Editorial of the Rural Postal Employees


JUSTICE DELAYED………………………….?

A leader once expressed his opinion on GDS problems.  We can easily count the stars in the sky but not the problems of GDS!  There was no dispute over the statement because it is a fact.  Since there is no change in the policy adopted by the British rulers, that is cheap labour/hire and fire, exploitation would continue till it is resisted tooth and nail.

Let us take an example of COMPASSIONATE APPOINTMENT TO THE WARDS OF GDS DIES IN HARNESS.  The scheme is to support the family of the deceased GDS immediately after the death, to assure bread, to wipe the tears, to mitigate hardship being faced due to unforeseen death etc. etc.  There are instructions issued often to process the cases of compassionate appointment but hardly followed.  There are cases delayed for years and ultimately it is the family members of the GDS suffer!  Would the D.K.Chauhan committee at least appreciate our views this time and come out with justified recommendations?

Some live examples from Karnataka:  A ward of a deceased GDS namely Anil Shinde is craving for compassionate appointment but denied by the committee for the reason that the family did not earn minimum of 51 points.  THERE IS NO PROVISION TO GRANT POINTS FOR EXTRANIOUS MATTERS.  In Shinde’s case his younger brother is suffering from mental ailment and the family cannot afford the child special training/vocational training/education.  This may be possible later after assuring the family appointment in relaxation of recruitment rules.  He has lost both his father and mother.  There are no discretionary powers to the committee to give points, really strange in deed! 

In another case, the ward of the GDS had to discontinue his studies temporarily as his father was suffering from paralysis. He worked as his father’s substitute and earned for the family needs.  No point is given for education of this child for the reason that the child was not pursuing his studies at the time of death of the GDS!

A GDS died before issue of charge sheet, that is at the stage of allegation/preliminary state of suspected fraud.  But compassionate appointment is denied to the wife of the GDS dies in harness for the reason that past record of the GDS was not good.  The principle of nil nisi bonum is not applicable to the GDS staff unlike regular staff, an act of discrimination and violation of article 14 of the constitution!  There is no such restrictions for regular staff, why discrimination towards poor GDS?

Due points for remarriage of a woman, divorcee, is proposed!  For this reason the ward of the diseased is denied appointment, case of Vageesh s/o Nagendrappa of Belalagere BO under Kanivebilichi SO in Shimoga division, Karnataka.  Similarly points for pursuing education of children after the death of the GDS, not given e.g. cases of Anup kumar s/o Ghanashyam BPM, Issur BO and Mohan kumar the ward in Hassan division, Karnataka. 

Hence in order to end such sufferings of the poor it is urged upon the concerned to look into the matter seriously and cause to further liberalise the norms for offering compassionate appointment.  Powers to the CRC committee is presently need of the hour. Any further delay in this regard would be to deny JUSTICE PERMANENTLY! All past cases need to be reviewed for obvious reasons!

MEMORANDUM
This union is humbly submitting the following facts for your kind consideration and favourable action on behalf of 2.62 lakhs of GDS employees.  

 Our union conducted Indefinite Strike from 10.03.2015 to 23.03.2015 requesting the Department of posts to honour the agreement reached between our union and the Dept. of posts on 21.02.2014 copy enclosed. We were assured by the Dept. and M.P’s and Ministers that the Indefinite Strike demands would be settled only after with drawl of strike. To honour them our union with drew the strike. But the Department has not taken any positive steps to settle the demands.

 2.     The Department introduced Service Discharge Benefit Scheme (SDBS) to GDS to provide Monthly Pension. GDS also contributed Rs. 200/- per month. The Department assured to implement the scheme from 01.04.2014. No retired GDS has been paid pension even today. This union is requesting to provide provisional pension Rs. 3000/- per month till the SBDS will be implemented.

 3.     Rastriya Swastya Bima Yojana (RSBY) for GDS is also accepted by the Dept. of posts and the file was sent to Ministry of Finance for approval. The file was kept in finance for two years. Prime Minister introduced for common people Prime Minister Rastriya Swastya Bhima Yojana.

Your kind intervention is requested to settle the matter as early as possible.
 Hence this union is requesting the Hon’ble Ministers kind intervention to settle the three issues by utilizing your good offices.

            between  AIDGSU and the Secretary, Department of Posts –reg.,

Ref:-    Directorate’s Letter No.17-13/2013-GDS(Pt.)  dated at New Delhi
            the 20  April, 2015.

