Subject:- Certain important matters and developments to think over.



Dear Comrades,



          At the outset we condole the deaths of the people on account of the severe earth-quake in Sikkim, Bhutan, Nepal, West Bengal, Bihar and Jharkhand. We offer our sympathies to those who have suffered losses at the hands of the devastating earth quake.



The holy Ramdan and Idul fitr have passed away and the festivals of Durgapuja and Diwali are fast approaching. We offer our greetings on this occasion. What we are actually concerned about is whether we shall be able to fulfill the aspirations of our young ones on these occasions. The inflation has been rising unabated and naturally the pay-packets are shrinking not with standing the installment of D.A. Which has fallen due and 7% D.A. relief has been approved. Orders are expected any time. But the moot problem remains as it is.



There are other problems and developments as well and the strike issues remain totally unsettled. We would not like to mislead our members on that score. Other developments are as follows:-



BONUS:      Despite our consistent efforts and solid arguments, the discrimination regarding the ceiling on salary i.e. Rs. 2500/- for us continues. The powers-that be have become so insensitive to the problems of the GDS employees. We shall have to put our heads together and think of some positive methods. As regards the quantum of bonus, though nothing has emerged so far it is likely to be about the same as last year.



But one thing that appearers not to have been given any consideration by any of the concerned entities-be it government or the employees representatives-is that even the ceiling of Rs. 3500/- has become totally irrelevant and requires immediate upward revision, proportionate to the rate of inflation over the period.



TIGHTENED NORMS:-   We have been repeatedly hammering the issue about impractibility of the tightened norms-especially in respect of cash handling and stamp-sale, but there is no reaction from the administration. The justified arguments are not being heard. There is deficits of empathy. We again have to think over the issue very deeply to find out a solution.



NORMS for COMPASSIONATE APPOINTMENT:           The Directorate has evolved strange norms, called the merit points to weigh the justification for appointment on compassionate grounds on death or incapacitation during service. We have written repeatedly to show that these norms are totally embalanced and impracticable. On the scale of these norms not even a single case would justify for such appointment. It does not require intelligence to understand that required qualification of gradation for appointment as GDS is not a product of normal thinking.



Nothing positive is coming out and cases are being rejected on the basis of these abnormal merit points. In case the powers-that be do not move, we shall have to seriously think of some way out.



GDS (CONDUCT & ENGAGEMENT) RULES:        The ED As (Conduct and Services) Rules, 1964 were replaced by GDS (Conduct & Appointment) Rules 2001. There was a fundamental



change and some intension is very clearly seen when the term "Service" was replaced with "Employment"; and now the term "Employment" has been replaced with "Engagement." Every body is aware that the Hon'ble Supreme Court of India has in its Judgement has held that ours is a "Service" and an "appointment" to a post which exists. Was the Wiseman who presided over the ED Committee above the Supreme Court of India that the Department has bowed down to obey its illegal and unwarranted recommendation regarding change of the service Rules?. In the long run it may hurt us grievously and our attempts to get suitable action taken has not produced results. Kindly advise us what to do next.



POSTMEN RECRUITMENT RULES: The avenues of promotion for the GDS staff is very little. They are appointed as group 'D' and postmen on promotion. While, regarding recruitment as group 'D' (now multi functional group 'C') there is not much clarity, the Postmen Recruitment Rules have been made to go against the interests of GDS staff as our quota has been curtailed. A very glaring discrimination is that while everyone not only in our department but also in other departments is enjoying three automatic promotions, there is none for the GDS employees. All these are glaring examples of crude discrimination. We shall have to find a way out of this. We are looking forward to your suggestion.
 
REMMITTANCE OF QUOTA:   Comrades, the position of receipt of quota by the CHQ is again very disheartening. The Divisional/Branch union get their subscription every month from the DDO's but the remittance of quota to CHQ is rather very casual. The Divisional Presidents and Secretaries will please ensure timely remittance of quota.



