We are having the moral responsibility to raise our voice and record our concern against the onslaughts unleashed on working class and we are wholeheartedly participating in the nationwide strike organised on 07.09.2010. All are requested to involve themselves in total for the successful result of the ensuing strike.
 
All Circle Secretaries are requested to submit the strike report to the respective Federation/CHQ.

The Convention resolves to go in for phased agitation by the working class all over the country to culminate in countrywide strike action. Regularise all Gramin Dak Sevaks daily rated workers/employees. Remove the ceiling on compassionate appointments; end the discrimination in the bonus ceiling of GDS employees. The Convention unanimously decides the Countrywide General Strike on 07th September, 2010. This calls including the demand of Regualisation of GDS employees and end the discrimination in the bonus ceiling of GDS employees. It is our duty to make the programme a grand success.
 
All Circle/Divisional/Branch Secretaries are requested to give wide publicity among the members. All are further requested to mobilise members for the grand success of struggle programme, General Strike on 07th September, 2010.

Charter of Demands

1.       Price rise of essential commodities to be contained through appropriate corrective and distributive measures like universal Public Distribution System and containing speculation in commodity market.
2.       Concrete proactive measures to be taken for linkage of employment protection in the recession stricken sectors with the stimulate package being offered to the concerned entrepreneurs and for augmenting public investment in infrastructure.
3.       Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.
4.       Steps to be taken for removal of all restrictive provisions based on poverty line in respect of eligibility of converge of the schemes under the Unorganized Workers Social Security Act 2008 and creation of National Fund for the Unorganized Sector to provide for a National Floor Level Social Security to all unorganized Sector workers including the contract/casual workers in line with the recommendation of National Commission on Enterprises in Unorganized Sector and Parliamentary Standing Committee on Labour.
5.       Disinvestment of shares of Central Public Sector Enterprises (CPSEs) is not resorted to for meeting budgetary deficit and instead their growing reserve and surplus is used for expansion and modernization purpose and also for revival of sick Public Sector Undertakings.
6.       Fill up all vacant posts, lift the ban on recruitment and create justified new posts.
7.       Stop outsourcing/contractorisation of Governmental functions
8.       Regularise all Gramin Dak Sevaks daily rated workers/employees, remove the ceiling on compassionate appointments; end the discrimination in the bonus ceiling of GDS employees.
9.       Withdraw PFRDA bill and extend the statutory defined benefit pension scheme to all Government employees
10.   Guarantee right to strike as a fundamental right of employees.

I am directed to enclose copy of the subject cited judgment of Hon. Supreme Court of India.


2 Consequent on introduction of RTI Act 2005 and the directions of the CIC to supply photocopies of answer papers to the candidates, filing of Court cases in the Tribunals has increased enormously. Various CAT Benches are also directing the Department to get the answer papers revaluated .On filing writ petitions in the High Courts against the orders of the CAT Benches, the High Court are also disposing off the cases saying that they don't want to interfere in the matter. It is stated that Rule 15-Appendix-37 of Postal Manual Volume-IV clearly stipulates "Revaluation of answer scrip is not permissible in any case or under any circumstances". Thus it is not permissible to consider requests of candidates for revaluation after declaration of results as it will not only cause great inconvenience to the examination process and also cause hindrance to the administration in the absence of vacancies of particular category viz, OC, SC,ST etc under departmental quota but also be against the sprit of ibid Rule.


3 .It may be seen that representations requesting for revaluation of answer papers are being received in this office specifically pointing out the following grievances:

(i) Particular answer(s) were not evaluated.

(ii) Excess attempted answer (s) was not evaluated.

(iii) For the some answer (s), the examiner awarded marks to one candidate and to another candidate no marks were assigned or the answer struck off as wrong.

(iv) All the answers were evaluated but justified marks were not awarded by the examiner.

4. The issues indicated at (i) to (iii) above are justified and need to be examined by the competent authority to find out the facts and if the calm of the candidate appears to be genuine, revaluation may be got done by an independent examiners in such cases and further necessary action may be taken. In so far as the issue indicated at (iv) above, there is no need to consider such requests and merits rejection of the initial stage itself.


5. In the similar situation in the Civil Appeal No(s) 897 of 2006 and 907 of 2006 between Himachal Pradesh Public Service Commission (Appellant) and Mukesh Thakur & Anr (Respondents), Hon. Supreme Court of India has upheld the plea of the Himachal Pradesh Public Service Commission rejecting the request of a candidate for revaluation .In the light of the judgment of Hon. Supreme Court , it is requested to review all pending court cases filed in various CAT Benches/High Courts by the candidates of various departmental examinations seeking directions for revaluation and declaring them as successful on the pretext that the evaluation was not done properly by the examiners and file suitable interim replies in the courts producing the copy of the Supreme Court judgment seeking dismissal of the cases . All pending representations received from the applicants seeking revaluation of answer papers covered item (iv) of para 3 above may also be disposed off at the Divisional/Regional/Circle level as the case may be without forwarding the same to this office.

INDIA POST IN NEWS PAPER

Govt may bank on post offices for financial inclusion

NEW DELHI: The neighbourhood post office may soon become a full-fledged bank as the government could facilitate a bank licence for India Post as part of a multi-pronged strategy to achieve greater financial inclusion.

The Reserve Bank of India is expected to soon come out with draft guidelines on licences to new banks
“India Post is a strong contender for banking license given its spread across the country,” said a finance ministry official.

The postal department already works as a quasi bank, providing a host of savings products, postal life insurance, pension payments and money transfer services through its 1.55 lakh branches, more than any other bank.

It, however, does not provide credit, the most important bit of financial inclusion. A banking licence will help fill that gap enabling the delivery of modern banking facilities in areas lacking access to financial products, credit and savings.
The department is expected to soon seek the required clearances from the Postal Services Board to expedite the process.
The Department of Post has already hired international consultancy firm Accenture to modernise the post offices across the country, which will also help create infrastructure for banking services.
“Once the infrastructure in place, we will able to assess if we need to rope in another player or not and accordingly get clearances from the RBI,” said an official with the Department of Post, adding that a Cabinet approval will also be required before commencing operations.

The idea of the Department of Post evolving into a bank has been around for a while. In 2006, India Post had even decided to appoint consultants to chalk out a regime for the transformation.

“There was a proposal to set up a bank with an initial capital of Rs 1,000 crore. The bank was to be set up as a subsidiary with the postal department holding a 51% stake in it,” said the finance ministry official.

More recently, the idea of a banking licence for India post was discussed in the inter-ministerial committee for financial inclusion, said an official of the Postal Services Board adding that the organisation was keen to provide banking services.

It is already working on core banking solution (CBS) for nearly 4,000 of its branches, which will allow customers to operate their accounts from any of the networked branches. The department has provided for Rs 106 crore towards development of CBS software.

Both the government and RBI have indicated that financial inclusion will be major criteria for giving new banking licences. “The final decision on granting a new licence will be taken by RBI. It will be a consultative decision as India Post is a government arm,” the official said.

A government committee on financial inclusion had also recommended that “India Post, with its ubiquitous reach should actively position itself to offer a low-cost, light-weight bank account to anyone enrolling for a Unique Identity Number.”

As per the committee report, nearly 16 crore people use India Post to save Rs 3,23,781 crore as on March 31, 2007. Out of this, deposits in savings bank account alone is Rs 16,789 crore, which makes a strong case for India Post to deepen the level of financial transactions and offer banking services to the rural population.

The Thirteenth Finance Commission has even proposed a budget of Rs 3,000 crore to be used for delivering an incentive of Rs 100 into the bank account of each BPL resident who enrolls for the UID Project.