Respected Madam,

          Our union is in receipt of the Directorate’s Letter cited under reference above, where in it is intimated that the Department of Expenditure (Ministry of Finance) has rejected even the Second request of our Directorate for Re-consideration of ‘Inclusion of GDS in 7th CPC’ and it is also intimated to our union that the process of ‘Terms of References’ is also under preparation by the Directorate for the proposed Committee for Grameen Dak Sevaks of our Department. In this connection, our union would like to convey the Directorate that:

1.   Our union which preferred several representations and conducted for a 4 day strike in Feb’14 for getting the GDS included in the 7th CPC, reached with an agreement with the Directorate in Feb’14 itself ‘for consideration  Constitution of a Judicial Committee by the Department of Posts’ in the event of   the recommendation of the Directorate for inclusion of  2.63 Lakh GDS’s legitimate demand for inclusion in 7th CPC is rejected by the Ministry of Finance, Department of Expenditure.

2.   Now, in the light of the above cited Directorate’s letter the GDS in general, Our union in particular  which conducted struggles for achieving the legitimate demand expresses our deep-dissatisfaction over the decision of the Department of Expenditure which pained the entire GDS fraternity.



3.   In this connection, it is not out of place to mention that Our union even compelled to conduct a Nation-wide strike also from 10-3-’15 to 20-03-’15 in which majority of the GDS participated  for getting a ‘Judicial Committee appointed’ by the Department of Posts as per the agreement reached in Feb’14 along with other crucial demands as the First Recommendation of the Directorate to Ministry of Finance, Department of Expenditure for inclusion of GDS into 7th CPC is not materialized. But, the Second recommendation of the Directorate also denied.

The Department of Posts again decided to refer third time the GDS inclusion in 7th CPC to the Department of expenditure on the request of postal JCA. We vehemently felt that the postal JCA is not the competent to discuss and decide the GDS problems as per the directorate letter no. 16-09/2014-SR dated 5th March, 2014.

It is naked fact that the postal JCA intentionally wanted to make delay for appointing judicial Committee for GDS. The Govt. Appointed 7th CPC for Departmental employees in Feb, 2015. But GDS issue has not been finalized till date either inclusion in 7th CPC or appointment of Judicial Committee.

There is a frustration among the GDS regarding this issue. We are requesting the Dept. to settle the matter i.e. inclusion in 7th CPC early with sincere efforts. Otherwise appoint judicial Committee for GDS as per the agreement between this union and the Department. We have already submitted our views and suggestions regarding judicial committee even no on 24.04.2015. 

Dear Madam,

         It is a known fact the GDS across the country are striving hard in taking forward all the Small Savings as well as Business Development Activities besides their noble service of NREGS, SSP Payments etc., due to which the Department as well as the Union Government is getting name and fame. Yet, the just demand of ‘Recognizing them as Civil Servants remained un-addressed by the concerned despite their noble service. It is also an Established Fact that in the changed Scenario, more and more highly Educated Candidates are being recruited as GDS, thus increasing the skill of the work nature in all spheres.

It is also a naked fact that the Last ‘Officer’s Committee of Sri.Natarajamurty could not address the GDS long pending problems as well as their service conditions with judicial view which necessitated the Department for appointing a subsequent ‘Officer’s Committee’. Yet, the GDS who are considered as Back Bone for Department’s survival could not get any legitimate justice.  Hence, annoyed by the adverse recommendations of the said ‘Officer’s Committee ‘the frustrated GDS resorted to conduct so many agitational programmes for getting their due justice.                                                                     
                                                        

Our union also would like to bring to the notice of the administration that during the strike from 10-3-’15 to 20-3-’15 several Individuals Dignitaries, Ministries supported the cause of the GDS for their legitimate demand of a ‘Judicial Committee’.

Hence, while expressing our sincere thanks to the Directorate for it’s efforts in getting the GDS included in 7th CPC,   our  union trusts that the Directorate will uphold the values of Democratic system of our country and honour the ‘Agreement Reached in Feb’14’  for  considering of ‘Appointment of a Judicial Committee’ and now cause immediate justice to the entire GDS fraternity by implementing the said ‘Agreement’ in it’s true letter and spirit for which our union will always be grateful  and thankful to you, Madam.

In this connection, Our union once again cordially requests the Directorate for taking into consideration our views also before referring any terms of references to the proposed ‘Judicial Committee’ for which our union will be ever grateful to you, Madam.

Com. B. G. TAMANKAR EX. PRESIDENT NFPE NO MORE

Comrade B G TAMHANKAR IS NO MORE. Com.Tamhankar passed away today in the early hours. It was a shocking news when we heard him severely ill some time ago.  HAVING MAINTAINED SOBER PERSONALITY INDIVIDUALLY AND COLLECTIVELY THROUGHT HIS PUBLIC LIFE HE PROVED HIMSELF A MODEL. May his soul rest in peace and let the bereaved get strength to bear unbearable LOSS. His continued support to AIGDSU for the cause of GDS unforgettable.