TAILPIECE:          The planning commission has told the Hon'ble Supreme Court that is urban areas if a person spends Rs. 32/- per day per member and in rural areas a sum of Rs. 26/- is spent per day per members, the person in not poor i.e. he is reach) to receive the benefit of schemes of government. This shows the bankrupcy of moral sentiments of those in planning Commission working  from Air conditioned cambers who probably spend more than Rs. 32/- over a cup of tea. This is the contradiction of five star culture on one hand and near starving situation faced by the majority on the other. This what the government prides itself in calling the government of "aam admi".











Comrades, in order to register our resentment and anger against the administration's failure to address our problems which are piling up like a mountain, we hereby call upon all Circle unions to observe one day Dharna at Circle/Region Head Quarters on 12 October, 2011 as first step of our agitational programme. Further programme will be announced in due course. After the conclusion of the dharna please send the following savingram to the Minister of State for Communications and IT New Delhi and Secretary Department of Posts, New Delhi-110001



          "Problems of GDS employees are piling up without any concrete steps by administration to address them kindly intervene.



          The problems are:-



  1. Discrimination in bonus ceiling
  2. Tightened norms
  3. Abnormal merit points for relaxation appointment.
  4. Illegal replacement of GDS (Conduct & Employment) Rules 2001 with GDS (Conduct & Engagement) Rules 2011
  5. Postmen Recruitment Rules affecting interests of GDS staff adversely
  6. Three time bound promotions (financial up gradation) for GDS employees.

Subject:- Productivity Linked Bonus for the Accounting year 2010-2011

Sir/Madam,

I am directed to convey the approval of the President of India for payment of Productivity Linked Bonus for the accounting year 2010-2011 equivalent of emoluments of 60 (Sixty) days to the employees of Department of Posts in Group `D`,Group `C` and non Gazetted Group `B`. Ex-gratia payment of Bonus to Gramin Dak Sevaks who are regularly appointed after observing all appointment formalities and adhoc payment of Bonus to Casual labourers who have been conferred Temporary Status are also to be paid equivalent to allowance/wages respectively for 60 (sixty) Days for the same period.

1.1 The calculation for the purpose of payment of Bonus under each category will be done as indicated below.

2. REGULAR EMPLOYEES:

2.1 Bonus will be calculated on the basis of the following formula:-

Average emoluments X Number of days of Bonus

30.4 (Average no. of days in a month)

2.2 The term "Emoluments" for regular Employees include basic Pay in the pay Band plus Grade Pay, Dearness Pay, Personal Pay, Special Pay (Allowance), S.B. Allowance, Deputation (Duty ) Allowance, Dearness Allowance and Training Allowance given to Faculty Members in Training Institutes. In case of drawl of salary exceeding Rs.3500/- (Rs. Three Thousand Five hundred only) in any month during the accounting year 2009-10 the Emoluments shall be restricted to Rs.3500/- (Rs. Three Thousand Five hundred only) per month only.

2.3 " Average Emoluments" for regular Employees is arrived at by dividing by twelve ,the total salary drawn during the year 2010-11 for the period from 1.4.2010 to 31.3.2011, by restricting each month's salary to Rs.3500/- (Rs. Three Thousand Five hundred only) per month. However, for the periods of EOL and dies-non in a given month ,proportionate deduction is required to be made from the ceiling limit of Rs.3500/- (Rs. Three Thousand Five hundred only)

2.4 In case of those regular employees who were under suspension, or on whom dies-non was imposed ,or both, during the accounting year, the clarificatory order issued vide Paras 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt-I) dated 11.6.81 and No. 26-4/87-PAP (Pt.II) dated 8.2.88 will apply.

2.5 Those employees who resigned, retired, left service or proceeded on deputation within the Department of Posts or those who have proceeded on deputation outside the Department of Posts on or after 1.4.2010 will also be entitled to Bonus. In case of all such employees, the Bonus admissible will be as per provisions of Para 2.1 to 2.3 above.

