Subject:       Clarification regarding given option for alteration/withdrawal or inclusion of new membership of service associations/unions in the month of April each year to be made effective from the month of July of that year.

 

Sir/Madam,

           

                        I am directed to refer to the Department's letter no. 13-1/93-SR dated 25.02.1994 circulating Department of Personnel & Training's OM No. 2/10/80-JCA dated 31.01.1994 regarding procedure for verification of membership of associations for the purpose of recognition under CCS(RSA) Rules, 1993. In accordance with instructions contained in said OM, option, if any, for alteration, withdrawal or inclusion of new members is to be given in the month of April each year to DDO or any other designated authority.

 

2.         The Department, vide letter No. 13/01/2010-SR dated 18.02.2010, modified 'letter of authorization' prescribed by the DOPT specifically in order to comply with the directions of the Hon'ble Court of Madras given in Writ Petitions No. 4704-4707 of 1999 and Contempt Petition No. 950/09. The modified 'letter of authorization' was endorsed with signature of Director (SR & Legal) with an objective to rule out the possibility of using the old forms bearing the signature of the employees, as some of the associations had complained about it. The signature of Director (SR & legal) has no relevance in regard to letters of authorization which may be used for change of option or for seeking new membership in the month of April every year.

 

3.         All the 'letter of authorization' whether bearing Director (SR & Legal)'s signature or not, applied during the month of April may be considered as per the standing instructions and in view of the clarification in the preceding paragraph.

            I am directed to refer to the Directorates letter No. 37-63/98-SPB-I (Pt) dated 20/26.8.1999 regarding increasing the number of chances to appear in the Limited Departmental Competitive Examination (LGO Examination) to fill up the posts of Postal Assistant/Sorting Assistant from 5 to 6. The matter has since been reviewed and it has been decided by the competent authority to increase the number of chances for OC candidates to appear in the Limited Departmental Competitive Examination (LGO Examination) to fill up the posts of Postal Assistant/Sorting Assistant from 6 to 8. It has also been decided to increase the chances for SC/ST candidates to appear in the said examination to 10 provided there are vacancies reserved for candidates belonging to SC/ST and in case any SC/ST candidate is appointed on the basis of his/her 9th or 10th chance he/she shall be appointed against the vacancy reserved for SC/ST, as the case may be, irrespective of his/her merit in the examination.

 

2.         It is requested that these instructions may be given wide publicity immediately.

Wrong mention eligibility-period for grant of ex-gratia gratuity to GDS employees

Sub:-    Wrong mention eligibility-period for grant of ex-gratia gratuity to GDS employees as existing  prior to the implementation of recommendations of Nataraja Murti Committee-correction to be made.

 

Ref:   Annexure III to your office letter No. 6-1/2009.PE II dated 9.10.2009

 

Madam,

 

          In respect of grant of gratuity it has been mentioned in Annexure-III of the above letter that the eligible period for grant of ex-gratia gratuity to the GDS employees as existing (prior to the issue of the letter) was 15 years. This is totally incorrect and Sri Nataraja Murti probably made such a recommendation with incorrect period to show that he was sympathetic towards GDS employees. The period for grant of ex-gratia gratuity has all along been ten years (and never 15 year) as can be seen from several letters issued by the Directorate beginning from DGP&T letter No. 43-48/64-Pen dated 16.1.1968 and ending with DG(P) letters NO. 29/87-PE-II/ED&Trg. dated 7.1.1993.

 

          Youare, therefore, requested kindly to make necessary correction to this incorrect mention of periodically.

Deferment of the proposed indefinite Strike and other related matters.

Subject: - Deferment of the proposed indefinite Strike and other related matters.

Dear Comrade,

        By this time the news of deferment of the proposed strike from 5th July, 2011 has reached every member. We feel the members must have discussed amongst themselves this development. We shall be happy for feed-back from the Circles and Branches about their feelings. As for the CHQ, we are not that satisfied with the outcome. Comrades, we are disappointed that due to serious illness comrade S.S. Mahadevaiah, General Secretary, was not able to personally take part in the meeting takes by the Secretary on the demands but our case and view point was ably presented by Com. Rajendra Prasad Diwakar, Financial Secretary,(CHQ); Com. Datta Ram, Asst. General Secretary; Com. Lakhwinder Pal Singh, Asst. Asst. Treasurer (CHQ) and Com. Rambir Singh, Circle Secretary, Delhi Circle, AIPEDEU. The other members of the JCA expressed satisfaction with the assurances given by the Administration and the strike was deferred.

 

        You are aware that our demand in the charter of demands was status of Central Civil Servant to the GDS employees for all purposes which includes proper service condition, increments at par with other Central goverment employees, pensioner benefits, leave, bonus and Trade Union Facilities.Other demands included withdrawal of Gramin Dak Sevaks (Conduct & Engagement) Rules, 2011, Scrapping the new rules for promotion to postmen cadre, and withdrawal of the tightened norms for measurement of work hours of BPMs, especially cash handling of Rs. 20,000 for one point.

