Indefinite strike deffered.

Sub: - Proposed Indefinite Strike by the G.D.S employees with effect from 3rd March,2009.

Dear Comrades,

We are overwhelmed with the tremendous response to our strike call from every quarter of this organisation and we extend hearty Congratulation to every member. The reports that we are receiving about the preparations are heartthrilling. Hats off to you, Comrades! We were rather forced to take this decision due to the negativity of the Postal Administration.

In the mean time certain developments have taken place. The Parliament (Lok Sabha) which had the last session of its tenure held from 13th to 26th February,2009 and now stands adjoumed sine-die. Election notification is likely to be issued shortly and with it the election proceedings begin.

The Chief Labour Commissioner (C), Ministry of Labour and Employment New Delhi has intervened in the case and Conciliation proceedings began on 26th February,2009. The Chief Labour Commissioner (C) asked the Postal Administration to hold effective discussions on our demands for an amicable settlement. The Postal Administration, with an intention to meet the requirements of the Conciliation proceedings invited us for discussion on 27.01.2009 but adopted a negative and indifferent attitude. The talks fell casuality to the negativity of the Postal Administration. There was neither any purposeful attempt nor sincerity to find out a solution. Simply a formality was observed. However, this can not the end of the matter.

The Chief Labour Commissioner has advised us not to resort to strike during the pendency of the Conciliation proceedings. We, as a responsible Trade Union, do have Confidence in Conciliation. We resort to strike only when all other attempts fail and talks break down. We have, therefore, requested the Chief Labour Commissioner to ensure that the next round discussion with administration is held in his office and in his presence. The next date of conciliation has been fixed on 12.03.2009.

Keeping the entire developments and Circumstances in view and expressing full confidence in the rule of law and efficacy of Conciliation, we hereby defer the proposed indefinite strike from 03.03.2009 till further notice, subject to the Condition that any exparte and arbitrary action or decision of the Postal Administration which is against our interests, or is detrimental to us will be met severe retaliatory action.

Comrades, this break should be utilized for further galvanization and strengthening of organisation, for education of members and for making fool-proof preparations for the effective struggle, in case the Department Continues to be negative and back-tracking, at the shortest notice.

Subject: -Proposed strike by All India Postal Extra Departmental Employees Union – Conciliation proceedings.

Sir,


We were of the view that the Department will act with sincere attempt, as per your advice to find out a solution। But the talks the Administration held with us on 27.02.2009 were not purposeful. The Postal Administration refused to give us any indication of what they were proposing to do or not to do. They even refused issue any minutes or record of discussion. The meeting, it appears, was held to meet the requirements of the minutes of the conciliation proceedings, and not as an endeavour to end the dispute.

However, we as a responsible trade union have full confidence in the conciliation and as per your advice we are deferring the strike till further notice with the hope that your goodself will arrange the next discussion between the Postal Administration and the union in your office and your presence to ensure an amicable settlement of the dispute. In case the Postal administration acts exparte or arbitrarily to the detriment of the Gramin Dak Sevaks, we reserve the right to resort to industrial action for justice.