3. GRAMIN DAK SEVAKS (GDS)

3.1 In respect of Gramin Dak Sevaks who were on duty through out the year during 2010-2011, Average monthly Time Related Continuity Allowance will be calculated taking into account the Time Related Continuity Allowance (TRCA) plus corresponding Dearness Allowance drawn by them for the period from 1.4.2010 to 31.3.2011 divided by 12 (Twelve). However, where the Time Related Continuity Allowance exceeds Rs 2500/- (Rs.Two Thousand Five hundred only) in any month during this period., the allowances will be restricted to Rs 2500/- (Rs.Two Thousand Five hundred only) per month. Ex-gratia payment of Bonus may be calculated by applying the Bonus formula as mentioned below:-

Average TRCA X Number of days of Bonus

30.4 (Average no. of days in a month)

3.2 The allowances drawn by a substitute will not be counted towards Bonus calculation for either the substitute or the incumbent Gramin Dak Sevaks. In respect of those Gramin Dak Sevaks who were appointed in short term vacancies in Postman/Group `D` Cadre, the clarificatory orders issued vide Directorate letter No. 26-6/89-PAP dated 6.2.1990 and No. 26-7/90-PAP dated 4.7.91 will apply.

3.3 If a Gramin Dak Sevak has been on duty for a part or the year by way of a fresh appointment, or for having been put off duty, or for having left service,he will be paid proportionate ex-gratia Bonus calculated by applying the procedure prescribed in Para 3.1

3.4 Those Gramin Dak Sevaks who have resigned, discharged or left service on or after 1.4.2010 will also be entitled to proportionate ex-gratia Bonus. In case of all such Gramin Dak Sevaks, the Ex-gratia Bonus admissible will be as per provisions of Para 3.1 above.

3.5 In case of those Gramin Dak Sevaks who were under put off duty or on whom dies non was imposed, or both during the accounting year ,the clarificatory orders issued vide Para 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt I) dated 11.6.81 and No. 26-4/87-PAP (Pt II) will apply.

4. FULL TIME CASUAL LABOURERS INCLUDING TEMPORARY STATUS CASUAL LABOURERS)

4.1 Full Time Casual Labourers (including Temporary Status Casual Labourers ) who worked for 8 hours a day, for at least 240 days in a year for three consecutive years or more (206 days in each year for three years or more in case of offices observing 5 days a week) as on 31.3.2011 will be paid ad-hoc Bonus on notional monthly wages of Rs.1200/- (Rupees Twelve Hundred only)

The maximum ad-0hoc Bonus will be calculated as below:-

(Notional monthly wages of Rs.1200) X (Number of days of Bonus)

Accordingly , the rate of Bonus per day will work out as indicated below:_

The above rate of Bonus per day may be applied to the number of days for which the services of such casual labourers had been utilized during the period from 1.4.2010 to 31.3.2011. In case where the actual wages in any month fall below during the period 1.4.2010 to 31.3.2011 the actual monthly wages drawn should be taken into account to arrive at the actual ad-hoc Bonus due in such cases.

5. The amount of Bonus /Ex gratia payment /Adhoc Bonus payable under this order will be rounded to the nearest rupee. The payment of Productivity Linked Bonus as well as the ex-gratia payment and ad-hoc payment will be chargeable to the Head `Salaries` under the relevant Sub –Head of account to which the pay and allowances of the staff are debited. The payment will be met from the sanctioned grant for the year 2011-2012.

6. After payment, the total expenditure incurred and the number of employees paid may be ascertained from all units by Circle and consolidated figures be intimated to the Budget Section of the Department of Posts. The Budget Section will furnish consolidated information to PAP Section about the total amount of Bonus paid and the total number of employees (category-wise) to whom it was distributed for the Department as a whole.

The Orders for payment of PLB for Postal Employees have been issued today evening. It will be 60 Days. The maximum ceiling will be Rs.3500/- for Regular Employees; Rs.2500/- for GDS; and Rs.1200/- for Casual including Temporary Status Casual Labourers.

Sub: Revision of Special Allowance and Cash Handling Allowance as a result ofenhancement of Dearness Allowance w.e.f. 1.1.2011

This Department has been receiving references regarding revision of Special Allowance and Cash Handling Allowance subsequent to increase in the rate of DA @ 51% w.e.f. 1.1.2011.