        The administration assured that they will consult other related departments regarding status to GDS employees. They assured review of the rules for promotion to Postmen Cadre, tightened norms of Cash-handling, bonus ceiling of Rs. 3500/-(To be taken up with Finance Ministry) appointment of casual labourers and contingent paid staff as the GDS. We are enclosing a copy the official minutes relating to the GDS demands.

        We are aware that the Circle level and Divisional/Branch level leadership strained all nerves in making solid preparations for success of the strike. We congratulate all such active workers and membership in general for their tremendous work.

Central Working Meeting on 18.06.2011

        The Central Working Committee of the union met at Chennai on 18.06.2011 under the presidentship of Com. D.N. Giri, President of the Union. Out of 22 Circle, twenty one Circle were represented at the CWC meeting which was inaugurated by Com. N. Balsubramanian, Ex-Circle Secretary, P-3, Tamilnadu Circle; Com. S.S. Manjunath, Circle Secretary, P-3, Karnataka; Com. S.C. Jain, Circle Secretary, P-3, M.P. Circle; Com. H.P. Diwaker, Circle Secretary,P-3, Rajasthan, Com. G.S. Asiwal, Ex-Circle Secretary, P-3, M.P. Circle; Com. D.P. Diwaker, Senior Leader Rajasthan Circle amongst others GDS members of RMS of Tamilnadu Circle Union made excellent arrangements for successful deliberations of the CWC. Our thanks to them.

 

The Central Working Committee, after serious discussions and deliberations adopted the following resolutions:

 

1.            Scrap Gramin Dak Sevaks (Conduct and Engagement) Rules 2011 and grant "Status/Regularisation as Government Servant" to GDS employees.

Implement Supreme Court Judgement for Payment of DCRG and Pension to all GDS employees.

2.            Family pension scheme at par with regular employees is to be introduced for GDS also.

 

3.            Grant all retirement benefits with effect from 01.01.2006.

4.            Remove present age condition and enhance age limit up to 40 years, 43 years and 45 years for O.C., O.B.C and SC/ST for appearing P.A Examination. The present system of selection to PAS from GDS should be changed. GDS employees should be selected in order of merit of written examination irrespective of last selected candidate's percentage of marks.

5.            Syllabus and new pattern for promotion examination of postman and multitask staff should be released at earliest convenience. Remove the condition offering 25% postmen and Multitask Staff vacancies to the outsiders. New recruitment rules for Postman and Multitask Staff should be modified in consultation with GDS, CHQ.

6.            Remove tightening of norms for GDS BPMs i.e. Rs. 20,000/- to earn one point and Rs. 900/- stamp sale for one point and allow status quo Ante.

7.            Grant Transfers to GDS without affecting the yearly increases earned by them.

8.            Grant Rs. 3500/- Ceiling as Bonus to GDS employees.

9.            Grant all Trade Union Facilities to GDS union at all leads and its office leaves including Foreign Service to Chief executives form Circle to All India.

10.         Formation of JCM at all levels with GDS representatives to negotiate the Anomalies of GDS Committee to redress the grievances of GDS employees.

Comrades, we are making every effort to realize the demands. As a matter of fact, there appears to be propress in movement of the files. We are on vigilant.

Union-Building

Regarding donation towards union building for the CHQ, a proposal to appoint Regional Sub-Committee has been adopted. We shall be giving more details about it in our next bulletin.

 

          Dear Comrades, Circumnstances keep an changing and changes are sure to take place. We are confident that the service conditions of the GDS employees will certainly improve.

          Last but not the least:- The Central Working Committee expressed grave dissatisfaction over non-payment quota and arrears of quota to the Circle Unions and to the CHQ. The CWC has decided that in case of failure to remit full quota and arrears of quota. The CHQ and Circle unions will take strong action under the provisions of the constitution. We believe that Divisional and Branch unions will not be failing in the matter of remittance of quota and will not provide any ground for any action on this score.

Minutes of the meetings taken by Secretary(P) Member (operations) with Postal Joint Council of Action comprising National Federation of Postal Employees (NFPE), Federation of National Postal organizations (FNPO) (along with their affiliated associations), All India Postal Extra Departmental Employees Union (AIPEDEU) and National Union of Gramin Dak Sevaks (NUGDS), on 27.06.2011, 29.06.2011, 30.06.2011 and 01.07.2011. 

 

Item No.2

On the issue of grant of civil servant status to Gramin Dak Sevaks, the Staff Side was apprised that it was not within the competence of the Department to take a view in the matter. As regards, scrapping of new recruitment rules for Postman Cadre, relaxation of norms for cash handling, stopping reduction of TRCA in case of reduction in work load, removal of ceiling in the matter of compassionate appointment, adjustment of part time casual labourers and contingent workers against Gramin Dak Sevaks Posts, it was agreed to have a re-look by the Department. On the persistent demands of Staff Side, the Chairperson agreed to send a proposal to the Ministry of Finance for enhancement of Ceiling of bonus to 3500/- in case of Gramin Dak Sevaks.