BOTH DEPARTMENTAL AND GDS EMPLOYEES ARE BEING CHEATED ONCE AGAIN BY POSTAL JCA (NFPE-FNPO) AS USUAL.

THIS IS THE FIFTH TIME POSTAL JCA WITHDREW THE STRIKE WITHOUT SINGLE ACHIEVEMENT

POSTAL JCA  ACCEPTED OFFICERS COMMITTEE BY ARGUING THAT THERE IS NO DIFFERENCE BETWEEN JUDICIAL COMMITTEE AND OFFICERS COMMITTEE. THEY MORTGAGED 2.62 LAKHS GDS EMPLOYEES FUTURE TO THE ADMINISTRATION.

POSTAL JCA PLAYED CHEAP TRICKS BY REQUESTING THE DEPARTMENT TO REFER GDS ISSUE THIRD TIME TO DEPARTMENT OF EXPENDITURE TO PREVENT APPOINTMENT OF JUDICIAL COMMITTEE.

Dear Comrades,

History repeats. Postal JCA deferred the proposed indefinite strike of 6th May, 2015 without any achievement by cheating both the departmental and GDS employees once again.

The announcement of indefinite strike of 6th May was made before Six Months. Postal JCA leaders created illusion among the postal employees that all the Central Government unions i.e. Railway, Defence, income tax etc are going to participate in the indefinite strike for the cause of GDS employees i.e. inclusion of GDS in the terms of reference of 7th Central Pay Commission.

It is known fact that the Department of Expenditure denied the GDS inclusion in the month of November, 2014. While postal JCA kept quiet on this issue AIGDSU conducted series of heroic struggles including indefinite strikes in Feb, 2014 and March, 2015. Postal JCA tried to dilute and divert AIGDSU agitations supporting the administration.  

Once again in the month of April, 2015 Department of expenditure denied the GDS inclusion in 7th CPC. Then also no action has been taken by PJCA.

The Dept. of posts convened meeting with postal JCA leaders to discuss the Charter of demands on 05.02.2015. After the meeting, the postal JCA leaders expressed strong dissatisfaction about the replies given by the Department and decided to go on indefinite strike. After the strike notice issued by postal JCA, Again the Dept. convened the meeting with postal JCA leaders on 30.04.2015 and same replies were given without changing comma, full stop. There is no development and no changing in the attitude of the Department towards the Charter of demands. Surprisingly the postal JCA deferred the indefinite strike. What a pity!

In the case of AIGDSU, there is a total difference in the replies given by the department on 19.02.2015 before the strike and on 24.03.2015 after the strike. After


the indefinite strike of AIGDSU positive replies were given. That is the achievement of AIGDSU indefinite strike. Our struggle is beginning to move towards the regularization. All the postal fraternity are requested to analyze the difference between the struggles of AIGDSU and others.

Most important demands i.e. grant merger of 100% D.A with Pay w.e.f. 01.01.2014, grant of 25% Pay as interim Relief (IR) w.e.f. 01.01.2014 were totally rejected. But PJCA ranaway from the battle field before beginning the battle surrendering the postal trade union movement at the feet of administration.  

We came to know that PJCA agreed to act as per the aspirations of Dept. to prevent appointment of Judicial Committee as demanded by AIGDSU. Because of that hidden agenda PJCA requested the Department to refer the GDS issue to Department of expenditure third time.

It is also known fact that the PJCA repeatedly propagated about the participation of Railway, Defence etc unions in 6th May strike to cheat the postal employees particularly GDS employees. AIGDSU obviously told this from the beginning. It proved now.

We would like to remind all the postal fraternity particularly GDS employees Nobody except AIGDSU has guts to fight for the cause of GDS employees.

Hence CHQ appeals all GDS that the doors of AIGDSU are always kept open for all GDS to build broder unity among GDS to fight effectively and efficiently to achieve the regularization demand by indefinite strikes in future. Join in AIGDSU with confidence and hope.
SEND CD TO CHQ
All Divisional/Branch Secretaries are requested to send the actual work load of all categories of GDS for one post in division by making CD for defending to Justify  regularization demand. Prepare CD’s regarding the work of GDS and send to CHQ.

RE- VERIFICATION OF MEMBERSHIP
Verification of Membership has been started for departmental employees. It is learnt that some new unions have applied for participation.

Pertaining to GDS, it will be in the beginning of 2016. All the Circle, Divisional Branch Secretaries are requested to alert all our comrades to strengthen our union.

SEND CHQ DUES
All Circle, Divisional, Branch Secretaries are requested to take initiation to send Quota to CHQ to improve the financial position. Please take interest to clear the due Quota. CHQ facing financial hardships due to series of struggles. Many Divisions and Branches are not responded the request of CHQ. Take responsibility. Clear early. Send revised Quota Rs. 5-00 each member.