2. This Department's O.M.No.4/6/2008-Estt.(Pay II) dated 1st October,2008 states that the rates of Special Allowance and Cash Handling Allowance will be automatically increased by 25% every time the Dearness Allowance payable on revised pay scales goes up by 50%.

3. All Ministries /Deptts. are, therefore, advised to take necessary action accordingly.

GOVT APPROVED 7% D.A.

CABINET COMMITTEE APPROVED 7% DEARNESS ALLOWANCE HIKE FOR CENTRAL GOVERNMENT EMPLOYEES AND PENSIONERS

 

The Union Cabinet today approved to increase Dearness Allowance by 7% to Central Government employees. The rate of Dearness allowance shall be enhanced from the existing rate of 51% to 58%. Revised rates effective from 1.7.2011. Orders will be issued by Finance Ministry in next week.

Discrimination between Departmental and GDS employees in respect of ceiling on amount for calculation of Bonus.

Subject:- Discrimination between Departmental and GDS employees in respect of ceiling on amount for calculation of Bonus.

 

Madam,

 

          We feel that the theory of pegging the ceiling on pay to certain amount not with standing the actual amount of pay and fixing Rs. 3500/- for departmental employees and Rs 2500/- for GDS employees has not received correct assessment. The pay of Rs. 3500/- or Rs. 2500/- has not been fixed on scientific basis. The bonus is to be calculated taking the amount of Rs. 3500/- as pay be what so ever the actual pay. The principle is that where is pay is more than 3500/-the bonus will be calculated on Rs. 3500/- as pay. Supposing the average annual pay of an employee—departmental or GDS. (as in case of seasonal employees)—the bonus has to be calculated on his actual pay. If such average salary is less than Rs. 3500/- This principle does not make any difference between departmental and GDS employees. Where the pay of the GDS is more than Rs. 3500/- it has to be pegged down to the fixed amount. But this principle does not justify the lesser amount of Rs. 2500/-. In case, the bonus were to be fixed on the basis of actual pay or ratio between the class of employees, there would been a higher ceiling for HSG-I officer, and lesser ceiling for a group 'D' (now multi functional Group 'C'). The principle of Bonus being a deferred wage is not fully observed in making two different pay-ceilings.

 

          Had the bonus to be calculated on the actual amount of pay, the GDS employees would not have any qualm regarding lesser bonus because it would be according to law.

 

          For the purpose of arriving at the number of days for which bonus is to be granted, an HSG-I employees is taken as one unit and also a group 'D'. There is no separate yard stick for calculation on the basis of quality of work or pay of the incumbent. Similarly, since generally, the pay of a GDS employees are more than Rs. 3500/- it has to be pegged down to Rs. 3500/- and where the emoluments are less than Rs. 3500/-, the bonus has to be calculated on the actual pay.

         

          The principle does not call for any discrimination and has to be considered to the principle of deferred wage.

 

          We, therefore, request you kindly to take necessary action at your level, that this discrimination is put an end to and ceiling for GDS employees also be raised to the amount equal for all other employees.

Easing extremely tightened norms in respect of cash-handling and sale of stamps for assessing the work of GDS BPM; Providing norms for new items of work.

Sub:- Easing extremely tightened norms in respect of cash-handling and sale of stamps for assessing the work of GDS BPM; Providing norms for new items of work.

 

Madam,

 

          The tightened norms for assessing the work load of BPMs, especially in respect of cash-handling and stamp-sale are taking heaving talls and are against the norms of condition based work. The GDS employees work in rural areas where cash is collected in small amounts and at different frequencies. It is not like the Post offices in urban areas where cash in collected in big quantities. More ever the denomination of the cash handled plays a big role. While in towns and cities GC notes of high denomination are presented or dealt out and in the rural areas it in shape of GC notes of small denomination and even more often in coins. No one can disagree that the conditions in rural areas are differ from those in urban areas and there cannot be an identical yard stick of measurement for both. Therefore, the yardstick of 20,000 of cash handled for one point- a rise of twenty times from the earthier one- is too heavy, too hard and is beyond any principled approach.