LETTER TO HON'BLE MOC ON GDS ISSUES

Sub:- Wrong and illegal revision of "Department of Posts Gramin Dak

Sevaks (Conduct & Employment) Rules 2001" as Department of Posts (Conduct and Engagement) Rules, 2011.

 

Respected Sir,

 

          The Departmental of Posts revised the then existing "Department of Posts  E.D Agents (Conduct & Service) Rules 1964" as Department of Posts G.D.S. (Conduct & Employment) Rules 2001" after the partial and turnicated implementation of the recommendations of Justice Talwar Committee. Since this was an obvious attempt of substitute the 'service' of the ED employees to mere 'employment' in order to obviate the recommendations of Justice Talwar Committee, we had registered our strong reservation and protest to this change, but the department chose to hang on to its decision.

 

          Now, by the amendment/revision of the rules especially by substituting the "employment" as "engagements" there has been a severe onslaught on the conditions of service of the G.D.S employees. This has been an attempt to over-ride the Judgement of the Hon'ble Supreme Court in P.K. Rajamma's case (Civil Appeals No 1172, 1354, 1355, 1751 of 1972). A copy of the Judgement is enclosed for ready reference. The Hon'ble Supreme Court has observed as below in the Judgement:

          "It is thus clear that an extra departmental agent is not a casual worker but holds a post under the administrative control of the state. It is apparent from the rules that the employment of an extra departmental agent is in a post which

 

exists "apart from"(sing) the person who happens to fill it at anytime. Though such a post is outside the regular Civil Services, there is no doubt it is a post under the state. The tests of a civil post laid down by this court in Kanak Chandra Datta's case (Supra) are clearly satisfied in the case of the extra departmental agents."

 

          The Hon'ble Supreme Court clearly hold that the ED Agent (now GDS employees) hold an employment against a post which exists. The Hon'ble Court has held that the ED Agent is not a casual worker and hence substitution of the "employment" as "engagement" is in letter contempt of the Judgement of the Hon'ble Supreme Court. We would respectfully submit that Mr. Nataraja Murti who recommended this substitution is not above the Supreme Court and the department should not have accepted and acted up on such recommendation bilind folded especially in face of the Judgement of the Supreme Court.

 

          As soon as the report of the one man committee under Sri Nataraja Murti, a retired bureaucrat was out, we lodged our strong protest against this recommendations vide our letter No. GDS/CHQ/41/1/2008 dated 03.11.2008 & 14/11/2008 but the Department chose to rush through the amendment to hurt the letter and spirit of the Judgement of the Supreme Court and the interests of the employees, despite our strong reservation and protest.

 

          We are confident that your goodself as an eminent jurist will consider the implications of the amendment in its right spirit and order that the amendment is withdrawn. We shall be thankful for restoration of 1964 rules.

Minutes of the meetings taken by Secretary(P) Member (operations) with Postal Joint Council of Action

Minutes of the meetings taken by Secretary(P) Member (operations) with Postal Joint Council of Action comprising National Federation of Postal Employees (NFPE), Federation of National Postal organizations (FNPO) (along with their affiliated associations), All India Postal Extra Departmental Employees Union (AIPEDEU) and National Union of Gramin Dak Sevaks (NUGDS), on 27.06.2011, 29.06.2011, 30.06.2011 and 01.07.2011.

 

The 25 point Charter of Demands served by JCA was discussed in the meetings held under the Chairpersonship of Secretary on the dates indicated above. The gist of Discussions is as follows:

 

Item No. 1

The mail arrangement made in the wake of creation of Speed Post Hubs and which, as represented by Staff Side, are causing delay as compared to the position prevailing before, will be reviewed by a Committee including Secretary General of both NFPE and FNPO. As regards, first class mail, the question of forming L-1 and L-2 will be reviewed along with the Staff Side by forming a Committee. Regarding closure/merger of Post Offices, the Staff Side requested that whenever there is a closure of a Post Office there should be a simultaneous relocation of PO in the new emerging areas etc. The view point of the Staff Side was agreed to. As regards change of Designation of sorting Postman, It was agreed to issue a clarificatory order in consultation with Mails Division.

 

Item No.2

In regard to casual labourers engaged prior to 1993, it was agreed to settle their case for payment on pro rata basis within one month. Post 01/09/1993 cases will also be taken up with Ministry of Finance etc for settlement.

 

Item No.4

The Staff Side was apprised that revision of OSA rates is under consideration in consultation with IFW and is being pursued closely. As regards OTA, the Staff Side was of the view that though it may not be within the competence of the Department to revise the OTA, but no official should be punished on the ground of non-performance of OTA. It was agreed to reiterate the earlier instructions issued on the subject.