 

          Similarly, the time provided for sale of stamps in urban and rural areas has been the same. While in urban area there is a person performing a particular job-say sale of stamps, in the branch office, the same man does all sorts of work. It takes time in taking up work from another. Moreover, in village the stamp sale mainly accounts for sale of Postcards, and inland letters cards, and at times of embossed envelops; in urban areas- registration, V.P., Parcel etc account mainly for the same. The two conditions are vastly different and call for different yardsticks of late the GDS employees have undertaken a series of new work, say, PLI, MNREGA, payment of electric bill etc. No norms have been prescribed for such work. You will kindly agree that the concept of honorarium is meant for casual work and not for perennial business. Non-provision of time factor such work is working very hard against the interests of the GDS employees. It is high time that time factor is provided for all new types of work under taken by the GDS staff.

 

          We, therefore, request you kindly to examine the factors dispassionately and get the extremely tightened norms reviewed on realistic assessment and eased accordingly. It is further requested that proper norms be prescribed for the new types of work undertaken by GDS employees.

DECLARATION



          The National Convention of Workers being held on 7th September 2011 at Mavalanker Hall, New Delhi noted with serious concern that despite several rounds of all in united protests by the entire trade union movement of the country, the Govt. has remained totally unresponsive to major concerns of the working people.



        Practically no step has been taken by the Govt. to address the basic demands of the workers being pressed through joint memorandum by the Central Trade Unions to honourable Prime Minister and the Lok Sabha Speaker and various other joint countrywide programmes.



        Rather, aggressive moves are being taken to further aggravate the rise in prices through frequent hike in prices of petrol, Diesel, LPG and Kerosene. Disinvestment of shares of Public Sector Units is being actively pushed through by the Govt. to facilitate phased privatization of the highly profit-making PSUs. Existing labour rights including right to form union and to social security and pension are being sought to be curbed through various legislative and administrative moves. Mass scale contractorisation of the regular work is continuing in all the workplaces including in PSUs and Govt. establishments. Contract workers are not being paid in most of the places even the statutory minimum wages which is very low to meet the basic requirements for a human living.



        The National Convention also expresses its serious concern over the flaring up of rampant corruption all around and huge black-money-generation in the economy and seeks to draw the attention of the Govt. to the widespread popular discontent and disgust over the issue of corruption demanding concrete legislative and administrative measures and change in the economic policy regime to eradicate and prevent corruption and bring back the black money stashed abroad.



        The National Convention calls upon the working people of the country to further widen the unity achieved through united struggle and launch united protest against the unresponsive approach of the Govt through intensified countrywide struggles.



        While reiterating the five point demands formulated jointly by the Central Trade Unions and Federations for 1) concrete measures to contain price rise 2) concrete measures for linkage of employment protection with the concession/incentive package offered to the entrepreneurs, 3) Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws, 4) universal social security cover tor the unorganized sector workers without any restriction and creation of a NCEUS and Parliamentary Standing Committee on Labour and 5) Stoppage of disinvestment in central and state PSUs, the National Convention of Workers also demands immediate action by the Govt of India to ensure:-



·                    No Contractorisation of work of permanent/perennial nature and till then payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the industry/establishment

·                    Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs.10,000/- per month with indexation.

·                    Remove all ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.

·                    Assured Pension for all

·                    Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO Conventions nos 87 and 98



To pres the above demands and to prepare for higher level of united action, the National Convention decides to hold Countrywide multiple forms of action such as SATYAGRAH/JAIL BHARO, MASS SQUATTING etc. in all the state capitals and industrial centres on 8th NOVEMBER 2011.



The National Convention also calls upon all the trade unions and workers and employees in general irrespective of affiliations to hold statewise and industrywise conventions to make the above programme a total success and prepare for countrywide GENERAL STRIKE as early as possible in the next phase.

2.         The revised dates for LGO Examination and IP Examination 2011 have been fixed as 15th October for LGO and 15th & 16th October 2011 for IP Examination.
